Family Archive CD License Agreement

The CD-ROM disc(s) is (are) licensed (not sold) to "you" (any individual, corporation, library, association, or other entity purchasing, owning, or using the software and/or data, including but not limited to professional genealogists and genealogy researchers for hire) for use under the following conditions:

You are licensed to:

1. Use the software and/or data on a single personal computer (by one person at a time) that is not used in any network, file server, virtual disk, timesharing, multiple CPU, other multi-user, bulletin board or remotely accessible arrangement.
2. Download to disk or reproduce in printed form, either on paper or in a personal electronically delivered message, limited portions of the data for incidental use. (For the purpose of this agreement, incidental use is defined as occasional use for yourself or for others provided the reproduction is minimal and reasonable -- within the Fair Use guidelines of the U.S. Copyright law.)

You may not:

1. Allow more than one user at a time.
2. Reproduce, publish, distribute, or sell any data on the Family Archive CDs.
3. Use the software and/or data on a network or bulletin board or place it in a multi-user environment without the express written permission of Broderbund Software.
4. Lease or rent the software, data, documentation or their use to any other individual or entity.
5. Disassemble, decompile or reverse engineer the software or data.

Limited Warranty

Broderbund Software warrants that the software and data substantially conform to the manual and or published specifications. This warranty is in effect for a period of one (1) year following your date of purchase. However, Broderbund Software does not warrant that the functions contained in the software and/or data will meet your requirements or that the operation of the software and/or data will be error-free. Broderbund Software does not guarantee the accuracy of data in the Family Archive CDs, and it cannot be automatically assumed that the information on the CDs is 100% accurate. Broderbund Software also warrants that the physical medium upon which the software is provided (e.g., diskettes or CD-ROM discs) are free from defects in materials and workmanship under normal use for a period of one (1) year. Broderbund will correct substantial software errors or replace defective diskettes or CD-ROM discs at no charge. If this is not possible, Broderbund will refund the amount paid for the product.

Except for the express warranties described above, Broderbund Software makes no other warranty, express or implied, with respect to the software, data, and/or documentation. This includes, but is not limited to, performance, merchantability or fitness for any purpose. Neither Broderbund Software nor anyone else involved in the creation or production of the software, data, and documentation will be liable for any direct, indirect, incidental, or consequential damages, such as, but not limited to, loss of anticipated profits or benefits resulting from the use of the software and/or data or arising out of any breach of warranty. Some states do not allow the limitation or execution of liability for incidental or consequential damages, while other states do not allow the exclusion of implied warranties, so the above exclusion(s) may not apply to you.

This license is effective until terminated. You may terminate the license at any time by returning to Broderbund Software or destroying all the software and data together with all copies, documentation, modifications, and combined portions of the software, data and/or documentation in any form.

This agreement will be governed by the laws of the State of California.

General

Broderbund Software retains all rights not expressly granted. Nothing in this license constitutes a waiver of the rights of Broderbund Software under the U.S. Copyright Act or any other Federal or State Law.
