Civil War - Conscripted as private 25 Mar 1863 in Captain Whitaker's company E 3rd battalio n of William H. Thomas's confederate militia made up of mostly Cherokee indians and white mou ntain men from East Tennessee and Western NC. All able bodied men between 18 and 35 were forc ed to serve. Source "Storm in the Mountains" by Vernon H. Crow. Family stories say he serve d only 3 months.
On 20 Jun 1863 while guarding bridge at Strawberry Plains, TN, a large force of 1,700 Federa ls overrun the 400 confederates. Company E was among those captured. The captives were immedi ately paroled with a verbal oath not to fight against US again and allowed to go home. Not su re if Nicholas was captured or escaped. Family stories sy he hid his rifle in a hollow log o n his way home, which suggests he was not captured. The Confederate leaders decided not to ho nor the oath taken by the captives, and ordered Captain Whitaker to sweep through East Tennes see to Cherokee County rounding them back up. Most did not willingly return. Nicholas someho w avoided recapture.
