John Baptista Ashe ,the progenitor of the family,was a lawyer practicing in the colony of N.C early in the 18th century. He married Elizabeth swann,the sister of Colonal Samuel swann and eminent layer,compiler of the Acts of the Assembly(1752)known as the Yellow Jacket and speaker of the Assembly and along with Swan and others settled on the Cape Fear. He was a man of wealth and of culture.His literary abilities are attested by his corespondence with the Home Government arraigning Governor Burrington for his excesses in the administration of the affairs of the colony. He was Speaker of the Assembly in 1727,and Member of the Council in 1730.He was fearless in his denunciation of Burrington,who procured his imprisonment by sub-.He lies buried at Gravely four miles south of Wilmington,now in possession of Marsden Bellamy.
