Blount County                  of said County, The undersigned
                  Administrator of the Estate of Alexander Baker Deceased returns the following unto your Honor as a Inventory and appraisement of the real Estate of said decedent which he asks your Honor to receive record and file to wit: The East half of the South East qr of Section twenty seven, also the west half of South West qr of Section (26), and South East qr of the South West qr of Section twenty six, all in Township twelve of Range three west, also the South W ¼ of the NE qr of Section 35 in Township (12) of Range 3 west. Also all of other portion of land containing of about 0 acres more or less, Also one lot of land lying at Sapps X Roads containing one acre commencing at the point where the road from the Blount Springs to Baltimore crosses the road leading from Elyton, thence an East course along said mentioned road to a point of the well of J. B. Byars, thence due north so far as to include……

Application to Sell Land                  January 1st 1874
To pay debts & c.                  Present, the Hon. J. W. Moore
Judge
      And now on this day comes Hannible H. Gillispie the Administrator General for Blount County, and as such, Administrator of the Insolvent Estate of Alexander Baker, deceased, and presents to the Court his petition in writing and under oath and praying for an order to sell the lands hereinafter described for the purpose of pay the debts of the said deceased. Viz: The South half of North East Quarter of Section Thirty-five, Township Ten of Range Three West, a portion of land lying North of the Said tract and South of the Warrior river containing ten acres, more or less, and on acre of land including the house and Still house built by Lewis & Beeson, at Sapps Cross Roads in said County, Starting at the intersection of the Stout***s and Baltimore Roads, thence Eastwardly along the Blount Sprigs Road to a point opposite site the well of J. B. T. Byars, thence South so far as to include one acre by a line running at right angles to the said Stout Road, thence along said Road to the beginning point, and the East half of the South East quarter, and all that portion of the west half of North East quarter of Section Two Township thirteen Range Three West, lying South of the Mulberry Fork of the Warrior River and the portion of said lands allotted and set off to the widow of said Alexander Baker deceased containing ten acres, and which is more particularly described in the proceedings for the allotment of dower recorded in this Court to be subject to the life interest therein, Alleging that the Personal property of the Estate of Said deceased is insufficient to pay the debts of said Estate.
      And said petitioner further represents that the names, ages residences and condition of the heirs and distributees of said deceased are as follows to wit: Rebecca Baker, widow of decedent, over twenty-one years of age, and resides in said County of Blount; Sarah Ann Chamblee, daughter of decedent. Wife of William M. Chamblee, over twenty-one years old and resides with her said husband in Blount County Alabama, Adaline Ingram, daughter of decedent, over twenty-one years of age, and resides with her husband A. J. Ingram in Blount County, Alabama. William D. Baker, son of decedent of full age and resides in Blount County Alabama, Jane I. Ingram, daughter decedent, over the age of twenty-one years, wife of Robert L. Ingram and resides with her said husband in Blount County Alabama, Mahala Dean, daughter of decedent of full age, and wife of John Dean and resides with her husband in Blount County, Alabama, Ascenath Head, wife of James P. Head, both of full age and reside in the State of Texas, County and Post Office unknown, Rebecca Gamble, daughter of decedent, of full age, of full age and resides with her Husband, Jackson Gamble, in this County, and Stephen A. Baker, son of decedent of Full age and resides in the state of Texas, County and Post Office unknown.
      And it appearing that the said petitioner has heretofore returned to the Court the inventory and appraisement and the report of sale of the personal property of said deceased, and the Court having examined said petition it is ordered that the same be filed and that the 16th day of February 1874 be set as the day for hearing said petition and that notice of this application and of the day above set for hearing be given for three other public places in Blount County, Alabama, and that citations be issued and duly served at least ten days before the said day of hearing on the said Rebecca Baker, Sarah Ann Chamblee, Adaline Ingram, William D. Baker, Jane I. Ingram, Mahala Dean, and Rebecca L. Gamble, adult heirs residing in this State, and upon the husband of the said Sarah Ann, Adaline, June I, Mahala, and Rebecca L. Viz: William M. Chamblee, A. J. Ingram, Robert L. Ingram, John Dean, and Jackson Gamble, citing them to be and appear before this Court on said day to how cause, if any, why the prayers of said petitioner should not be granted. And it is further ordered that to the said Ascenath Head and her husband James B. Head and Stephen A. Baker, adult heirs and distributees residing out of this State and whose Post Office is unknown, notice of this application and of the day above set for hearing be given by written notice sent to each of these by mail postage paid.

The State of Alabama                  In Probate Court in the
Blount County                        matter of the Estate of Alex Baker

Your petitioner Hanable A. Gillispie would respectfully represent unto your Honor that he is administrator de bonis non in the Court of the insolvent Estate of Alexander Baker deceased, that said decedent at the time of his death was seized and possessed in this own right of the following described real estate to wit: The S ½ of the NE ¼ of Sect. 35 %12 R3 West a portion of land lying north of the said track and south of Warrior River containing ten acres more or less, and on acre of land including the house & store house built by Lewis Beeson at Sapps Cross Roads in said County, and the E ½ of Se ¼ and all the portions of the west half of NE ¼ of section two township 13 Range 3 West lying in South East of Mulberry Fork of the Warrior River. That on the 22nd day of December 1865 letters of administration of said decedent were granted to Robert L. Ingram who thereupon qualified as said administrator and entered upon his duties as such administrator that from a statement in writing filed for record among the papers of said Estate it appears that upon the application of said Robert L. Ingram as administrator aforesaid, R. W. Dial, E. D. Sanders, and Samuel M. McPherson did on the 1st day of May 1867 lay off and allot the following described land as the portion allowed the widow & children of deceased by statue to wit: East ½ of SE ¼, and all that portion of the W ½ of NE ¼ of Sec. 2 T13 R3 West lying south of the Mulberry fork of the Warrior River and valued the same at five hundred dollars said statement marked Exhibit ****** is here to attest and prayed to be taken a part of this petition.
      Your petitioner further requests unto your Honor that upon the same day to wit the 1st day of May 1867 an order of this Court was made confirming said report and ordering the same to be filed and recorded a copy of said order is hereto attached and prayed to be taken a part of this petition marked Exhibit *******. Your petitioner alleges that the action of said Ingram and said Dial Sanders & McPherson and the order of this warrant confirming said report are null & void for the following among others recordeth; First said appraiser were not required and appointed by the Probate Court as required by law, Second said appraisers were not sworn before making said appraisement as required by [staticle?], Third said lands so set off allotted to the widow and children of decedent were of the value of two thousand dollars where the [staticle?] only authorized five hundred dollars worth to be allotted to her and the minor heirs, Fourth it does not appear that said lands include the homestead or such portion thereof as could be [setieled?] without [trying] to the remaining portion of the Estate not that this would be [?] done as required by [statistion]; Fifth it did not appear from said report or order of Probate Court confirming the same that the Estate was insolvent and that it was necessary to sell the lands for the purpose of debts.
      Your petitioner therefore prays your honor that a day may be set to hear this application what due notice of this application and the day set for hearing the same may given Rebecca Baker the widow of decedent who resides in Blount County Alabama & Stephen A. Baker minor child [members?] resides in Texas at the time of the death of decedent and whose Post Office is unknown of his family and the said attachment by said appraisers Dial, Sanders & McPherson and the order of this Court confirming the same may be [included] & held for [many let] and as in [dulebond] he will never pray.
