THE LAST WILL AND TESTAMENT OF JOHANNES BOYER
In the name of God amen, I Honas Boyer of the Town of Manheim County of Montgomers and State of New York Farmer; considering the uncertainty of this mortal life and being in body and of perfect Mind and Memory, blessed be almighty God for the same do make and publish this my last Will and Testament in manner and form following that is to say, First, I give and bequeath unto my eldest Son John Boyer his Heirs and Assigns all that part of my Messuage or Tenaments situater lying and being in the Town and County aforesaid and is distinguished and known by being part, or one hundred Acres of Land to be run of the South end of Lot Number two in the Subdivision of Lot Number eighteen in a Tract of Land called Glens purchase together with all and singular the buildings on the said hundred Acres of Land, to hold to him the said John Boyer his Heirs and Assigns for ever. And I hereby give and bequeath to my Sone Lendart Boyer his Heirs and Assigns fifty Acres of Land to be run of the Southwardly end of Lot Number three of the Subdivision aforesaid to his Heirs and Assigns for ever. And I give and bequeath unto my Sone Robert Boyer his Heirs and Assigns all that certain peice or percell of Land in Lot Number Six in the Subdivision aforesaid, lying to the Eastward of a Line to run South from two Beach Trees twisted together standing on the North Line of said Lot Number six to hold to him the said Robert Boyer his Heirs and Assigns for ever. And I further give to my Son Lendert Boyer his Heirs and Assigns all the westwardly part of Lot Number six aforesaid. And I give and bequeath to my Sone Henry Boyer to hold to him the said Henry Boyer his Heirs and Assigns all them certain poices or parcells of Land in three following Lots of Land in said Subdivision viz.twenty Acres of Land of the North end of Lot Number two and ten Acres of the North end of Lot Number three, and the whole of a certain Lot of Land called the Mill Lot containing Seventy eight Acres of Land, excepting out of the same one Acre formerly granted to Remen Snyder to his Heirs and Assigns for ever. And I give and bequeath to my loving Wife all and singular of my personall Estate of whatever Name or denomination either Good or Chattles, and that she shall use and occupy during her naturel life the undermost West Room of my now dwelling House, and I do will and order that my Son John Boyer at his own expence shall support her his Mother in Meate Drink and washing in a decent and becoming manner, and to pasture and winter two Milch Cows and two other horned cattle. And I do further will and order that my Son Lendert Boyer will yearly and every during her neatureal Life that is his Mother with two Gallons of Rum, And that my Son Robert Boyer will yearly and every Year during his Mothers natural life furnish her with two Gallons of Wine And that my Son Henry Boyer will yearly and every year during his Mothers natural life furnish her with two pound of Tea And I further will and order that my four Sons will pay to my four Daughters thee following Legacies in manner and form following that is to say, that my Son John pay to my Daughter Mary Edle the Sum of Sixty two Dollars and fifty Cents and my Son Lendart to pay to my Daughter Elizebeth Newman the Sum of twelve Dollars and fifty Cents, And my Son Robert to pay my Daughter Deboragh Commins the Sum of twelve Dollars and fifty Cents and my Son Henry to pay to my Daughter Nancy Wisbald the Sum of twelve Dollars and fifty Cents, and I do hereby constitute and appoint Bartlet Picket Jur. And Peter Lowks Jur. my Executors of this my last Will and Testament hereby revoking all former Wills by me made. In witness whereof I have hereunto set my Hand and Seal this twentieth Day of March 1799.

The within writen Will having ben signed sealed published and decleared by the within named Honas Boyer to his last Will and Testament in the presence of us who have hereunto subscribed our Names as Witnesses in the presence of the Testator. - Note that part of the word (Eastward) in the eleventh Line wrote on erazure and part of the word (westward) in the thirteenth Line wrote on erazure previss to the execution hereof. Be it remembered that on the twenty third Day of July in the Year of our Lord One thousand eight hundred and ten, personally appeared before me James Lansing Surrogate of the County of Montgomery, Evins Wharry and John M. Petree who being duly sworn severally depose and say that they saw Johannis Boyer sign and seal and heard him publish and declare the within Instrument as and for his last Will and Testament: That the said Johannis Boyer was at the time thereof of sound and disposing Mind Memory and Understanding. That the Names of these Deponents subscribed thereto, are respectively their own writing. That they saw Jost D. Petree subscribe his name thereto; and that they together with the said Jost D. Petree subscribed their Names thereto as Witnesses to the Execution thereof in the presence of the said Johannis Boyer the Testator.

The preceding are true copies of the last Will and Testament of Johannis Boyer deceased, of the Certificate of the proof thereof, and the Letters testamentary thereon.

The people of the State of New York by the Grace of God free and independent. To all to whom these presents shall come or may concern, send Greetings: Know ye that at Johnstown in the County of Montgomery before James Lansing Esq. Surrogate of our said County the last Will and Testament of Johannis Boyer deceased (a Copy whereof is hereunto annexed) was proved and is now approved and allowed of by us and the said deceased, having whilst he lived, and at the time of his death, Goods, Chattels or Credits within this State by means whereof the proving and registering the said Will, and the granting administration of all and singular the said Goods Chattels and Credits and also the auditing, allowing and final discharging the Account thereof, doth belong unto us; the Administration of all and singular the Goods, Chattels and Credits of the said deceased and any way concerning his Will, is granted unto Bartlett Pickert Junr. And Peter Loucks Junr. Executors in the said Will named they being first duly sworn well and Faithfully to administer the same, and to make and exhibit a true and perfect Inventory of all and singular the said Goods and Chattels and Credits, and also to render a just and true Account thereof when thereunto required. In testimony whereof we have caused the Seal of Office of our said Surrogate to be hereunto affixed.
