2. THOMAS2 SIMS (WILLIAM1) was born 1702 in Sittenbourne Parish, Richmond Co., Virginia, and died Bet. 1784 - 1785 in Culpeper County, Virginia. He married REBECCA PETTY Bef. November 30, 1725 in Virginia, daughter of THOMAS PETTY and CATHERINE GARTEN.

McGinnis: "Several of the Sims-Simms families that settled in the present counties of Kanawha, Putnam, Fayette, Nicholas, Lewis, Roane. Mason & Cabell, West Virginia came from Culpeper County, Virginia where Thomas Sims Sr. and his wife, Rebecca were living when that county was formed in 1748." "In 1833 William R. Woods & wife transferred to Henry Sims of Culpeper County 2, 076 acres in Kanawha County (now Putnam), adjoining the Craik grant and including the site of Scary, where Union and Confederate forces first clashed in the Kanawha Valley in the War between the States. Henry Sims and his wife, Margaret "Peggy" Marshall, who according to family tradition was related to Chief Justice John Marshall, had apparently settled on that tract some years earlier, as he is credited in Hardesty's "History of Putnam County" formed from Kanawha, Mason & Cabell, with having established the first grist mill in what later became Putnam County near Scary about 1820."

Thomas Sims will written 21 April 1784: Item 8 - "I do give & bequeath Ann Graves....and all that befell to her by Division to her and her heirs lawfully Begotten forever."

Thomas Sims was under the age of twenty when his father wrote his will April 1716. Following his father's death in the summer of 1716, Thomas was granted 112 A. "in Parish of Sittenbourne, County of Richmond, bounded by land of Doyle Matthew Bean and land of Wm Sims deceased, purchased from sd Doyle....also by Bakers land...dated 17 Dec 1717.".......Va Land grants (Upper Neck) 1713-1719,

He married Rebecca Petty (Patty, Paty) dau of Thomas & Catherine Garten-Petty, also of Richmond County, before 30 Nov 1725, for on that date Thos. Sims of Sittenbourne Parish in that County, and his wife Rebecca sold 112 A., "part of patent granted to Thos Hobson dec'd - Escheated by the Guardians of ye afore named Thomas Sims"......to Land of Doyle and along the line of Wm sims dec'd....past Matthew Beans....to Alvin Mothershead of parish and county afsd. Thomas Patty and Catherine his wife, one of the daughters of John Garten, deceased, complained against Robert Post & Anna his wife administrators of John Hughes, excr of John Garten, in a plea that they render unto the plaintiffs the sum of seventeen hundred and fifty-two pounds of tobacco showing that John Garten late of this county, deceased, in his late Will & Testament dated ye 17th of June 1698 gave & bequeathed his wife and five children Richard, John, Mathew, Catherine and Ruth, one half of all his estate equally to be divided amongst them, which estate being appraised amounted to 17, 504 pounds of tobacco, the one-half of which is 8,752 and Richard, one of the children being dead, the said 8,752 pounds of tobacco being equally divided between the widow and four children - equal part amounting to 1,782 fifths pounds of tobacco for which the said plaintiffs brought suit and demand judgement with costs. ..........Richmond County Order Book#3-, p79 & John Garten 1721 Inventory, Will Book same county.

Their final land sale in Richmond County was made 4 March 1733 when Thos Sims od Lunenburg Parish, Richmond County sold to William Jordan of same parish and county for 60 lbs current money of Virginia 100 A. of land in parish and county afsd "which sd one hundred acre of Land be the same more or less William Sims Father of the said Thomas Late of the County aforesd Dec'd formerly Purchased of John Doyle & by his last Will and Testament among Sundry other Legacies gave & Devised to his sd Son Thomas by the said Will (bearing date the twenty eighth day of Apr one thousand seven hundred & Sixteen).....(Signed) Thos Sims. Wit: Alvin Mountjoy, John Naylor, Edd Collinsworth. Recorded the same day. ...........Richmond Co., Va DB8-679.

This sale apparently was in preparation for Thomas and Rebecca Sims removal to a tract on the Rapidan River then in Spotsylvannia County, for the lease of land by Alexander Spotswood to Thomas and Rebecca Sims 23 Oct 1734 stated that they already had been settled one year on the tract, which was on the south side of the river. The terms leased to Thomas Sims, planter, 108 acres in St. Mark's parish, Spotsylvannia County, part of 40,000 acres granted to Spotswood, called the Spotswood Tract, and excepted minerals and quarries. The lease was to "Tho Sims and his assignees for & during the natural lives of Rebecca, the wife, and Thomas ye son of Thomas, Senior, for during the natural life and lives of the youngest liver of them, yielding and paying therefore yearly and every year of the first 4 years....on the 25th of December, one ear of Indian corn and every year after the expiration of the said four first years 624 pounds weight of good sound marketable top tobacco.....delivering it at a convenient landing in the County of Spotsylvania." The terms of the lease also required them to plant within four years 300 fruit trees (one third apple trees); the orchard was to be fenced in; all buildings and fences to be kept in good repair. Thomas Sims was also to provide one laboring hand for making the water dam or race of any grist mill which Spotswood, his heirs or assignees desired. It also provided that if Rebecca or Thomas Jr. should die before 25 Dec 1775 or before Thomas Sims Senior, the latter or his assigns could chose the person or persons to take their place. Date of Record: 5 Nov 1734. Wit: John Grame, John Pattey & William (X) Morton. Others leasing the land, the same day from Spotswood; James Jones Sr., Thomas and James Jones, sons (200 acres), Thomas Pettey, wf Katherine and son Christopher (100 acres), William, Jeremiah and Elijah Morton (200 acres), all on the south side of Rapidan river, and John Petty, wf Rebecca and son Thomas (100 acres) on N. side of Rapidan River. .......Spotsylvania Co., Va DB C-(1734-1742). Since Orange County was formed from the western part of Spotsylvania in 1734, Thomas Sims is listed in the Orange County tithables of 1734 with 2 white males of taxable age; in 1739, 42 tithables. Orange County records show that Thomas Sims purchased land from Timothy Johnson in 1738 and that on 26 July 1744 Thos Sims and wf Rebecca of Orange County sold to Francis Williams, same county, 200 acres purchased of Johnston, bounded by land of Timothy Johnson, John Zachary, and Barbers. ......Tiths 1739: Orange County Va Families Vol Ii Wm Brockman c 1956 p 135; Orange County Va DB 2-355, 6 & 9-184-186.

Thos Sims served on the jury Feb 1735 (1736). ......Orange County Va DB 1 & 2 1735-1739 by J.F. Dorman, p 71.

Culpeper County was taken from Orange in 1748. Brumfield Parish was cut off St. Mark's by act of assembly in 1752 and "included what is now Madison & Rappahannock Counties and a small section of Culpeper." ....."History of St. Mark's Parish, Culpeper County, Virginia", by Phillip Slaughter (1877) pp 78, 80.

Thomas Sims & wife Rebecca conveyed this same land to Wm Scott of Orange Co 18 Sept 1766, with John Flynt, Thos Sims Jun., William (X) Clark, wits. ....... E-191.

19 Apr 1770 Richard Parker & wf Grisel to Thomas Sims 29 Acres North side of Mtr Run...in sd Sims old line (F-45); and the same day Thos conveyed to Richard Parker 29 A on South side of Mtn. Run - an exchange of land, same consideration, on opposite side of Mountain Run. (F-45,46).

15 August 1783 Thomas Sims to Elijah Sims. Deed of gift. 85 acres purchased from T. Holdway & obtained by swap of Richard Parker except 30 acres conveyed to Richard Sims. Bounded by lands of Richard Sims, Richard Parker, Thos Sims Jr & Elijah Sims party thereto & personal items except 1/2 acre Thos Sims reserves for a burying ground. Not to include any present buildingd. Wit: Ambrose Coleman, Rchd. Parker, Stephen Bingham. ..........(M-203).

Will of Thomas Sims Sr.:
"In the name of God Amen I Thomas Sims Sener of Brumfield Parish and County of Culpeper being Sick and weak in body but of perfect mind and memory Thanks be given to God Therefore Calling to mind the Mortality of my body and knowing that it is Appointed for all men once to die do make and Ordain This my last Will and Testament that is to say Principally and first of all I do give and Recommend my soul into the hand of the Almighty God that gave it and my body I recommend to the Earth to be buried in a decent Christian Burial at the Discretion of my Executors nothing doubting but at the General Resurrection I shall reieve the same again by the Mighty power of God and as touching such worldly Estate wherewith it hath pleased God to bless me in this life I give devise and Despose of the same in the following Manner and form Imprimis.
Item first of all I do Give and bequeath and bequeath to my eldest son Thomas Sims Junr. that part of my Estate that fell to him by division, and Likewise I do give and bequeath to my son Thomas Sims my negroe woman by name Milley and her Child to him and his heirs Lawfully begotten forever, Likewise my son Thomas Sims Juner is to pay Thirty pounds in gold or silver to my son William Sims Deceased Children Six Pounds to each Child as they come of age and other little debts comeing against me-

Item Secondly I do give and bequeath to my son James Sims my negro man Peter and all that fell to him by Division to him and his Heirs Lawfully begotten forever Likewise I do give and bequeath to Elizabeth Sims wife of James Sims my Gilt Looking Glass and I desire at her Death that one of her sons may have it.

Item Thirdly I do give and bequeath to my son Elijah Sims the land he lives on The Gardon excepted and Likewise a Negro boy by name Abraham and all that fell to him by Division to him and his heirs sons of his first wife Lawfully begotten forever-

Item Fourthly I do give and bequeath to my Daughter Amay Bobo a negro woman by name Cate, and all of her Children, and I desire if John Sims lives with Absalom Bobo and his wife untill he comes of age they may give him one of the Negro Children if they see proper, This Negroe woman Cate and all her Children, and all that fell to her by Division is to her her and her heirs Lawfully Begotten forever-

Item Fifthly I do give and bequeath to my two Grand Daughters Lucy and Anna Jones Daughters of my Daughter Sarah Jones deceasd a Negroe Woman by name Rose and a boy named Peter and all that part that fell to my said daughter Sarah Jones by Division to them and Their heirs Lawfully Begotten for Ever, This Estate they are to recieve at the day of of Marriage or Coming to Lawful age-

Item Sixthly I do give and Bequeath to my Son Zachariah Sims a Negro man by name Moses and all that fell to him by division to him and his heirs Lawfully Begotten for ever

Item Seventhly I do give and Bequeath to my son Richard Sims a Negro woman by name Dafne, and Likewise Thirty odd Acres of Land and all that fell to him by Division to him and his heirs Lawfully Begotten for Ever.

Item Eighly I do give and Bequeath Ann Graves an Negroe woman by name Winney and her Child and all that fell to her by Division to her and her Heirs Lawfully Begotten forever

Item Ninthly I do Desire that my Feather bed and Furtinure and what other things I possess may be sold to the highest bider in the Family and the Money Rising Therefrom be Equally Divided amongst all my Children-
And Lastly I do appoint my sons Thomas and James Sims my hole and Sole Executors of this my Last Will and Testament hereby Revoking all former wills and Declaring this to be my my last will and Testament.

This last Will and Testament of Thomas Sims Decd was Exhibited to the Court by thomas Sims one of the Exors therein named and was proved by the Oaths of Edwd Sims & William Mason two of the Witnesses thereto & Ordered to be recorded And on the Motion of the said Executor Certificate is granted them for obtaining a probate thereof in due form they having made oath thereto and given bond & Security according to Law Liberty being reserved for the other Exor therin named to Qualify when he may think fit.

No evidence of the relationship of John Sims (Mentioned in the will) to Thomas Sims Sr. has been found. However, since Ann Graves received an equal share of the estate with other children of Thomas, she evidently was a daughter.

Thomas Sim(m)s, son of William of Richmond Co., Virginia, was born abt 1702 (he was under the age of 20 when his father wrote his will April 1716). This Last Will and Testament of Thomas Sims decd was Exhibited to the Court by Thomas Sims one of the Exors therein named and was proved by the Oaths of Edwd Sims & William Mason two of the Witnesses thereto & Ordered to be recorded And on the Motion of the said Executors Certificate is granted them for obtaining a probate thereof in due form they having made oath thereto and given bond & Security according to Law Liberty being reserved for the other Exor therin named to Qualify when he may think fit Teste John Jameson Cl.C. Might the John Sims mentioned in Thos Sims wil (1784) have been a son of Elijah & his first wife?

1782 Culpeper Co., Va Tax List: (Henry Field Comsr) - Sims james, Richard & Elijah follow in the list; also includes two other James Sims, Benjamin, Thos Jr. & John Sims. Elijah was on the list from 1782-1787 tax lists (1790 census) with 1 white poll & 5 slaves. In 1787 he was on the T. Nash list in Fauquier County, Va., and 1789 in Prince William Co., Va. with two tithables.

Culpeper Co., Va K- pg 87 February 21, 1780: Elijah Sims purchased from Richd Parker & wf Grisel consid. 2180 L 10 sh est. 291 Acres in Culpeper Co on S side of Mtn. Run...corner to James Garnett...to Parker's old line....corner to Rchd Sims...Thos Sims Junr line...corner to Thos Sims Senr. No wits.

Culpeper Co., Va DB M- pg 203 August 15, 1783: Thomas Sims Sr made a deed of gift to Elijah Sims consid. 5 sh & "love & affection, etc." est. 85 Acres - all remainder of tract he purchased of Timothy Holdway (1762 obtained by swap of Richard Barker except 33 Acres conveyed to Richard Sims) - bounded by lands of Rchd Sims, Richard Parker, Thos Sims Jr & Elijah Sims + personal property - except 1/2 Acre Thos Sims reserves for a burying ground. In his father's will Elijah was given "land he lives on"...to him & his heirs sons of his first wife."

Culpeper Co., Va. DB M- pg 178 June 21, 1784: Elijah Sims & wf Elizabeth to Bromfield par Culp Co conveyed to Rowley Marders, 1200 L, est. 148 Acres, N side Mtn. Run...corner to James Garnett & sd Sims....corner to Richard Sims - with houses, etc.

Culpeper Co., Va DB O- pg 37 November 10, 1786: Elijah Sims & wf Elizabeth of Culp to Gabriel Hansbrough, 200 L, 2 tracts est. 200 Acres: 1) 87 Acres adjoining lines of Richard Sims, Wm Lewis, Thos Sims Senr & Elijah Sims party thereto; 2) 193 Acres a pt of tract sd Sims purch of Richard Parker. Culpeper Co., Va DB U- pg 154 June 29, 1798: Elijah Sims & wf Elizabeth of Prince William County Va sold a tract of land in Culpeper on waters of Mountain Run...to John Crap (Cross?0..bounded...John Tutt...Wilhits' corner..Lucas' line...Lucas & Towles...corner Towles & Delaney...Bingham...consisting of 842 Acres for 500L. (Northern Neck Grant, Fairfax deed: BK W- pg 258, 1792-1795).

Prince Williams Co., Va DB 2- pg 124: Elijah Simms of Pr Wm Co conveyed to Sheriff of Culpeper Co Va all "my rt & estate in fee law & equity to a certain tract of land respecting which a controversy was had & compromise effected in Co Ct Pr Wm Co & all my rights to purchase money. Under act for relief of Insolvent debtors. I being about to take oath as an insolvent debtor being in execution at the suit of Benjamin Botts - convey to Sheriff of Pr Wm Co all land, etc. (Signed) Elijah (X) Simms Dec 7, 1802 Deed to Sheriffs of Culpeper & Pr Wm Cos.

Elizabeth Simms made the accounting of sales February 17, 1804 in the settlement of the estate of her husband Elijah Simms (I-42). Morgan sims, Richard Sims & Margot Sims were among purchasers at Estate sale of James Simms dec'd May 4, 1778 in Prince William County; one Jane Simms dec'd (will pr May 1782 in same co) with son Charles & dau Mary Purcell. Absalum Bobo was a witness, along with Mary Crim & David Davis January 10, 1752 when Wm Sparks of St. Mark's Parish Culpeper agreed to give sd Spencer Bobo same par & co & his wf Mary land whereon sd Spencer now lives cont. 50 Acres with improvements during natural lives of sd Spencer & Mary...Janauary 20, 1763 Spencer Bobo of Brumfield Par Culp deeded to Absalom Bobo same par & co - consid. 5 L est.
