Mrs. Columbia S. Miller wrote October 1970 to Lela Prewitt, "My research began with a letter written by my grandmother's oldest sister, Mary Ann Roberts White, in which she stated that her grandfather, Joseph Roberts married Elizabeth Sims(Simms), that Joseph & Elizabeth had seven children. She also named some of their husbands & wives....I knew that my ancestors lived in Culpeper County, Virginia (general family knowledge) so when I had the opportunity to visit in Virginia I made several trips to Culpeper. There in the Ct. House I found Joseph's will on record as well as that of Joseph's father, Benjamin Roberts, Jr., also the will of Benjamin Roberts Sr., ....the information in Aunt Mary's letter tallied with the information in Joseph's will in which he mentioned his "beloved wife Elizabeth" & named all his children...four generations lived in St. Mark's Parish...Benjamin Roberts sr. willed money to his grandsons (Joseph was one of them) to buy land on the Western Waters. Why Joseph didn't take advantage of the request in the will I do not know. For some reason he stayed in Virginia. Near the time of Joseph's death, at least in the same decade, Joseph's son, Benjamin III came to Muskingum County, Ohio, and later moved to Athens County, Ohio....All are based on Bible records and wills except for the generation of Benjamin Roberts (A381)."

1810 Census Madison County, Virginia: Edward Sims 1 M & 1 F 45+; 2M & 2 F 16-26; 2 M 10-16; 2 M & 1 F -10; 12 slaves.

Will of Edward Simms: July 16, 1825; October 29, 1825 Madison County, Virginia.

"Be it known to all whom it may concern that I, Edward Simms of County of Madison, Va., do proclaim this to be my last will & testament in manner & form following, that is to say, I desire my Executors hereafter named will, at my decease, have my body buried in a plain decent manner, & as soon thereafter as practicable proceed to sell so much & such part of my Estate either real or personal as they may find necessary for the payments of my just debts. My children all being near age, I desire that my wife & such of my childrenas are present, may be consulted relative to the species of property that may be disposed of for the payment of my debts. The 200 Acres land lying on ridge which I bought for non-payment of Taxes of prentice, & which includes Pitcher's place, I wish them to sell at any rate".

"Item, After my just debts are paid, all provided for, the ballance of my property, both real & personal, I do hereby leave to my Wife Amy Sims, for & during her natural life, & it is my wish that my wife Amy Simms do keep my daughter Jamima Simms with her during her life, also, my youngest son A.H. Simms & let my eldest daughter & youngest son share with her in the profits from the loan of my estate. 3 Item, After the death of my wife Amy Simms, I do lend my daughter Jemima Simms, any two slaves, belonging to my Estate, that she may chose to elect. Also 1 bed & furniture, 1 horse, 2 head of cattle, 6 hogs, if she may chose to take them, the sd property, I do lend my daughter Jemima Simms for & during her natural life & at her death, sd property together with future increase thereof, is to be divided equally among all my children, or such of their legal representatives there may be. After the death of my wife Amy Simms I desire that my daughter Jemima Simms, do take her property & retire to such of her friends with whom she may choose to spend the rest of her life".

"Item 4. All my Estate of what kind so ever it may not here in before disposed of, I desire that my Executors on the death of my wife, Amy Simms, will cause to be equally divided among my following children (or such of their legal representaives as there may be) having particular regard to forms & advancement, which I have noted down in a book to which they can have access, to Wit: Benjamin Sims, Nancy Broadus, formally Nancy Simms, Thomas T. Simms, John Simms, Albert G. Simms, Matilda J. Jones, formally Matilda J. Simms, Alexander Simms, I do hereby given my above children, their heirs & assigns forever.

"Item 5. I desire that my son, Albert G. Simms will relinguish any claim that he has against my Estate, in consideration of money put in my hands for safe keeping, which I ask as an equivalent for the extra expense I was at for his education.

"And lastly, I do hereby appoint my friends Edmund Broadus & Albert G. Simms, sole Executors of this my Last Will & Testament, hereby revoking all former dispositions by me made & declare this to be my abiding will & testament. In witness whereof I have hereunto set my hand & seal this 16th day of July 1825.

Will of Amy Simms: June 3, 1842; Sept 25, 1845 Madison Co., Va..."all my children being of age, & having entered into year 1835, my husband's will was partialy set aside & the whole of his personal Estate except four negroes was sold & divided between myself and children, the sum of $1300 being placed at interest for my benefit..." She gives all the profits from sd use of Estate of her husband Edward Sims to son Alexander H. & all property set aside for herself, everything at her death except beds & furniture to daughter, Jemima. Wits: John Fletcher, J. Yowell. Edward Simms' inventory totaled $6654.55; settlement of state March 14, 1828. WB 7-606 WB 5-4; 5-139.

Edward Simms served on the first jury of Superior Court established in 1809 in Madison County, Virginia, according to History of Madison County, Virginia, pg 60.

Also of interest is the deed recorded in Madison County, Virginia April 3, 1839 in which Amy Simms, relict of Edward Simms; Edmund Broadus & Nancy his wf; Thomas P. Simms; Albert G. Simms & Salome B., his wf; John Jones & Matilda J., his wf; Alexander H. Simms, all heirs of Edward Simms, deceased, sold to Thomas Shirley 100 Acres on Ragged Mountain for $900. Benjamin Simms, living in Kentucky, had conveyed all his interest in the estate to Edmund Broadus in 1835, & John Sims had probably done likewise.
