Caudill Dies At Uz, Tuesday" Mrs. Ettie B. Caudill, age 39, died at her home at Uz after along illness Thursday, September 8th. Mrs. Caudill was alife-long resident of Letcher county and was the daughter of James C. and Eva Dixon of Uz. About sixteen years ago she was united in marriage to William Caudill, who with the following children survive her, Virgil, Ruth, Lillian and Harold. Mrs. Caudill was formerly a teacher in schools of Letcher County and was a member of the Regular Baptist Church. Funeral services were held at the home at Uz by Elder Felix Fields, Friday, September 9 at 10 o'clock, with interment in the family cemetery near the home. Also, the following card of thanks was in column 4 on the same page: "Card of Thanks" We wish to thank our many friends and neighbors for the many acts of kindness and consoling words during the recent illness and death of our mother and wife, Mrs. Ettie B. Notes for Artie Cornett: The following is from Book 16, Page 533 of the Commonwealth Orders for Letcher Circuit Court (the 7th day of the January term on January 13, 1936): Commonwealth of Kentucky vs. Order. (Willful Murder) Artie Caudill. It appearing to the satisfaction of the court that the defendant is financially unable to employ counsel, it is ordered that H. L. Moore and Emmett G. Fields be, and they are hereby appointed to represent the defendant in this case, and the case is set for trial on the 17th day of the present term. The following is from Book 16, Page 540 of the Commonwealth Orders for Letcher Circuit Court (the 9th day of the January term on January 15, 1936): Commonwealth of Kentucky vs. Bond. (Willful Murder) Artie Caudill. The defendant being in custody charged with the crime of Willful Murder, and being admitted to bail in the sum of $5000.00, came the defendant with W. E. Cook, Mantie Whitaker, Sherman Ison and Troy Cornett as surety, and acknowledged themselves indebted to the Commonwealth of Kentucky in the sum of $5000.00, to be void upon condition that the defendant appear in this court on to-day to answer said charge and that she will at all times render herself amenable to the orders and processes of this court in the prosecution of said charge, and if convicted will render herself in execution of the judgment of this court; but should she fail to perform either of these conditions they will forfeit and pay to the Commonwealth of Kentucky the sum of $5000.00. The following is from Book 16, Page 572 of the Commonwealth Orders for Letcher Circuit Court (the 19th day of the January term on January 27, 1936): Commonwealth of Kentucky vs. Willful Murder. #958-F. Artie Caudill This cause came on for trial and the Commonwealth and defendant announced ready. The defendant waived formal arraignment, and entered a plea of not guilty to the charge contained in the indictment. Thereupon came the following jury, to-wit: G. P. Isaacs, Billie Day, Crit Morgan, Mose Anderson, U. S. Tolliver, Joe Holcomb, John Pendleton, J. T. Smith, J. B. Frazier, John Pendleton, Isaac Morgan and Isaac Day, who qualified and were selected, accepted and sworn as the law directs. The attorney for the Commonwealth read the indictment to the jury, made statement of the case for the commonwealth and stated the defendant's plea. The Commonwealth then proceeded to introduce its evidence and announced through. Counsel for the defendant made statement of the case for the defendant, and the defendant then introduced her evidence and announced through. Said jury after hearing the evidence and the instructions of the court, which was in writing, retired for deliberation but having not agreed on a verdict, and the hour for adjournment having arrived, court adjourned until 9 o'clock to-morrow morning. The jury was again placed in custody of S. P. Combs, Deputy Sheriff and the defendant in custody of the jailer. The following is from Book 16, Page 573 of the Commonwealth Orders for Letcher Circuit Court (the 19th day of the January term on January 27, 1936): Commonwealth of Kentucky vs. Allowance to Witnesses. (Willful Murder) Artie Caudill. Came the following witnesses for the Commonwealth and claimed their attendance as follows: Linville Cornett, Minnine Cornett and J. L. Frazier one day each $1.00 each; Jonah Mitchell, W. M. Caudill, Kinnard Cornett, Leonard Fields, Monroe Cornett, Harve Whitaker, Mrs. Monroe Cornett and Joe Blair three days each $3.00 each; all of which is allowed and ordered certified to the Auditor of Public Accounts for payment. The following is from Book 16, Page 575 of the Commonwealth Orders for Letcher Circuit Court (the 20th day of the January term on January 28, 1936): Commonwealth of Kentucky vs. Willful Murder. Artie Caudill. Came again the parties, the jury in custody of Deputy Sheriff S. P. Combs and the defendant in custody of the jailer. Said jury again retired to the jury room for deliberation and returned into court the following verdict, "We the jury do agree and find the defendant guilty and fix her punishment at 11 years in the State Penitentiary. J. A. Pendleton one of the jury." The defendant was then remanded to jail to await the judgment of the court. The following is from Book 16, Page 577 of the Commonwealth Orders for Letcher Circuit Court (the 21st day of the January term on January 29, 1936): Commonwealth of Kentucky vs. Judgment. (Willful Murder) Artie Caudill. The defendant being in open court and having waived time for the judgment of the Court and being informed of the nature of the indictment, plea and verdict, was asked if she had any legal cause to show why the judgment of the court should not be pronounced against her and none being shown, it is ordered and adjudged by the Court that the defendant, Artie Caudill, be taken by the Sheriff of Letcher County to the State Reformatory at Frankfort, Kentucky, and there confined at hard labor for a period of eleven (11) years. It is further adjudged by the Court that the Commonwealth of Kentucky recover of the defendant all its costs herein expended for which execution is directed to issue. |
