5. Will:
January 16, 1849      Knowing that my brother Albert J. Pollitte was very ill and believing from his former dictations that he wished to make some disposition of his property, his brother George W. Pollitte asked him in my presence, as he was very ill, if he wished and (he) George, believing that he would die; if he wished his mother and sisters to have his property, and then my brother Albert J. Pollitte replied to me — that he wished his son Albert C. Pollitte son of G. W. Pollitte to have all of his property after paying all of his just debts.
                                    Mary A. Pollitt
Mason County Sct.                              March Court 1849      The non-cupative will of Albert J. Pollitt was further proved by the testimony of George W. Pollitt, who swore that the written paper already filed and sworn to as the non-cupative will of said Albert J. Pollitt by Mary A. Pollitt, contained and truly set forth the disposition of his property as declared by himself during his last illness in January 1849 at his residence. And that the same was committed to writing by Mary A. Pollitt at his request prior to his death, and testimony was also produced proving notice to all the next of kin of the present motion: whereupon the same was ordered to be recorded.
Administration of the estate of Albert J. Pollitt decd. with his non-cupative will annexed, is granted to George W. Pollitt who made oath and executed and acknowledged bond with Samuel Pollitt as his security in the penalty of four hundred dollars conditioned as the law requires. And on his motion it is ordered that a certificate be granted him for obtaining letters of administration thereof in due form.
