I, John Conley of the
County of Johnson and State of Kentucky, Being seventy-five years of age and sound in mind and memory do make,
publish, and declare this my last will and testament in manner following, that
is to say,
First I direct my
executor herein after-named to pay out of my personal property as soon as
possible after my decease, all my just debts together with the expense of my
last sickness, my funeral, and {illegible} expenses.
Second, I give and
devise unto my sons, Jas. H. Conley, William M. Conley, Hiram F. Conley, John
A. Conley, Martin V. Conley, and Harvey Burns Conley all the real estate, of
which I die seized, to have and to hold, to them, their heirs, and assigns
forever, reserving the right and prohibiting the conveyance of the same to any
person or persons save to the sons named above for the term of or the space in
time of twenty years after my decease save to the sons named above. They may
convey to each other but to no other person or persons for the space of time,
twenty years. Neither is said mine estate to be subject to any debt or debts,
mortgages or liens contracted by said sons. Said mine estate is set apart for
the use and benefit of said sons and their families and that alone for twenty
years. I further request that my real estate be divided between my sons named
above in proportion to what I have given them of my personal property and that those of my sons located on my
land, that their shares be given them in the most convenient manner to their
dwellings so as not to remove them that use {illegible}. Hiram in the upper part of Little Lick fork,
William next to Hiram below and John next or William. Martin on the lower end
on Big Lick fork. Burns on the upper end on Big Lick fork and Jas. H. Conley’s
between Martin, Burns, and John shares said land to be divided as before stated
and if said sons fail to agree as to a divide between themselves, they shall
choose some suitable person or persons agreed upon by themselves as a majority
of them whose decision shall be final.
Third, I bequeath
unto my daughter, July Conley right and possession (of) her choice room of my
dwelling also the garden during her single life and if she remains single
during her natural life and when this expires this is to go to the son whose
share it is a part of. Further I bequeath unto my daughter, July Conley, the
kitchen utensils with the stove, all my household goods with the clock and
sewing machine also the horse now owned by her and her choice cow.
Fourth. All the rest
and residue of my personal property and estate I give and bequeath to my
children, Jas. H. Conley, Heirs of Thomas J. Conley deceased, Jane Spears wife
of Enoch Spears, Wm. M. Conley, Hiram F. Conley, Amanda M. Pelphrey wife of
Jas. M. Pelphrey, John A. Conley, July Conley, Mart V. Conley, H. Burns Conley,
Heirs of Isabel Hyden wife of G.D. Hyden deceased, equally share and share
alike. Fifth, I hereby appoint Atty. B.H. Conley the sole executor of this, my
last will hereby revoking all my former wills made by me, made at any time.
