Will of James H. Conley                   May 4th, 1911

 

       I, James H. Conley of County of Johnson, State of Ky. Being seventy years of age and being of sound mind and memory do make, publish, and declare this my last will and Testament in manner following. That is to say:-

       First, if my wife Cintha E. Conley should out live myself that she is to be well cared for and no division of my home farm during her life time.

       Second, all of my just debts with my last sickness and funeral expenses are to be paid out of the proceeds of my personal property.

       Third, I devise all of real estate to my sons as following: As I have helped Millard to get land, I give him none in this division. I give John W. Conley what land I own on Little Lick Fork, the some bought of W.L. Smith. I give Lindsey S. Conley all of my interest in the lands bought of Doctor F.M. Bayes near the mouth of Rock House Branch. My other sons Charles F., A.F., and Frank J. Conley to have my home farm and be divided thus. Charles F. Conley is to have the upper end known as the Frank Centers farm. Beginning on top hill next to Joe Fairchild’s and running a northerly course down a small drain to the Rock House Branch and down the same to mouth of barn branch up the same to the upper end of the Young meadow to a small drain thence westerly course with said drain to top of point thence north westerly course to top of main Ridge near some large rocks so as to include all the land I own above said line.

       A.F. Conley  is (to) have the lower end of said home farm. Beginning at the lowest depression in the Hiram Tacket gap and running a southerly course down a swag to main Sugar Camp Branch and down the same to the Rock House Branch, thence up the same a short distance to the mouth of a drain, thence up said drain to top of ridge so as to include all the land I own below said line. Frank J. Conley is to have all the home farm between C.F. and A.F. Conley’s lines.

       Said sons (are) to have and hold said land as it my come to their hands upon the death of their mother for ever. In regard to division of my real estate,

there is to be no litigation whatever. All difference of opinion must be settled by arbitration and no other way except the collection of debts.

       Fourth, all farm tools, wagons, & ect. are to remain on (the) farm, also my household goods.

       Fifth, all of my personal property after my just debts and sickness and funeral expenses also that of my wife, Cintha E. Conley are paid are to be divided thus: Louisa Reynold, Solla G. Trimble, and Genoa Conley are each to have ten dollars. Virgia Turner is to have fifty dollars and the remainder to be divided equally between my sons named above. Genoa Conley being now unmarried if so she decides to remain the three sons that get the home farm are to provide her with (a) comfortable home during her life or single state.

       Sixth, I hereby appoint Ex-Judge H.B. Rice the sole executor of this, my last will hereby revoking all my former wills by at any time made. All my property must be disposed at private sale and all misunderstanding settled by arbitration. In witness whereof I have hereunto set my hand and seal.
