Hugh Crossen's Will

Filed April 30, 1909. Petition for probate of will. Probate no. 161. In the district court of the 8th Judicial District of the State of Montana, in and for the County of Teton. In the matter of the estate of Hugh Crossen, Deceased. Petition for probate of will. Your petitioner would most respectfully state to the court:
1. That on or about the eighth day of November, 1907, Hugh Crossen died in Cascade County, Montana.
2. That at the time of his death he was a resident of Teton County, State of Montana.
3. That he left an estate in Teton County, Montana, as shown by his will, consisting of an undivided one-half interest in and to said real estate situated in said county and certain cattle and horses and other personal property, all situated in said county, the precise amount of said real estate, personal and other property, and the value and nature of said property is to your petitioner unknown, save and except such information as is obtained by your petitioner by the examination of the last will of Hugh Crossen, a copy of which is hereto attached and made a part hereof, and to which reference is hereby made.
4. And your petitioner would further state, according to his best information and belief, that the said deceased was the owner of other property not located in the State of Montana.
5. That the said Hugh Crossen, deceased, left a will bearing date of 23d day of September, 1907, in the possession of J.W. Speer of Great Falls, Cascade County, Montana; that the said J.W. Speer has surrendered said will to your petitioner, and which accompanies this petition for the purpose of filing with the Clerk of this Court.
6. That your petitioner believes and therefor alleges the fact to be that the said will and testament of the said deceased left with the said J.W. Speer was the last will and testament of said deceased, a copy of which is hereto attached.
7. Your petitioner would further represent to the court that Frank Crossen of Great Falls, Cascade County, Montana, and Morris Crossen of Teton County, Montana, mentioned in said will as the executors thereof reside in the State of Montana.
8. That your petitioner is willing to act as the executor of said estate.
9. That in said will the said deceased gave, devised and bequeathed to his brothers and sisters and to their sons and daughters equally share and share alike, it being the deceased’s intention, as expressed in said will, to devise all of his estate among his two brothers now living (Phillip and James) and their sons and daughters and the sons and daughters of his brother, Patrick Crossen, said Patrick Crossen now being deceased, and the sons and daughters of the deceased’s two sisters now being deceased.
10. That your petitioner would respectfully state that Michael Boylan, aged 49; John Boylan, aged 37; and William Boylan, aged 27 of Sawyer County, Wisconsin; James Boylan, aged 45; Hugh Boylan, aged 25; Susan Boylan, aged 35; Mary Boylan; aged 39; and Catherine Boylan, aged 41, of Ridgeway, Wisconsin; and Maggie Doran, aged 32, of Hollandale, Wisconsin, are the children of Susan Boylan who was a sister of the said Hugh Crossen, deceased, and that the said Susan Boylan is now deceased.
11. Your petitioner would further state that James J. Boyle, aged 50; Bernard Boyle, aged 50; Bridget Boyle, aged 54; Catherine Boyle, aged 52, of Carbon County, Pennsylvania, and Annie McGrans, [McGrane?] aged 56, of Luzerne County, Pennsylvania, are the children of Catherine Boyle, who was a sister of the said Hugh Crossen, deceased, and are the children of the said Catherine Boyle who was a sister of the said Hugh Crossen deceased, and are the children of the said Catherine Boyle and Susan Boylan mentioned in said will; that the said two sisters are both deceased.
12. Your petitioner would further represent that James Crossen, brother of deceased, resides at Plains, Montana, and Philip Crossen, a brother, resides at Ridgeway, Wisconsin; that the deceased had a brother, Patrick Crossen, who is now deceased, and who left surviving him his children as follows, to wit: Mrs. Susan McGrath of Madison, Wisconsin; Mrs. Mary E. McCabe of Ridgeway, Wisconsin; Mrs. Katie Ellis of Ridgeway, Wisconsin; Mrs. Bridget Ryan of Blue Mounds, Wisconsin; Mr. Murty Crossen of Blue Mounds, Wisconsin; Mr. Boylan (?) Crossen of Ridgeway, Wisconsin; Mr. James Crossen of Ridgeway, Wisconsin; Mr. Willie Crossen of Chouteau, [Choteau] Montana; Mr. Hugh Crossen of Ridgeway, Wisconsin; and Mr. Patrick Boylan (?) of Ridgeway, Wisconsin.
13. That the above named persons, your petitioner is informed and believes, are the heirs and next of kin of said testator.
14. That the said subscribing witnesses to said will are Henry Rooney and J.W. Speer, both residing at Great Falls, Montana.
15. That at the time the said will was executed, to-wit, on the 23rd day of September, 1907, the said testator was over the age of 18 years, to-wit of the age of 73 years or thereabouts, and was of sound and disposing mind and not acting under duress, menace, fraud or undue influence and was in every respect competent by his last will to dispose of all of his estate.
16. That said will is in writing, signed by the said testator and attested by the said subscribing witnesses at the request of said testator and in the presence of said testator and in the presence of each other, and that, as your petitioner is advised and therefore alleges, said witnesses, at the time of attesting the execution of said will, were and are now competent to testify in this matter.
17. That the undersigned attorneys represent all of the heirs of said deceased, except Patrick Crossen, who now resides in Teton, County, Montana.
Wherefore your petitioner prays that an order may be made requiring the said will to be admitted to probate, and that letters testamentary be issued to the parties named in said will or to such other party as this court may deem proper. And your petitioner will ever pray. [signed] Frank Crossen. Freeman and Thelen. Wm G. Downing representing all the heirs of Hugh Crossen deceased except Patrick Crossen.

Hugh Crossen Obituary

Hugh Crossen Laid to Rest. Hugh Crossen, for many years well known and respected by a great number of acquaintances and friends in Teton county, died at the Columbus hospital in Great Falls, on the morning of Nov. 8 [1907.] He had been in poor health for almost a year and went to the hospital last July. He did not improve in health and toward he last failed rapidly. Heart trouble was the immediate cause of his death and this with complications due to his advanced age was more than his system could rally from. He was 73 years of age, a native of Ireland, and a resident of Montana for about twenty years. His business interests here consisted of a part ownership of an extensive cattle ranch 15 miles south of Choteau, and he also had mines in Idaho. A brother (He had two brothers left James and Phillip) Pat had died in 1896) ) and several nephews, among them (James and Phillip) Pat Crossen, are his relatives in Wisconsin. The body was brought here from Great Falls and the funeral was held Monday at the Catholic church and was largely attended by friends from this vicinity and other parts of the county. Father Phelan conducted the services. A choir consisting of Mrs. Truchot, Edna and Anna Beaupre, Mrs. Cole, Mrs. Johnson, and Messrs. Burbank, Trescott, and Hirshberg rendered several beautiful selections, and Mrs. Cole sang a solo. The pall bearers were J. F. Burd, M. Connelly, Wm. H. Hodgskiss, T.J. Moore, K. Mckenzie, Jas. Gibson. The remains were interred in the Choteau cemetery. [Reprinted from the Choteau Acantha Nov. 14, 1907]

He is a well-to-do rancher and has nothing but words of praise for the
Chronicle. Wednesday he purchased the Cohen ranch of about 900 acres, which
