Some confusion pertains to his date of death. However, I have seen his headstone and the probate records of his estate. In the probate records, his wife, Anna and son Abijah clearly affirm the settlement of his affairs on January 29, 1754, supporting the January 11, 1754 date shown in the Vital Records of Waltham (p. 252). He married first, 7 May 1741, Mary Stearns, daughter of Isaac and Mary (Bemis) Stearns, born 4 Dec. 1712. She died soon, 22 Aug. 1741 (ibid.).

He married secondly, 21 Feb. 1744/5, Mary Bemis, daughter of Jonathan and Anna (Livermore) Bemis, born 10 March 1722/3, died 16 Aug. 1802 (Columbian Centinel), She bore him ten children.

His will was dated 26 Jan. 1780. His estate was valued at £867.10s.11d, and included a 70 acre farm (Middlesex Co. Probate, No. 19803).

The following describes the involvement of Samuel Bemis in the affairs of the estate of James Barnard:

"The papers in the packet of the estate of James Barnard of Sudbury (Middlesex County Probate #1062) further confirm the relationship. Paper No. 1 is a "rough" inventory, taken "by us the subscribers 25 February 1717/18, as it was shown to us by Benjamin Barnard and Sam'll Bemis and his wife, Lt. Col. Edward Goffe, Capt. Nath'l Bowman and Capt. Joseph Bowman being present." (This inventory was a meager one, showing personal property of £8:17:6. Later inventories showed real estate of £654:6:6.) "We also took some pages into our hands: viz. 1 mortgage deed of George Harrington, 2 bonds from Col. Goffe and a bond of William and Peter Jenison." Jona Bond, Moses Boardman, John Noyes sign. Appended to the inventory are some lines written by F. Foxcroft, Judge of Probate, difficult to decipher, but seemingly as follows:

"The above James Barnard died at his kinsman James Barnard's house at Watertown...and by the consent of the principal kinsman I impowered the 3 Gent. above to ride up and take an inventory...Justice Bond delivered to me £8:17:6 bills of credit and the bonds above mentioned and told me he left the rest of the goods to Mrs. Sarah, wife of Sam'l Bemis, as I ordered... F. Foxcroft, J. Probate."

Those present at the taking of the inventory were evidently some of the principal kinsman, Benjamin Barnard, a nephew, and the husbands of four nieces--Samuel Bemis, Edward Goffe, Nathaniel and Joseph Bowman."

[James Draper, History of Spencer:1-2] "BEMIS SAMUEL, came from Watertown, 1721, and was the second settler in Spencer. He was born in 1688, was m. to Sarah Barnard of Sudbury. He was doubtless, a descendand of Joseph Bemis, who came from England to Watertown, in 1640, and was probably the ancestor of all who bear that name in this part of New England. He purchased 400 acres of the easterly part of lots (29) and (36). He commenced felling the ancient forest, which covered his farm, before he removed his family here. At that time the Indians had not all retired from this part of the country, and some of them frequently came into his cabin and tarried with him through the night, but their presence was very offensive to him. In 1722, when his wife was about to give birth to her third son (William), fearing the Indians, she made a journey to Sudbury, for safety during that critical period, and when her little son was only two weeks old, she rode home on horseback, a distance of nearly fifty miles in one day, and carried her infant son in her arms, although the greatest part of the distance the road, such as it was, passed through an entire wilderness! He acquired a handsome estate, and built the first frame house in town, a building of two stories, which stood on the site of the present house of Mr. Robinson, and was taken down a few years since. His wife Sarah died September 30, 1756. His children were Samuel, b. May 1716; Edmund, Nov. 1, 1720; William, Nov. 1, 1722; Nathaniel, 1725; Sarah, Dec. 12, 1727; Joshua, July 14, 1729; Elizabeth, 1732; Jonas, March 25, 1737. The following is the inscription on his tomb stone.
      'In memory of Mr. Samuel Bemis, one of the first settlers of the town, who died August 1776, in his 84th year.
      Where nothing dwelt but beasts of prey,
      Or men as fierce and wild as they,
      Our kind forefathers did repair,
      And built us towns and cities there.'

[Draper:123] They resided for a time in Sherborn. Samuel Bemis was the second settler of Spencer, Mass., going ther from Wat. in 1721. He purchased 400 acres of land, and began at once to fell the timber, with which the land was covered, before bringing his family from Wat. At that time, the Indians were still numerous in that section, and they frequently came to his house and tarried the night, but their presence was most offensive to him. His wife, Sarah Barnard, came from English ancestry. She was born at Watertown, January 25, 1694, and died at Spencer, September 30, 1755, proceeding him 20 years. Her father, grandfather and great grandfather Barnard were named John. John Barnard Senior, born in 1602, came to America from Ipswich, England, in the ship Elizabeth, William Andrews master, in 1634 with his wife Phebe and their son John, aged three, and settled at Ipswich in this State. Her father was a housewright and lived at Watertown, and his surname, Barnard, has to some extent been used in Spencer as a given name in the Bemis and other families.
