Adams Co., PA GenWeb Project - Will of Andrew Noel WILL OF Andrew Noel submitted 19 May 2002and © EllisRN@aol.com In the name of God Amen, I Andrew Noel of Menallen Township in the County of Adams & State of Pennsylvania, being weak in body, but of sound & perfect mind, memory & understanding (Blessed be God for the same), Do make & publish this my last Will & Testament in manner and form following, viz: Principally & first of all, I commend my immortal soul to the Earth to be buried in a decent & Christian like manner, at the discretion of my Executors herein after mentioned, & as to such worldly Estate wherewith it hath pleased God to bless me in this life, I give and dispose of the same in the following manner, Viz: First, It is my Will & I order & direct that all my Just debts & funeral expenses shall be first paid out of my Estate, by my executors herein after named. Item, I give & bequeath unto my well beloved wife Theresa Noel, the house in which we now live, with all & every the Rents, profits & emoluments of the Farm as per Articles of Agreement between me and my son Andrew Noel Junr. (a copy where of is in his possession & another lodged with this my will) & it is my construction of the void agreement, & my will that the firewood therein mentioned shall be cut short at the door ready for the kitchen & stove for the use of my said wife; I also give and bequeath to my said wife one good bed, bedstead & bedding sufficient, the stove as it now stands in the house, the corner cupboard & furniture, together with such other household & kitchen furniture as she & my executors herein after named shall think necessary for her to keep house, also one Milck (sic) cow--All during her natural life, & at her decease to be sold by my Executors, & the surplus after payment of her funeral expenses to revert toItem, I give & devise to my son Andrew Noel the farm on which I now live, supposed to contain about three hundred & forty eight acres to hold to him his heirs & assigns forever, from & after the death of his mother, & subject in the meantime to the bequests to his said Mother & at her decease to the payment of seven hundred pounds in the manner mentioned in the Articles of Agreement herein before mentioned. Item, I Give & Bequeath to my three sons, Jacob, John, & Nicholas Fifty Dollars to each and every of them. Item, (unreadable) as touching all the rest, residue and remainder of my Estate, Real, Personal & mixed, of what kind & nature the same may be whosesoever found, I give, bequeath & devise the same unto my ten children, Viz--Jacob, Madalena intermarried with Thomas Noel, Margaret intermarried with George Starns, John, Susanna intermarried with Isaac Warren, Nicholas, Catharine intermarried with John Lonsteter, Barbara intermarried with Frederick Warren, Betsy intermarried with Paul Miller, and Theresa intermarried with David Warren, to be divided equally amongst them, share & share alike, but with respect to my two daughters viz Madalena & Margaret it is my will & I order & direct that their shares of my estate shall be retained by my Executors, & given to them respectively as they may stand in need, at their discretion, & the balance if any, at their decease, to be divided equally among their children respectively. And whereas I did, sometime in the spring of the year one thousand eight hundred & fifteen, execute & deliver unto my son in law John Lonsteter, a certain instrument of writing empowering him to transact my business & etc., It is my will that the same be cancelled and become void and of no effect & that the said John Lonsteter shall account with my Executors herein after named, for all or any part of my Estate which he may have received, by virtue of the said writing. And Lastly I nominate, constitute & appoint my son in law Isaac Warren & my friend Alexander Russell, Esq. to be the Executors of this my will, hereby revoking all other wills, Legacies & bequests by me heretofore made, & declaring this & no other to be my last Will & Testament. In Witness whereof I have hereunto set my hand & seal the thirty first day of October in the years of our Lord one thousand eight hundred & sixteen. Abraham Strosbaugh John Dillon Adams County, PA Before me James Duncan, Esq., Register for the probate of Wills & granting Letters of Administration in and for the County of Adams in the State of Pennsylvania, personally came Abraham Strosbaugh and John Dillon the subscribing Witnesses to the foregoing Instrument of Writing, and on their solemn Oaths do severally say, that they were personally present and saw and heard the therin named Andrew Noel sign his name unto and seal and publish the foregoing Instrument of writing as and for his last Will and Testament, and at the time of doing thereof, he the siad Andrew Noel was of a sound and disposing mind, memory & understanding to the best of their knowledge and belief, and that they subscribed their names thereto as Witnesses in the presence of the said Testator, and at his request, and also in the presence of each other at the same time.
