Subject: [Mitsawokett] Last Will and Testament of Elisha Durham

Will, Elisha Durham, - Negro -
----------
Little Creek Hundred Kent
County and State of Delaware
In the name of God Amen.
I Elisha Durham, being of sound and
disposing mind and memory, considering the
uncertainty of life, and the certainty of death,
do hereby make and publish this my last will and
testament in manner and form as follows. To wit.
First, I will and devise to my wife Priscilla
Durham the house and premises on which I now
live containing about fifteen acres of land more
or less, situated on the main road leading from
Dover to Kenton and on the east side of said
road; beginning at the bend of the aforesaid
road opposite an old ditch bank, and running
northward with and on said ditch bank about
twenty-six perches to a stone now set on top of
said ditch bank; thence eastwardly running a
straight line to a white oak that stands in or near
the line that divides the lands of John Rheims
from my own about sixty-eight perches, thence
southward to a stone that stands on the line
dividing the lands of John Moore and John
Rheims, and which is a corner of my lands;
thence westward up the road leading to Kenton
about sixty-seven perches to the place of beginning,
including the forty square perches which
I purchased of John Moore. The above described
----------
tract of land I devise as above stated to
my wife Priscilla Durham during her natural
life instead of dower.
Second, I devise to my grandson Robert
John Durham son of my daughter Elizabeth
Durham, now Elizabeth Williams wife of Baynam
Williams of New Jersey all the above described
tract of fifteen acres of land be the same more
or less, and to his heirs and assigns forever,
after the decease of my wife Priscilla Durham;
provided nevertheless if the said Robert J.
Durham should die without lawful issue
then the above described real estate shall
revert to my legal heirs.
Third, I bequeath to my wife Priscilla Durham
all my house hold goods, and one third
of all my other personal estate after all
my legal debts and funeral expenses have
been fully paid and satisfied.
Fourth, I bequeath to my grandson Robert
J. Durham above named, one cow at my decease.
Fifth, I devise to my daughter Mary Clark
wife of George Clark, her heirs and assigns
forever, the five acres of land situated on
the north line of the whole tract on which
the house now in the tenure of George Clark
stands as her full share of my real estate.
----------
Sixth, I order and direct that my
Executor, herein after named, shall sell and dispose
of all the remainder of my real estate, being
about sixty acres, to the highest and best
bidder, sometime within one year after my
decease, for the use and benefit of my other
children and their heirs, to be divided among
them as follows, to wit.
To Joel Durham one seventh.
To Isaac Durham one seventh.
To the heirs of Elijah Durham decd namely
Isaiah Durham, Elijah Durham and Mary
Catharine Durham one seventh, to be paid
to them severally as each shall arrive at the
age of twenty-one years.
To Elisha West Durham one seventh.
To John West Durham one seventh.
To David West Durham one seventh.
To Elizabeth Williams wife of Baynam Williams one seventh.
To Hester Driggus wife of David Driggus one seventh.
Seventh, I bequeath all the remainder of my estate
of whatever nature, after all my debts & funeral
expenses have been paid as herein before provided,
to be equally divided between my eight children
or their heirs equally, share and share alike.
Eighth, I hereby constitute and appoint
James S. Moor of Moorton my executor
----------
of this my last will and testament.
In witness whereof I have hereunto set
my hand and affixed my seal this
the twentieth day of April in the year of our
Lord one thousand eight hundred and
sixty-four.
