Indenture from Henry and Martha Jones to Robert Jones, Washington Co. VA 1826

This Indenture made this twelfth day of July in the year of our Lord one thousand eight hundred and twenty six between Henry Jones of county of Washington in the State of Virginia and Martha his wife of the one part and Robert Jones of the County and State aforesaid of the other part. Witnesseth that whereas Samuel Steele the elder of Rockbridge County Virginia by his last will and testament dated in the year 1807 devised a certain tract of land lying in Washington County on the middle fork of the Holstein river containing three hundred and sixty acres in moiety to John Steel his son and the other moiety to his other children as by the said will records in July 1808 in Rockbridge county appears and whereas Henry Jones of said county of Washington purchased of John Steel aforesaid his moiety of said land and received his conveyance therefore through Philip Beddenger his attorney in face and afterwards the said Henry Jones purchased of William Patterson and Sarah his wife William Steele and Elizabeth Grimes heirs and heirs of Samuel Steel the elder the other moiety of said tract except the portion of Samuel Steel the younger now deceased which was by him sold to John Hide and by said Hide to said Robert Jones the son of the said Henry Jones and the said Henry having received conveyances for the portions so as aforesaid purchased by him of the tract aforesaid and having sold the same to his son the said Robert on which he has lived for four years therefore these presents witness that in consideration of natural love and affection and also for and in consideration of the sum of three hundred dollars current money to him the said Henry in hand paid by the said Robert the portions owned by said Henry being exclusive of improvements made by said Robert worth about two thousand dollars doth by these presents grant bargain and sell to the said Robert and his heirs forever all the interest of him the said Henry in said tract the said portions being undivided which be acquired by purchase as aforesaid being one hundred and eighty acres a moiety thereof from John Steel and one hundred and twenty acres from Wm. Patterson and wife, William Steel and Elizabeth Grimes except twenty one acres described by metes and bounds which he the said Henry reserves. the three hundred and sixty is bounded as described in a deed of conveyance from Wm. Patterson and Sarah his wife, William Steel and Elizabeth Grimes to the said Henry Jones bearing date the 27th day of July in the year 1820 which is recorded in the Court of the said county of Washington. the twenty one acres reserved by said Henry Jones is bounded as follows, to wit Beginning at a white oak on the points of a large ridge being an original corner thence S22 E35 poles to a large red oak thence S53 W39 poles to a small hicory and large poplar on the North side of the ridge thence N8½ W27 poles to a large red oak on the north side aforesaid ridge thence N13½ W32 poles to a hiccory dogwood maple and dead locust corner to the old line N87 E23 poles to a white oak hiccory and black oak and walnut thence N64 E44 poles to the beginning and the said Henry Jones for himself and his heirs doth covenant with the said Robert Jones and his heirs that he the said Henry Jones the said undivided portions of said tract of land except the twenty one acres reserved as aforesaid unto the said Robert Jones and his heirs against the claims of him the said Henry shall warrant and will forever defend so far only however that the said Henry and his heirs will be responsible for three hundred dollars received and interest from the date of payments in case the said land or any part of it is hereafter recovered from said Robert by due and legal means the residue in value of said portions being a gift from said Henry to said Robert his son. In Witness whereof the said Henry Jones and Martha his wife have hereunto subscribed their names and affixed their seals the day and year above written.

This Indenture of bargain and sale between Henry Jones of the one part and Robert Jones of the other part was acknowledged in the Clerks office of Washington County this 16 day of June 1829 before Jacob Lynch deputy Clerk of the said County by the said Henry as his act and deed and ordered to be recorded.
