records for 1920 nor 1930 - his grave was
never found it should have a nice headstone furnished by the VA however
there are now many woods growing around the Church where
many others might have been buried. We
know that his daughter and her husband and child are buried by or near
her father, because this author visited those graves
many many years ago, but those graves are not found either;
then what if the parents of Charles are buried here
also
JAMES was in Alabama 1860 after the death of his wife so
Josiah must have joined him, or helped him
move, and then enlisted in the Civil War...

Notes for JAMES W. MCCLAIN:
There were two James W. McClains in DeKalb County before
1850. Some researchers think that the one
born in 1811 is the son of Josiah and Nancy. Your Compiler thinks that J. W.
McClain, b. 1814 is their son. Reason #1
being that the James W. b. 1814 named his first child Josiah(after his father)
Reason #2 being that the James W. born in 1811 did not move
from Dekalb County but died there in 1889. The James W.
McClane, b, 1811 is thought to be the son of John McClain, a
brother of Josiah McClain's. This would mean that the two James W.
McClains were first
cousins.
Both of the James W. McClains that were in DeKalb County,
Ga. in 1832 drew in the Gold Lottery and
Land Lottery. They had lucky draws. One drew (Gold Lottery) land in Section
12, Dist. 1, Lot #0068. One drew in the Land Lottery Section
4, Dist 7, Lot 241. Both of these Lots are located in what
is now Cobb County, Ga. (was originally at drawing time in 1832
known as Cherokee District).
James W. McClain, born 1814 must have lost his first wife
and married again. He is found on the 1860 Coffe County,
Alabama census (P.O.Geneva) as follows: (same children as
listed on 1850 census of Dekalb County). The oldest child Josiah M.
McClain has left his father's home and
married.

Notes for JOSIAH MARION MCCLAIN:
Josiah M. McClain deserted Julia Ann America King with
four small children. He is believed to have fought in the the
Civil War and moved to Alabama where he married again. Julia
Ann filed for a divorce in Carroll County,
Ga. on grounds that he was missing and believed to have deserted her and the
children. In 1870 Julia Ann and four
children were living near Bowden, Georgia. On June 17, 1880 she lived in the 9th
District, 1006 of GMD of Carroll County, had
two children in her household with one living a short distance away. The
following census seems to be the same Josiah
M. who left his first family in Georgia.

It is the opinion of this compiler the Josiah M. McLain
who enlisted in the Civil War in Co. K, 33 Alabama Infantry in
Greenville (Butler County) in 1862 is this
Josiah. Records show that his father James W. McClain was in Coffee
County, Ala. in 1860 and that he moved there from DeKalb Co., Ga. after
he lost his first wife. In 1860 James' parents were
living in Cobb County, Ga. Josiah could have gone Ala. to visit his
father and enlisted; however, he returned home for a visit long
enough to father his last child with Juliann America King who in
1872 filed for a divorce in Carroll County stating she did not
know where he was living. Evidently, he deserted his family. No
record can be found of the
marriage.
No record has been found of his second marriage to
Elizabeth Broadway. . They are found on the 1880 Montgomery,
Ala. E.D. 142 Tuckers Store

This census would indicate that Josiah married about 1869
in Alabama. He evidently married again before Julia Ann
divorced him. The question is - was he a
bigamist or did he get a divorce over in Ala? Elisabeth had her first child
when age 16. Perhaps this was a common law
marriage.

or did Josiah run off again?

Notes for JULIA ANN AMERICA KING:
Julia Ann America King McClain filed for a divorce after
J. M. McClain deserted her and his four
children.
No marriage license for this couple can be found. It is
believed that they married in Cobb County,
Ga. and that the records were destroyed when Sherman set fire to the
Courthouse. The following record was found
in Carroll County, Ga. which proves there was a marriage between the
two.

defendant appear and answer at the next term of this else that the case
be considered in default and the Plaintiff allowed to ? and
it is further ordered that this rule be published in the Carroll

Oct. term 1872 - Liable for divorce, Juliann McLain vs.

marriage heretofore existing between the said Juliann McLain and
Josiah M. McLain be absolutely anulled and
set aside and that said Julian McLain be fully free from any liability
which she might incur by reason of a second marriage and ? of the

divorce but it is not clear who paid for
it.

Census states that Martha Ann is the mother of six children (4
living). Relatives state the son named "Penn" on this census is
actually a female.

Benjamin's first wife, Mary "Molly" died of thyphoid fever
in 1884 in Cleburne, Co., Al. (Abernathy District). She left
him with 4 children under the age of six.
James Benjamin's second wife Martha Ann Mobley is found
here on the 1900 census with her mother,
Annie Jane first married Joseph Chapel Mobley and then married an Owens
(was widowed twice). James married six
times. The third wife was Sally Wiggans (mar. 5/9/1914), the fourth wife
was Louisana Strength (mar. 8/20/1921), the fifth wife was
Sarah Alice Weathington Boatright (mar. bef.1928). Laura Ann
Yarbrough Hall) sixth wife signed his death
certificate. He had children by the first two wives
only.
Information obtained June 30, 2003 in an interview with
Cousin Estelle Boatright Messer, age 94 (a
granddaughter of J. B. McClain) is as follows: She states that one of
her grandfather's wives was her widowed Grandmother Boatright
whose name was Sarah Alice Weathington
Boatright. She states that this was not his last wife, however the order
of wiv She said that her grandfather McClain married sisters, but
that she did not know their names. After the first sister
died, he then married her older sister (90 years old and ailing)
who was living with them because he could not live with her
and take care of her without gossip. She had nobody to take
care of her and no place to move to, so he married her. More
research will have to be done to put the
wives in the correct order of marriage. She stated that he was a smart, kind
old man. He always had a garden and planted fruit and nut
trees(as well as grape vines) every place he
lived.
James Benjaman was the son of Josiah Marion McClain, b.
1840 DeKalb Co., Ga. and Julia Ann America
King, b, 17 Mar. 1841, Carroll County, Ga. married 1857 in Carroll County,
Ga.
In 1914 James, a farmer, was a registered voter in the
Turkey Creek Dist. 1240, Carroll County, Ga. James fathered four
children by his first wife and seven by his
second wife and ended up marrying six times. He was widowed four times,
divorced once, and left the last wife a
widow. His first wife was Mary "Molly"Chandler (died), 2nd was Martha Ann
Mobley (died), 3rd, was Sally Wiggans (died), 4th was
Louisanna Strength (died), fifth was Laura Jane Yarbrough
(divorced), and sixth was Ethel Boatright (living when he
died).

Your compiler remembers her great grandfather McClain.
She was nine years old when he died. He bought a small
farm (about 100 acres with a house on it) in the Ridgegrove
Community in Lee County, AL. near his
daughter Laura, her grandmother. He sold this house and land to his daughter
Laura Clements in 1934. He and his daughter
lived about 1/3 mile apart when he bought the farm. She and her husband
were renting their land from the Sanford
family of Opelika. The cause of death of his wives varied. His first wife
died of typhoid fever leaving four little children, the oldest was
Laura, about six years of age. James Benjamin (called Jim)
was about 6' tall, brown eyes, (brown curly hair before it
turned gray), olive complexion), large bone structure but thin.
He was probably quite handsome in his youth. His daughter
Laura, my grandmother, looked a lot like
him, with olive complexion, dark wavy hair, and brown eyes (she was about
5'7" tall) with nice facial
features.
The following letter was written to John Reese of Utah in
1976 by Enoch Smith, Rt. 4, Box 155, Heflin, Ala. It
seems John had asked for some church records and Enoch was
researching for John. I cite this information because it definitely
ties in our James Benjamin McClain to the McLain/McClains of
Acworth, and Cobb County, Ga.
Records of Harmony Primitive Baptist Church, Cleburne Co.,
Al (formerly Carroll Co):
"James McClaine joined Nov. 28, 1879; Julia Ann McClain
joined 1894; John Free joined Aug. 10, 1885;
sister M. J. Free by acceptance of grace; receivied J. J. McClaine by
letter; received brother J. H. McClain by acceptance of grace
(baptized July 18, 1895). Brother J. B.
McClaine served as a delegate to our sister church at (Mars Hill, Acworth, Ga.
in 1896.
(Note: Jim's grandfather Josiah McLain and many other
McLains are buried at this Mars Hill
cemetery located in Cobb County between Acworth and Marietta.)
Dear Brother Reese sorry I have not found more on these
names you requested information on but our
old Records Book is in bad shape from 1860 to 1920. It has faded out
until I just cannot read it............You might find more
information at Poplar Springs Church in Carroll Co., Ga. that might be
your best bet, so I will hush by asking you say pray for me and
mine. My wife and myself has retired and we
are 70 years old and enjoying life pretty good. Good night. My membership
is at Harmony Church."

1880.

The 1900 Carroll County census reveals that this couple
lived in the Smithfield Community. In 1910 they lived on
Mountain Road and had six of twelve children living, all born in
Carroll County, Ga. Marion was a farmer and registered voter in
District 1006 of Carroll County in 1914. J.
M. McClain and wife N.E. with 4 minor children are on the Carroll County
Homestead Records dated November 30-, 1895.
They are supposed to be buried in the Poplar Springs
Cemetery.
Compiler has death certificate. Miller Funeral Home made
funeral arrangements (Tallapoosa, Haralson
County, Ga.)
The 1920 Carroll County census, Smithfield Dist. is as
follows;

Message Board Posting by Lorena states that the sistes of
Charles Allen McClain died very young and he
had no other siblings. He said that he was an only child so they may
have died before he was born.
Charles served in WWI and his sons were also military but
there are no surviving males in this line.
His son Joe was in Pearl Harbor, was married to a Broadway but had no
children. His son Charles had only one
daughter and the other son Walton is buried at Arlington.
Elizabeth Broadway is found on 1860 census with parents
Abner and Susan Broadway. Elizabeth lter
married John Gardner in Ramer, Al after the loss of Josiah. In 1910 she
is found with John and Charles with his new bride in the same
household. Elizabeth's sister Rebecca
Broadway married Clopton Gibson who's family lso came from South
Carolina.
Lorena also states that Gr. Grandpa Charlie McClain raised
my native american mother when her parents
died so young. Charlie's mother has been referred to as Elizabeth B, and
later and later as Betty Gardner when she
remarried
