1. JAMES1 FERRY was born ABT 1774 in Virginia, and died Bef. 1850 in Grayson County, Kentucky. He married ELIZABETH HARRELL March 18, 1793 in Nelson County, Kentucky, daughter of MOSES HARRELL and ELIZABETH ?. She was born 1774 in Viginia, and died July 25, 1859 in Grayson County, Kentucky.

April 17, 1804
p.98, Benjamin Helm v. James Ferry, on debt. Court received plea of defendant that action ought not to have been maintained since the said note held by the plaintiff was given to James Johnston for payment for a tract of land of 500 acres, to which Johnston pretended that he had right and title, and Johnston did not have right or title and since hath not acquired any, and as the tract was the sole consideration for which note was given, defendant pleads as stated, Requested jury trial.

July 17 1804
p.121, Benjamin Helm, assignee, v. James Ferry, on debt, The parties appeared for jury trial, jury consisting of John Snellin, James Hendrix, James Arsbury, Presley Cummins Thomas Wheeler, Nelson Cummins, Enoch Brown, Thomas Piety, Joseph Carnes, George Hughs, Philip Tabor, and William Walker. Found that the obligatory note was not given for Land which the assignor Johnston had no title. Found for the Plaintiff, damages of 6 pounds, 8 shillings and costs, and plaintiff also to recover against defendant 18 pounds, 19 shillings and 3 pence, being the debt.


July 18, l804 Wednesday, James Ferry v. James Johnston and Benjamin Helm, in chancery. Plaintiff by attorney asked for injunction to stay proceedings on a judgment at common law obtained by Benjamin Helm, assignee of David Ward who was assignee of James Johnston for 18 pounds, 19 shillings, 3 pence debt and 6 pounds, 8 shillings damages, and costs, until the matter in the said Bill could be heard in equity. Said injunction was granted. Elisha Edwards posted bail for 40 pounds.

p.337, July 24, 1806. James Ferry v. Benjamin Helm and James Johnston, in chancery. On motion of plaintiff, an amended bill of complaint was filed, and Court ordered that Stephen Cleaver survey the land and circumscribe by certain metes and bounds all lines as the parties shall direct.

October 21 1806
p.366. James Ferry v. Benjamin Helm, in Chancery. Ordered that Stephen Cleaver do go on land and inspect (as per previous examples of rulings).

July 20 1807
p.398-399, James Ferry v. Benjamin Helm and James Johnston, in chancery. Complainant by his attorney moved Court for order of survey. Therefore ordered that Stephen Cleaver, Esquire go on the lands in question and conduct survey and report to the Court.

  Notes for ELIZABETH FERRY:
In the 1870 Grayson County, Kentucky census she had a William Ferry age 18 living with her. Was this her son ? Did she never marry? She is living in the next house to Michael Harrell.
