      1. Newton Jasper1 Filyaw was born 1848 in Alabama1, and died 10 February 1888 in Beat 5, Lawrence Co., Alabama1. He married Emily Gracie (Morgan) Burns. She was born Bet. 1847 - 1854 in Alabama2, and died 04 June 1893 in Lawrence Co., Alabama3.

Found in the 1870 Lawrence Co., Al. census, spelling TILLYAW, P. 89. Found in 1880 Lawrence Co. also in Moulton, p. 358

Molly Barrett of Hartsell, Al. said that she was told that Allie was 6 yrs. old when Newton J. Filyaw died and that James "Jim" Filyaw, brother of Allie, took him to raise. Molly found in Lawrence Co., Al. Birth and Death microfilm that Newton died in 1888 which made Allie only one year old at the time of his father's death.

The exact date of birth is in dispute.

Statement in Newspaper, dated June 8, 1893, Mrs Newton Filyaw buried at McDonald's graveyard on the Sunday before.

Last name for Emily was furnished by some family members, made statement that her name was Gracie Emily Morgan. Burns-came from the death certificate of James Monroe Filyaw.

Further information furnished by Eunice Filyaw Parker, states that Emily was full blood Cherokee Indian.


Marriage Notes for Newton Filyaw and Emily Burns:
Mollie Barrett of Hartselle said that Emily and Newt could have been married in Cullman Co., Winston Co., or Farnklin Co. because Emily was supposed to a full blooded Indian. They could have married without a bond or license so that she would not be discovered as an Indian. Many were fearful of being sent to Oklahoma at that time.

Charlie said that his mother told him that William Filyaw's wife's last name was Christenberry or Rutherford. William moved to Texarkana, Texas about 1910. He died several years before James Monroe, his brother. He is buried in Texas. There were no children.

Molly listed Maggie as having married a Stover. Said they had a daughter who lived in Hartselle, Al..
Can this be the same people , Riley G. Stover, B: 29 March 1837---D: 01 Dec. 1888. Mary A. Filyaw Stover, B: 16 April 1857---D: 26 June 1889. The cemetery is kept up by Mrs Evelyn McDaniel.

I do not remember who told me that Maggie married F. B. Spygley

Charlie's mother told him that Maggie possibly married a Glover and lived near Hartselle, Alabama.

Not sure if Allie was a half brother to the other children in his family. Some said that he was.

In the 1900 Walker Co., Al. census, p. 33 finds Allie living with his brother, James M. Filyaw. His age was 13. They were living in So. Lowell, Walker Co., Al.

On 5 Sept. 1917, Allie Filyaw and a group of other young men left Moulton for Camp Pike, Arkansas to serve in WW1.

Rites Held For Allie Filyaw, Victim of Burns:
Funeral services for 73-year old Allie Filyaw, Moulton Rt. 4, were held at 3 p. m. Sunday at Landersville Church of Christ, and burial was in the adjining cemetery, Elliott Brown-Service directing.

Mr Filyaw died at 1:20 a.m. Saturday at Lawrence County Hospital from burns suffered on the legs and hands three weeks ago as the result of a gasoline fire. He was a native countian, and a member of Landersville Church of Christ. Mr Filyaw was a widower.

Survivors include three nephews, Newt Filyaw, Hillsboro 1, Dallas Filyaw, Trinity 1, and George Filyaw, Jasper; and seven nieces, Mrs. Henry Lawrimore, Indiana, Mrs. Webb Parker, and Mrs, Leonard Parker, both of Town Creek 1, Mrs. Louise Parker, Town Creek 3, Mrs. Julia Reeves and Mrs Annie Filyaw, both of Sheffield and Mrs Grace Simmons, Jasper.

Charlie's mother told him that Allie deserted from the Army during WW1. His discharge papers had already been drawn up because of his cataracts.
