Joseph COBB vs. James C. FIRESTONE

COBB purchased John FIRESTONE’S interest in his father’s estate. By some decree of County Court land was sold in 1853 to Samuel FIRESTONE and David A. COBB was appointed receiver. John FIRESTONE started off to one of the Southwestern States, was followed by James C. FIRESTONE, son of Samuel, who prevailed upon him to transfer his interest to him, James. Joseph COBB knew nothing o fthis until James came from Ala. And presented his clain to David A. COBB who executed his note for same, which James sold to John BENTON

Mathias FIRESTONE, Sr. died spring of 1850 and his widow Polly died shortly after in spring or summer of 1850, and Mathias and Mary Ann went to live with Samuel FIRESTONE. The children of Mathias Sr. are 1. Elizabeth wife of James DOUGLAS of Mo.; 2. William of Ark.; 4. Alfred of Ga.; 5. Sarah, dec'd wife of Joseph COBB, who left children Martha wife of Joseph WARE now dec’d, David J. now dec’d without issue, Sarah E., Mary E. wife of John G. MAYFIELD of Polk Co.; 6. Samuel 7. David; (all by first wife) 8. Mary Ann who was age seven or eight when father died and who married first Archibald Miles BENTON now dec’d brother of John BENTON, and who married second John CROSS of Washington Co., Ark.; and 9. Mathias who died in fall of 1864 at age eighteen, without wife or child (the latter two are children by Polly). Samuel, son of Mathias Sr., has recently died leaving children J.C. of Ala.; Persha or Portia wife of Thomas MARTIN; Mary wife of Jesse GIVENS of Ga.; Telitha wife of John BRANDON of Ga.; Sarah wife of Jesse PURDY of Texas; Permelia wife of James PEAL of Ga.; and S. POLK residence unknown. Complainants charge that the execs. had no right to sell land in 1853 by order of County Court. Chancellor decrees in favor of complainants and the Tenn. Supreme Court upholds the decree. The land was rented out by the U.S. Government for three years during the War. About 1865 Samuel FIRESTONE deeded it to his daughter Permelia who afterwards married PEAL. Mary Ann and A.M. BENTON give power of atty. to John BENTON and Carter W. COBB 22 Sept. 1859. Elias P. BLOOM died during the suit leaving widow Susan and children Eliza wife of William WATTS, Elizabeth, G.M., Harriet, P.D.K., and Susan who married BLOOM.
