Justus H. Cole, who died on the 5th inst., and whose death appeared in our last issue, was born in Oneida. While yet young he removed to Albion; and there in after years was united in marriage to Miss Lodema Gorton, with whom nearly fifty years of wedded life happily passed. They removed to the west, where they settled, and where two daughters were born to them, the late Mrs. J.M. Foreman and Mrs. C.F. Prentice. Thirty years ago he returned to this state and located in Le Roy. Here to the day of his death he has been a blessing in his home, a blessing in the community; a blessing wherever his pure deeds have been known; especially in the Baptist church of this place, which will keenly feel the loss of one of its most zealous members .... He died of pulmonary disease; was confined to his room but three weeks...

In closed you find papers showing my appointment Gardean of Lenard Cole + Windfield Cole since the deth of thare mother Mary A. Whealer. And other papers + affidavits that I have been able to gather from time to time since hear deth. Since my appointment I have received this sheet from Alice Post office in Oceana Directed to Mary A. Whealer mother of Lenard and Windfield Cole (and Elizabeth Cole, the later still in Mich. Oceana Co.) The two boys are with me + have been since last fall. the little girl I have not been able to git yet on the account of her grand Father Townsend gitting her + gitting appointed her gardean under handedly and will not give her up as yet. he is an old man 75 years old has a second wife no kind to the girl. They live in the woods of N. Mich + all he wants of her is to git her Pention to use for his own benefit so sais all the other Relatives.

I live as you see in LeRoy, Genesee Co NY + have been for 20 years past + after the death of Mary A. Whealer that was my Brother's widow I went out thare + got the two boys + such papers as I could to inable me to git thare pention some have been sent to me since. I found them destitute of the comfort of line a lone in a log cabin in th ewods. thare s[tep] father 40 miles away to work on a job + was not at home scarcely any of the time. After I returned with the 2 boys I went to our Suroage to get appointed thare Gardean. The judge toald me it would not be [unr] till I could git all three of the children here + then git the appointment for all three for thare could not be but one gardean to be recognised at your department so I have delade till gitting your leter. Requesting of thare Mother who was thare gardean to send you evidence of her marriage to Whealer + the birth of her children. I send you there facts with what other evidence I have been able to git living here so far away + both partys dead you find there marriage surtiffacate sent me by the CLeryman that married them. I wrote him to send me a certifide copy of marrage of Mary A. Cole to Dexter M. Wheeler. He sent me the one you find here. I also got an affidavid of thare [unr] of her deth you also find. and the affadavits of two women who knew of the birth of her children. thare physicn would not be found he had moved a way.

I also send you a copy of thare family record taken from thare family Bible recorded by thare Father Archibald L. Cole sent me by Whealer. This is all you ask for in your leter. If you wish any thing more or more defined please write me back what further

as to the little gurl Elizabeths pention you can send it with the two boys or retain it till I can git her here with me. I can be appointed her gardean with the boys as you think best. If you should [unr] it me I will keep it for her benefit whether I git her here or not.

PS. I have other Papers showing my Brothers (Archabald L. Cole) Marriage to Mary A. Townsand + his inlistment in the US Service + his death by wonds in Emery hospital. But I supose you have all there facts from his Widow by which she drive her Pention before her mareage to Whealer. I suppose the children will be intitled to what would have been her due had not she marryed again, in adition to thares. Please send me all they are intitled as they are intirely destitute of properly + both thare parents. I will get the girl as soon and git [unr] from this. JH Cole
