In the name of God Amen I Miles Garthwaite Clerk parson of Fulbeck in the county of Lincoln sick in body but in perfect memory praise to God do make my last will and testimony in manner and form. First I give and beg with my soul into almighty Go d my creator and redeemer hoping and being fully persuaded of eternal life by the merit of Christ and my body to be buried within the chancel of the Church of Fulbeck aforesaid. Item: I give and bequeath to Ephram Garthwaite my eldest son the su m of four score pounds of lawful money of England to be paid by my executrix at her discretion at any time within 8 years after my decease as occasion shall be offered for further education and learning or putting forth to be an apprentice or othe r preferment and my will is ( see my note below) if my said son Ephram Garthwaite will rest himself contented in full and satisfaction of childs portion with four score of lawful money of England but seek some pretended title or otherwise of an y of my lands. Item: I give and bequeath to Samuel Garthwaite and Thomas Garthwaite my sons a 100 marks a piece of lawful money of England by my executor at her discretion for their preferment as before at any time they shall accomplish their ag e 24 years. Item: I give and bequeath to the rest of my children Timothy Garthwaite, Benjamin Garthwaite, Edward Garthwaite, Elija? Garthwaite and to that which is now within the womb of my wife 100 marks apiece every one of them in lawful mone y of England to be paid by my executor at their discretion likewise for preferment before 24 years old. If any of them die before reaching particulars then my will will be divided between survivors. I shall make a condition my wife Ellene to wh o I give my estate debts funeral charges all my lands tenements in Fulbeck and Long Leadenham to be sold by her at her pleasure to be sold to pay all debts and legacy. My wife not only to sell item off but to pay education for my said children pro vided that if she do so before day of marriage she be called to give sufficient surety remainding there in the lands at the discretion of my supervisors and to give portions. Lastly I do desire mf cousin Roy of Welbourne. Mr Thorold of Caistor ? Mr Luddington of Leasingham to supervise directions of my wife who I give 10 shillings. 40 shillings to the poor people of Fulbeck by my executors as the need. Item for my daughter Garthwaite for score pounds to her portion. Item tha t if my wife do marry again my supervisors bonds for my children if not sufficient if not perform then my supervisors shall have power to receive and require and every presently without delay on marriage.
The rest is in Latin. The date of the will is January 31st 1616/17.
This is in secondary hand and , so the expert said very difficult. I hardly understand a word. This was speed read to me by a busy tutor so it is not word for word but the salient features are correct.
There is a "not" missing out of the original because he is saying if Ephram contests will and goes for more then he risks losing the lot.
His wife is his executor but he has ensured that if she marries again she takes a bond and he has appointed supervisors to ensure his will is carried out.
Apparently he is a very rich parson. His will does not detail land, houses which will go to his wife but he is to leave Epram £80 ($112). The no name daughter £80. The other sons 100 marks each, a mark is 13s 4d now worth about 65 pence, so 10 0 marks is £67 ($94).
The year is shown as 1616/1617 as at sometime later, I cant remember the year at the moment, they changed the end of the year from 31st of March to 31st of December so whilst the will was made in 1616 for current research it is dated 1617.

Garthwaite, admittedly of the ancient family of same of Richmondshire in Yorkshire.
Rev. Miles Garthwaite, MA. Born c. 1576. Rector of Fulbeck, co. Lincoln. Presented to that living by Queen Elizabeth. Instituted 03 April 1598. Compounded first fruits 04 April 1598. Married at Hackney, co. Middlesex 13 May 1599 (PR). Died 04 Ja n 1616 per his epitaph (Harl. MS 6829 f.341) age 40 but on 05 Jan per inq. p.m. taken at Sleaford 02 May 15 Jac. I; seised of lands (Suttons Farm, Bartons Farm, and Catlins Farm) held of the Monors of Fulbeck and Long Ledenham, co. Lincoln. Burie d at Fulbeck 12 January 1616. will proved at Lincoln by Ellen Garthwaite, the widow and executrix. The date appears to be shortly before the birth of his daughter Elizabeth, who was baptised 21 May 1615. Mentions his children (Samuel, Thomas, Benj amin, Timothy, Anna, Edward, Ephraim, Eleazor and Elizabeth mentioned as " that which is now within ye wombe of my wife") and his "Cozen Roe of Welborne". Legacy to the poor of Fulbeck. To be buried in chancel of Fulbeck. Agnes Garthwaite burie d at Fulbeck 07 December 1612 may have been mother or sister.
Note: I went to Fulbeck church in 1992. I was unable to locate to grave of Miles or Agnes Garthwaite, but he is listed as one of the rectors of that church on a wall engraving. There is also a baptismal font at the church which dates back to th e 12th century and is probably the same one Miles Gartwaite baptised his children in. \\

[PDMAN] ([MGC])-"just before my niece and I went to Lincoln in 1910, leading residents of the city and count of Lincoln had founded a society, to be called the 'Lincoln Record Society', its purpose, publishing Lincoln records. I was pleased to ac cept the invitation to join. Their first publication was the Holles, 'Lincolnshire Church notes' (issued in 1911), on page 281 of which is copy of the quaint inscription which reads, together with Holles' note: ' On a flat gravestone:' Enclosed he re Miles Garthwaites corpes doe rest; His spirit heaven hath forever blest. He loving pastor like Christ's sheep susteyned with sacred write Soules food by Christ ordeyned. All pastors preach gods worde, all People heare, That you may rest with Ch rist our Saviours deare, "Obit 4to die Januarii, Anno Dni 1616, Aetatis Suae 40 Persuit Helena Garthwaite".
When I received my copy of that work, it gave me something of a thrill that after the epitaph of my earliest-known paternal ancestor had lain buried as it were, in the British Museaum as "Harleian Manuscript No. 6829", it had been my privileg e ater three centuries to have even in so small a degree, a part in bringing it to light. but the hightlight of all of my research, was holding in my own hands, that precious parish register of Fulbeck Church, the yellowed pages bearing Reveren d Miles Garthwaite's own clear hand, the entries of all the marriages, baptisms and deaths aat which he had officiated, froom 1598 to his death, January, 1616/17.
(p62) Burke's Landed Gentry (Vol, 2, p 135, Supplement) confirms Canon Maddison as to York having been the original seat of the Garthwaite family by stating' The Reverend Miles Garthwaite, rector of Fulbeck Co, Lincoln, Descended from a family ori ginally from York, died in 1616, he leaving besides other children a son Ephraim. Reverend Ephraim married Dorothy, wido of Thomas Bunworth Esq. and daughter of Ashton Esq. by his wife, Elizabeth, sister of Sir Henry D'Isney. By this lady Mr. Gar thwaite had besides other sons and daughters, Nathaniel. (See Howard's Miscellanea Genealogica and Heraldica, Vol. II, Second Series page 111.)
GARTHWAITE HALL, 'Yorkshire Notes and Queries and Folklore" Garthwaite Hall, former residence of the Yourkshire family is a fine relic of early seventeenth century architecture. Here the notorious eugene Aram, who was born at Ramsgill (two mile s farther in the valley), baptised and married at Middlesmore Church, taught school. ; (all that about a common murdere hanged for his crime and not a word about the Garthwaite family who built the Hall. MGC)
"History of the County of York' by Thomas Allen, published December, 1828, book VI, pp. 185-6; "AAt Gowthwaite Hall, now a farmhouse, was born 1731 William Craven, D.D. Here Eugene Aram born at Ramsgill in the township of Stonebeck, 1704, convicte d at York in 1759 for murder of Daniel Clark, had a school".
(p 63) GILES GARTHWAITE (GAWTHWITHE, GARTHWICKE) of Richmond, pleb. Trinity College, Oxford, metric. entry under date of 12 December, 1572 ae 16 years; B.A. 29 February 1575/6, as Garthwright; vicar of Highington, Co Durham, 1594. See Foster's Ind ex Eccl. (note, M.G.C.; I was unable to locate a copy of 'Foster's Index' The item as given here was taken from the Alumni Oxonieness, the published record of Oxford graduates. This is the only instance I found were either church of college recor ds garbled the name of Garthwaite). (p 41) "giles" be a misprint for "Miles". said Giles having been the father of our rev. Miles of Lincolnshire who "was admittedly of the ancient family of Richmond and York', per "Linconshire Pedigrees" , by Canon Maddison? M.C.C. this is the only instance where I found the name of Garthwaite, garbled in either university or church records.
(p40), "admittedly of the ancient family of Richmond and Yorkshire; born 1576; Rector of Fulbeck, co Lincoln, presented to that living by Queen Elizabeth, 3rd April, 1598". So reads the opening of the account of the Garthwaite family of Linconshi re Pedigrees, compiled and edited by Canon A.R. Maddison, F.S.A., Vol. 2, page 388. published in 1903 by the Harleian Society of London. The Rev. Miles married at Hackney, Co Middlesex, 13 May, 1599, Helen (Ellen, Eleanor &c), 'daughter and in he r issue, co-heir of Walter Audley of Grantham". the memorial stone tablet erected by his "widow, Eleanor", per his epitaph, gives the date of his death as January 4, 1616/7. He was buried in the chancel of the church. His will named wife, "Ellen " as sole executrix, mentioned all of the living children and bequeathed a legacy to the poor. According to his Will and the parish register, Rev. Miles and Ellen had issue: Ephraim, Samuel, Thomas, Benjamin, Who died 1609, Timothy, Anna, Edward , Eleaser and Elizabeth Twins,
[KimKnox]- Here is the text of a letter I received, in 1993, from the Lincolnshire Archives:
The Lincolnshire Family History Society have passed your letter on to us, the county and diocesan record office for Lincolnshire. I am happy to inform you that we do have some information on the Garthwaite family mentioned in your letter.
From the 'Alumni Cantebriensis' we discover that Miles Garthwaite went to St John's College, Cambridge in 1588, gaining his BA in 1592-3, and his MA in 1596. He was ordained in Peterborough in 1596-7, and became Rector of Fulbeck in 1598, a positi on which he held until his death in 1616. He was buried in the churchyard at Fulbeck, and Lincolnshire Archives holds his will and inventory - document reference nos LCC WILLS 1616/208 and INV 119/544 We also have a Presentation Deed for his pos t as Rector of Fulbeck - document reference no PD 1598/38.
We have references to several other Garthwaites in our wills index, and as we also hold the parish registers of baptisms, marriages and burials for Lincolnshire, I would think it likely that you would be able to find out more information about th e family from he sources held here at Lincolnshire Archives. "At this point one might think of it a a typicla Yorkshire Dales river over which old men can lean on the bridge and in which youngsters can tickle the trought unde r ists banks. Yet in a mile or so it is recaptured again, this time in the great length of the GOWTHWAITE reservoir, a compensation reservoir which it must be admitted has something of the beauty of a Scottish loch, ..... To build this it was nec essary to demolish the pleasantly mullioned GOWTHWAITE Hall, one of the homes of the Yorke family whho owned much of this dale as far back a Elizabeth times. A member of this Catholic family was accused of harbouring at the Hall a conspirato r in the Gunpowder plot and the story is told in the dale that the family was heavily fined for allowing a Catholic play to be performed in the house. It is also said that when the reservoir was built the then tenants refused to move until the wat er was actually lapping at the door, but this scaarecely agrees with the fact that, with true Yorkshire carefulness, much of the old Hall was dismantled and used to build another house which can be sean on the up-dale road to Ramsgill."
