AMOS MCCREARY'S ESTATE PETITION FOR WRIT OF PARTITION
To the Honorable Judges of the Orphans Court of Bedford County now setting at August 1832.The petition of Amos McCreary and Robert McCreary children and legal representatives of Amos McCreary late of Napier township deceased, respectfully sleweth that the said Amos McCreary lately died intestate leaving four children viz. Thomas the eldest, Amos and Robert your petitioners and Rachel intermarried with Paul Mock and fourteen grandchildren viz. Amos, Mary, Rachel, Thomas, Elizabeth, Sarah and Isabella Calihan, children of Isabella on of the daughters of the said deceased and Jennings, Amos, Rebecca, Alice, Hannah, Thomas and John Oldham children of Hannah Oldham another of the daughters of the said deceased. That the said intestate died seized in his demesne as of fee of and in the following described tracts of land situate in the township aforesaidviz. One tract the mansion place composed of four small tracts all adjoinin, containing about one hundred acres more of less adjoining lands of Thomas McCreary and Stephen Wonder and others, all patented except the 100 acre tract that the said children and legal representatives of the said intestateof the same can be so parted and divided as to accommodate them all without prejudice to andspoilingthe whole thereof, but if the same cannot be so parted and divided as to accommodate two or more of the said children and legal representatives of the said intestate and if they do so find then to ascertain how many the same will accommodate and value and appraise the same in seperate parts-but if the children annd legal representatives of said intestate without prejudice to or spoiling the whole thereof, then to value and appraise the same together and undivided and make report according to law and they will pray etc

Bedford County S.S. The Commonwealth of Pennsylvania, To the Sheriff of Bedford County Greeting:Whereas Amos McCreary and Robert McCreary two of the children and legal Representatives of Amos McCreary late of Napier Township presented a petition to the Orphans Court of Bedford County, setting forth that the said Amos McCreary lately died intestate, leaving four children to wit; Thomas the eldest, Amos and Robert said petitioners, and Rachel intermarried with Paul Mauk and fourteen grandchildren, to wit: Amos, Mary, Rachel, Thomas, Elizabeth, Sarah and Ezabella Calihan, children of Isabella one of the daughters of said deceased and Jennings, Amos, Rebecca, Alice, Hannah, Thomas and John Oldham another of children of Hannah OLdham, an other of the daughters of said deceased.That the said intestate died seized in his demesne as of fee of and in the following described tracts of land situate in the township aforesaid viz.On tract the mansion place composed of four small tract all adjoining, containg abnout three hundred acres more or less, adjoining lands of Anthony Blackburn Esq. and others.One other tract containg about one hundred and eight acres adjoing land of Peter Hiner and others- also one other tract containing about one hundred acres more or less, adjoining land of Thomas McCreary, Stephen Wonders and others, all Patented except the one hundred acre tract that the said children and legal representatives have never agreed upon a division of the said Lands and tenements among themselves, but continue to hold the same together and undivided-And praying the Court to award an Inquest to make partition of the said tracts of land to and among the children and Representatived of Intestate, if the same can be so parted and divided as to accommodate them all without prejudice to or spoiling the whole thereof, but if the same can not be so parted and divided as to accommodate all of the children and legal representatives of said intestate, then to ascertain whether the same could be so parted and divided as to accommodate two or more of the said children and legal representatives, and if they do so find, then to ascertain how many the same will accommodate, and appraise the same in separate parts.But if the same cannot be so parted and divided as to accommodate two or more of the said children and legal representatives of said intestate with out prejudice to or spoiling the whole thereof then to value and appraise the same together and undivided and make report according to law.And the Inquest was awarded by the said Court agreeably to the prayer of said petitioners.We therfore Command you, that taking with you twelve free hones and lawful men of you Bailiwick, you go to the tracts of land aforesaid and there upon their oaths and soleumn affirmations, in presence of the parties and the presence of the guardians of such as are minors, by you to be warned, (if upon being warned they will be present) the aforesaid tracts or parcels of land into six equal parts you cause to be parted and divided, if the same can be so parted and divided without prejudice to or spoiling the whole thereof, and one of the said equal parts unto the said Thomas McCreary, one other of the said equal parts unto the said Amos McCreary,one other of the said equal parts unto the said Robert McCreary,one other of the said equal parts unto the said Paul Mock and Rachel his wife in right of the said Rachel,one other of the said equal parts unto the said Amos, Mary, Rachel, Thomas, Elizabeth, Sarah, and Isabella Callihan in right of their mother Isabella Callihan late Isabella McCreary and the other of the said equal parts unto the said Jennings, Amos, Rebecca, Alice Hannah, Thomas, and John Oldham in right of their mother the said Hannah Oldham late Hannah McCreary dec. to them in severally you assign and deliver- but if the said inquest cannot make such partition of the tracts or parcels of land and premises without prejudice to or spoiling the whole thereof, then that you cause the said Inquest to enquire whether the said tracts of land and premises will accommodate two or more of the said children and legal Representatives without prejudice to or spoiling the whol thereof and if they do so find that they ascertain how many of the children and legal Representatives, the same will accommodate, describing each share by metes and bounds and make a just and separate valuation and appraisement thereof-but in case any such partition cannot be made of the tract or parcel of land aforesaid without prejudice to or spoiling the whole thereof that then you cause the said Inquest to value and appraise the whole together and undivided--And that, that partition or valuation so made you distintly and openly have before our Judges at Bedford at our Orphans Court there to be held the Fourth Monday of November next, under you hadn and seal under the hands and seals of those by whom oaths or solem Affiermations you shall have made that partition or valuation.Witness the Honourable Alexander Thomson Esq.President of our said Court at Bedford the thrity first day of August Anno Domini One Thousand eight hundred and thirty two.
