"James Guthrie, immigrant from Ireland between 1765 and 1770, settled in Maryland, whence he moved to North Carolina before the Revolutionary War. Descendants are unable to give positive information as to his service in that War, though it is believed that he was a soldier in it. He settled near Hillsboro, county seat of Orange County.

[Notes: Upon reading in more detail the information provided about the 1790 NC US Census, I realize that the census for Orange, Caswell and Granville counties is far from complete. The state itself was divided into 8 districts with several counties falling into each district. The HILLSBOROUGH DISTRICT was comprised of 6 counties: Chatham, Randolph, Wade, Caswell, Granville and Orange. The last 3 counties are listed as "missing" with the names being taken from TAX lists of the time. Therefore, the James Godfrey listed for At. Asaph's District of Hillsborough District of Orange County, NC is a name taken from the TAX LISTS and not the actual census. This also explains why there is no enumeration of those members of his household as with the many other counties.]

"In the name of God Amen. I James Guthrie of Orange County and State of North Carolina being in perfect mind and memory but finding the decline of life and my disalution fast approaching and calling to mind the certainty of death I constitute this my last will and testament making void all other wills and testaments hertofore made Commiting my body to the dust from whence it came and my soul to the mercy of God who gave it and as to my temporal property it hath pleased God to bless me with in this life I dispose of as follows.

[Notes on above deed abstracts:
The land indentures listed above clearly indicate that James Godfrey was of Orange County, NC. This may suggest that he is our James Guthrie, Sr. or simply another James "Godfrey/Guthrie" of Orange County, NC. It appears that James Godfrey possessed a 1000 acre tract of land which was granted to him by the state (NC?) and parts of this land were sold to Joseph and Witheral Latimer. This same property was later bought by James & Robert Guthrie. Does this indicate that our James & Robert were purchasing land previously owned by their father? There is no mention of this land in James Guthrie's 1801 will. Assuming that it indeed belonged to him, he must have sold all of it by 1801 or previously deeded it to his sons.]
[Follow-Up 7-15-97: An examination of microfilmed originals shows that the sale of 700 acres by James Godfrey to Benjamin Rainey was also part of the original 1000-acre land grant. Combined with the 150-acre sale to Joseph Latimer and the 150-acre sale to Witheral Latimer, the 700-acres to Benjamin Rainey indicates that all 1000-acres were sold by James Godfrey by 1798. This is 3 years prior to the death of our James Guthrie, Sr.]

[Notes: Here is some evidence to suggest that the 1000tr of Red River land belonged to a James Godfrey of another line, although it seems rather coincidental that Guthries/Guthreys/Godfreys purchased the same land.]

Notes re: the Survey, Purchase and Sale of Land within Orange and Caswell Co., NC involoving the name of JAMES GUTHRIE/GODFREY/GUTTRY & various other spellings:
According to known facts and suggested information, James Guthrie, Sr arrived in the colony of MD before moving on to Orange County, NC sometime between 1765-1770. He purchased land & raised his family. He died in Orange County, NC in 1801 survived by his wife and 8 children.
There are many land entries for James Guthries of various spellings, usually Guttry, Guttrie or Godfrey. James Guthrie's 1801 will does not identify a specific creek, so it is difficult at first to determine the location of his property. By examining the deeds of Orange and Caswell Counties, it is possible to establish the general size and location of the property James Guthrie owned at the time of his death. Other properties mentioned may have been owned by James or another man by the name of James Godfrey.
The fact thattwo of the latter entries (1805 & 1810) indicate that the land owned by our Guthries was located on the South Hico River makes a definite connection to the remainder of the Hico land entries. The first entry which suggests a Hico connection is the 18 Nov 1778 deed of William Muzzle which lists "Guttry" as owning neighboring land, although it does not specify this owner as "James" Guttry. The next is the 14 Dec 1779 deed of Hugh Shannin on the Hico next to the Caswell County Line where James Guttry is a chain carrier during the survey. Then on 11 Aug 1784 James Guttrie purchases 440 acres on the S. Hico in Orange and Caswell Counties from John Gibson; Forrest is a neighbor. Two of James Guthrie's daughters married men by the name of Shannon and Forrest.
At the time of James Guthrie's death, his 1801 will divides his property as follows:
To son James, 100 acres of land on the North Side of the Creek
To son Robert, 100 acres of land lying West of the land given to James, Jr
To wife Elizabeth, all lands on the South Side of the creek (no mention of acreage)
The sale of 200 acres of land by James Guthrie's sons James and Robert is recorded in Caswell County. They were given theland on the North Side of the Creek. Both sons were located in Sumner County, TN at the time of this 1805 deed. In 1810, their mother, still living in Orange County, along with her sons-in-law James Madden and Alexander McMinnamy, sell 323-1/2 acres on the S. Hico.
Uncertain why Elizabeth Guthrie's sons-in-law would be listed as primary individuals in the sale of land unless they were pooling neighboring lands together, were acting merely as male overseers or had (probably) become part-owners/owners of the land once owned by Elizabeth's husband. It is possible that in the 9 years since her husband's death that Elizabeth "sold" parts of the land to her sons-in-law for sake of an income.

Haw River land entries for "Jas Godfrey" appear within a month of the first "Guttry" entry. All but one of the Godfrey entries include James as a chain carrier for the survey of the land in the deed.The other entry is the issue of 225 acres of land to James Godfrey on Varnals Creek of the haw River. Godfrey entries are located on the Allemance (1), Varnals Creek (5), Mary's Creek (1) and Haw branch (1). Varnals, Marys and Haw are all branches of the Haw River.
Both "Godfrey" and "Guttry" are listed as survey chain carriers in different land deeds. The 1801 inventory of James Guthrie's estate indicates "2 pr. Chains" as part of his property.
Despite the fact that the 1790 Census lists only one "James Godfrey"
of any spelling in the NC Census for Orange County, there is no way to pronounce Godfrey and Guttry the sameJames Guthrie without further research on the James Godfrey name. Godfrey is too much of an official name versus a misspelling to ignore the possibility that they are separate men.
Caswell County entries for William and James Guthrie(sp.) probably indicate a different individual, unless James had a brother or other relative we know nothing about.

[Notes: As a follow-up to the above entry, I now believe that the James Godfrey listed in the 1790 census is probably James Godfrey of the Haw River area vs. being James Guthrie of the Hico River area. The Haw River flows through what is currently Allamance County, NC and was in 1777 the St. Asaph's District of Orange County, specifically the district which James Godfrey was listed from tax records in lieu of the missing county census. The interesting thing in examining the maps which show the waterways of Caswell, Person and Orange Counties in 1790 is that the HICO River (which has been previously established as bordering the river property of this James Guthrie) seems to be located in Person County running to the Caswell County border. None of the maps show the river extending into Orange County. One map of 1777 Caswell shows that the S. Hico Creek extends to the Orange County border in an area that would later be Person County. His will lists James as a resident of Orange County, so it is possible that his land crossed the county line and that his house was on the Orange County side, but this is only conjecture. When his sons later sold their share of the property left to them by their father, the deed was recorded in Caswell County and not in Orange. The person buying the S. Hico property was from Person County.]
