JAMES TALLY, 24 November 1874, Jan 1882 - Life estate to wife Mary, then equally to children. Son Oscar Tally, cash advanced to Aron Stinson and wife Sarah L. Stinson, daughter Juda Sloan's heirs - their father Joseph Sloan's estate, probably other children already advanced. Ex: JOHN M. DURHAM.

[Notes: Uncertain if Sally is James' daughter or another close relative. Timing suggest the latter. According to the above census, James was born in 1820. Aron Stinson, Sally's husband, was born in 1828 and Sally est at being born between 1826-1833. This would suggest that Sally was James' sister rather than his daughter.]

Son Zachariah Talley and daughter Charity Talley, granddaughters Lucy Butterworth, Polley Talley daughter of Charity Talley, Sally Talley, Lucy M. Talley, Eliza W. Talley, Permely Talley. Ex: Zachariah Talley; Reuben Talley. Wt.: William Montgomery, Hubbard Saunders, Peterfield Jefferson. (wo, 261)
[Notes: Although there is a "Sally Tally" listed here it is probably not this one. The 1820 date of Zachariah's will does not match with our Sally's birth range of 1826-1835. Also, the Automated Archives CD#2, Marriage Records of IL, IN, KY and TN lists a Sumner County, TN marriage for a Sally Tally to a Thomas Berkly on 31 Jan 1825 suggesting that this is the marriage of the granddaughter listed above. Neither the Sally mentioned in the will nor the marriage record seem to be this Sally.
Note that there is also no mention of the JAMES TALLY listed in the 1870 Sumner County Census. He was 50 in 1870, making his birth year 1820, the same year as the writing of the above will. This could suggest that James was another grandchild born after 19 Apr 1820 or that he had no relation to Zachariah. Notice that Zachariah Jr. is the only son assumed to be living in TN, as the others are specifically mentioned as living in VA.
No indication what relationship REUBEN TALLEY has to Zachariah. He could be another son who was already provided for, a brother or cousin. Reuben was the bondsman to the marriage of Sally Tally and Thomas Berkly.
