Enoch Barton departed this life sometime in the month of August 1833, and about one month thereafter his children and heirs at law, three of them being minors, met and amicably divided the money on hand amounting to the sum of $1135.47 after paying incidental expense cash as funeral expenses etc. giving to each of the seven heirs them living the following sums of money, to wit:

All of which said shares were received as above shown by each of said heirs except the three last named, who were minors and whose shares therefore were retained for their use by the above named Gilbert Barton. Afterwards Charles T. Barton and Jemima Barton departed this life and also afterwards other claims having been discovered as due to come against the estate, and unhappily difficulties and disagreements having arisen amongst themselves in relation to said estate, John Ross at the Nov. term of this court for the year 1834 was appointed administrator thereof and he accordingly took upon himself the discharge of heir Gilbert Barton, gave to said administrator written acknowledgements that they had each received the sums above specified, and that they withhold the same subject tot the order of said administrator for the payments of decedents debts etc., but the said Gilbert utterly refusing in any manor to account either for his own share, or the shares of said minors, the administrator brought suit against him for the recovery thereof, which was finally appealed to the Supreme Court; and the estate of their deceased ancestor, but that minors could not consent thereto, nor be bound by such settlement; and, therefore, rendering minor Heirs with interest amounting to the sum of $550.00 at the same time permitting him to retain his own share subject to any debts that might thereafter arise, or be presented against the estate. This judgement was rendered at the May Term of said Supreme Court in the year 1836. The administrator, therefore, in stating his account, to make all of said Heirs equal, must state it in the following names:

Notes for Margaret Barton: WARREN COUNTY COURTHOUSE Wills #5 New & Old - The court being satisfied that Margaret Barton aged fifteen years child of Enoch Barton dec'd chooses for her guardian William Coulson and Elisha H. Barton another child of said Enoch deceased in his own person in open court here choosing said William Coulson for his guardian in open court requires security of said guardian in the sum of $2,000 and approve John Randall as such security. Old C.P. File 65 William Coulson Guardian for Margaret Barton John Ross Adams. of Enoch Barton Dec'd An action of assignment brought to recover the sum of $6,000 with interest A.D. 1833, it being the amount of a legacy bequeathed to the said Margaret Barton by her uncle Charles Tower late of the State of Penna. deceased and received by the said Enoch Barton in his life time. April the 11th 1835 - the parties in the above case have agreed to wave ______ and enter into trial. Elisha Barton was called sworn and examined as a witness in behalf of plaintiff and from whose testimony it appears that the plaintiff is entitled to the above sum of $6,000 and interest from the 11th day of June A.D. 1833. whereupon the interest was calculated and Judgement entered against said defendant John Ross Adams. for the sum of Sixty-six dollars and sixty cents debt and thirty nine cents cash. Rec'd of the said John Ross Adams. as aforesaid the sum of Eighty three dollars and sixty-four cents in full of the above Judgement. June A.D. 1839. State of Ohio, Warren Co., Deerfield Township.
