1001David Halliburton, a native of Scotland, had a rich heritage of seven hundred years of Halliburton tradition which included generations of Border Clan activity in a lusty period of Scottish and English history.His rapid accumilation of land in the country would indicate he was industrious and not without means.
As a young man, possibly a student, he came to the shores of Colonial America in 1746 as a direct result of the dispersion of a large segment of the population of Scotland by the Duke of Cumberland, who had been hired by the English to subdue the Scots.
He located on the Little Stone Creek in Mecklinburg County, Virginia; and continued his residence in Virginia until after the birth of his son William, in 1760.Sometime thereafter, he conveyed his Virginia plantation home to Richard Ragsdale for the consideration of 125 pounds (143), and moved his family to Orange County in the Province of North Carolina.
David Halliburton, Sr. wrote his will Jan. 3, 1767 and it was proved in the Orange County Inferior COurt in August 1767.In his will, he named each of his sons, David, John, Charles, William and Thomas and devised property to each.David made alternate plans for his unborn child, bequeathing 100 acres of land if the child should be a boy, and personality in the event of the birth of a girl.He named his wife Amey Halliburton, executrix, and George Moore, executor. Among the descendants of David Halliburton were Richard Halliburton (1900-1939) writer traveler and lecturer;Erle Plamer Halliburton (1889-1957), whose wealth was estimated between $75 million and $100 million in 1957; and Clair Emory Halliburton (1884-1953) owner of the "Alhambra" a gold mine which yielded $900,000 in gold in 1937.
David Halliburton's widow Amey, married a neighbor, James Jones, and they were parents of two sons Ambrose and Robert Jones.

Came to America in 1746 (Duke of Cumberland got rid of the Scots to subdue them.) (3) The three brothers David, William, and Thomas came to America in 1746. They were spectators at the Battle of Culloden but the Duke of Cumberland included them in the same category as Scots and therefore they were banished from Scotland on account of adherence to Charles the Pretender and fled for their very lives. The family includes such royalty as Sir Walter Scott. You can find incredibly detailed history of all of three lines in "The Genealogical History of the Halliburton Family" written in 1959 by WK Rutherford and published by Brown-White-Lowell Press in Kansas City. It was updated in 1972.
Will written Jan 3, 1767. Proved Orange CO Inferior Court Aug 1767. Named each son and devised property to each. For unborn child (Margaret) gave land if boy and personalty if girl. (3)

IN THE NAME OF GOD AMEN, I David Halliburton of Orange County and Province of North Carolina, being weak in body but sound of memory thanks be to god but not knowing how soon there may be a change, Do this third day of January in the year of our lord, One Thousand Seven Hundred and Sixty Seven, do make and Ordain this my Last Will And Testament in manner and form following that is to say,
First I recommend my Immortal Soul into the hands of the Almighty God, that gave it hoping, through the merrits of my Blessed Redeamer to inherit Life everlasting and as to my mortal body I commit to the Earth from whence it was taken to be at the Discretion of my Executors hereafter mentioned

I give devise and bequeath my Loving wife(after my debts are paid) the plantation where I now dwell also my two negroes, Sam and Buk and all that is upon or belonging to the said plantation, during her widowhood or life I desire that no more land may be cleared over the creek but of this side also I desire that each of sons when they come of age shall have a new suit of clothes at six pounds ten shillings Virginia money price and A new saddle and Horse or more at six pounds price Virginia money the saddle at two pounds five shillings like money,
And my son Charles which is now a cripple and and if he remains so shall have good learning if he will be able to recieve it and have his free board upon the plantation, his mothers life.
At my wifes Death or marrage I desire that my land and negroes shall be divided among my children as followeth,
I expect my wife is now with child & if it come to perfection and is a boy I give and bequeath unto it one hundred acres of land on the east side of the creek joining the North line with the dwelling house on it.

I give unto my son Charles one hundred & thirty acres of land at upper joining the upper line and upon both sides of the creek.
Item,
I give unto my son Thomas one hundred and sixty acres of land joining the lower line & west line.
Item,
My land upon the Crooked fork I leave to be equally divided between my three sons
David, John and William according to quantity and quality and the child before mentioned should prove to be a girl, I give no land but an equal share of the rest of my estate with clothes horse & saddle according to the boys,
And Thomas to have his part where the dwelling house stands and William to have that part of land that Thomas was to have and the Crooked fork to be equally divided between my two sons David and John according to quality and quantity and the rest of my movable estate to be equally divided between all my children at the death of my wife or marrage and I do hereby constitute and appoint my loving wife and George Moore Executors of this my last will and testament.
