WILL OF GEORGE PACK OF FREDERICK, CO., MARYLAND
In the name of God, Amen, the eleventh day of September in the year of our Lord One Thousand Seven Hundred and Fifty: I GEORGE PACK of Frederick County in the province of Maryland, Yeoman being very sick and weak of body, but of perfect mind and memory, thanks be given to God therefore. Calling unto mind the mortality of my body and knowing that it is appointed for all men to die do make and ordain this my last will and testament. That is to say principally and first of all, I give and recommend my soul into the hands of God that gave it and for my body, I recommend it to earth to be buried in a Christian-like and decent manner at the discretion of my executor, nothing doubling but that at the general resurrection I shall receive the same again by the mighty power of God and as touching such worldly estate wherewith it hath pleased God to bless mein this life I give, devise and dispose of the same in the following manner and form. Imprimis, It is my will and I do order that in the first place all my just debts and funeral charges be paid and satisfied.

Item, I give and bequeth unto MARGARET, my dearly beloved wife, all the lands I have in the county and province aforementioned laying along the Potomac River, some of which I bought of Robert Brightwell and the Other part I purchased of (?) as may more at large appear reference being had to writings I had of said men. The said land and premises together with the house and all my movable estate I give to my well beloved wife, thatt is during the whole time or days of her widowhood and if she should wed again, then it is my will that the land above mentioned to be equally divided between my son JOHN PACK and my son BENJAMIN PACK and the use and benefit of the same to be for them, namely my son JOHN PACK and my son BENJAMIN PACK be for the help of their bringing up and giving them learning so as to read reasonably well and when they come of age each of them to have their part; my sons above mentioned to them and their heirs forever to their only proper use and behoove. If JOHN PACK should die and BENJAMIN PACK be living it is my will that BENJAMIN shall have his part and if BENJAMIN should die leaving no heirs that JOHN should have his part, if living. Item, it is my will that if my loving wife should be living and a widow when JOHN and BENJAMIN come of age or either of them come of age that they shall take care and maintain their mother for it is my will that she shall have her living out of the above mentioned inheritance as long as she remains my widow and the moveable of my estate when all my debts are paid. I do give and bequeath to my loving wife forever to her disposable pleasure forever and to give to my three daughters MAY, ELLIZABETH and SUSANNAH according as may seem best to her, namely my wife, MARGARET, whom I likewise constitute, make and ordain my only and sole executor of this my last will and testament.

Item, I give and bequeth unto my elder son SAMUEL PACK the seventh part of a tract of land laying in Virginia in Frederick County which I purchased of Andrew Paul; it lays on Sleepy Creek.

Item, my will is that the said tract of land which hath seven hundred forty acres of land, that it be equally divided for quantity and quality as near as can well be done by a surveyor and honest man, chosen by my four eldest sons herein named as followeth; SAMUEL PACK, GEORGE PACK, THOMAS PACK, AND JOSEPH PACK, if all living when divided and if any deceased by the rest living.

Continued furthermore.
When the said land is divided accordingly as above mentioned it is my will that my eldest son SAMUEL PACK have the first choice that is when the tract is divided into seven equal parts as near as a surveyor and another my sons shall choose, can divide it for quantity and quality into seven equal parts to choose one of them to his only proper use and disposal forever to him and his heirs and assigns foever and the other six parts I vive and bequeath forever to my sons herein named as followeth, namely: GEORGE PACK, THOMAS PACK, JOSEPH PACK, JOB PACK, BARTEMUS PACK, and SIMON PACK.

Item, I give the six parts of said, after SAMUEL PACK has chosen his part, to those six sons together mentioned. I give and bequeth in manner and form following,

Item, it is my will taht the surveyor of some other honest man number the said parts of land or give each some particular name to each of them and write theat on six pieces of paper and lottery draw beginning at GEORGE and son on according to birth from GEORGE to SIMON.

Item, I give and bequeath to these six sons their parts of said land and premises to them. thier heirs and assigns forever, which they shall draw.

Item, it is my will that if one or more them dies before they have any heirs that their part shall be disposed of and then the value of it equally divided among all the rest of my children, herein mentioned that shall be living , both sons and daughters herein mentioned. And I do hereby disallow, revoke and disannul all and every other former testament, wills, legacies and executors by me in any wife before this time, named, willed and bequeathed ratifying and confirming this and no other, to be my last will and testament in witness whereof I have hereunto set my hand and seal the day and year above written.

Signed, sealed, published, pronounced and declared by the said GEORGE PACK as his last will and testament in the presence of us the subscribers, James Gilliland, Aaron Reyse, and James Dunn. March 21, 1754 James Dunn and James Gilliland, two of the subscribing witnesses to the within will, being duly and solemnly sworn on the holy Evangels of Almighty God, dispose and say, that they saw the testator, GEORGE PACK, sign the within will and heard him publish and declare the same to be his last will and testament, that at the time of his so doing he was to the best of their apprehension of sound and disposing mind and memory and that they subscribed their respective names as witnesses to the said will in the presence of the said testator, and at his request, and at the same time they saw Aaron Reyse subscribe his name as witness to the within will in the presence and at the request of the said testator.
