"In the name of God, Amen -I David D. Davis of the town of Tampico in the County of Benton in the State of Oregon being of sound mind and memory but in feeble health do therefore make ordain publish and declare this to be my last Will and Testament.That is to say First after all my lawful debts are paid and discharged the residue of my estate real and personal I give bequeath and dispose of as followsTo my beloved wife Sarah A. Davis Ninety Eight acres of land to be taken from the South end of my farm and East of the public highway, with all the improvements and appurtenances situated thereon during the term of her natural life and after her death to be divided equally between my two little daughters Hannah and Mary Jane.To my sons Meshac R. Davis, Thomas W. Davis and William D. Davis all the remainder of my real estate equally between them reserving the portion falling to William D. Davis for the use and benefit of my wife and two little daughters Hannah and Mary Jane until such time as the said William D. Davis shall arrive at legal age.To my daughter Ann Hendricks one brown American mare about ten years old now in the hands of her husband.Tom my daughter Elizabeth Baxter a certain sorrel mare known by the name of Lizzie also one milch cow.To my son-in-law John Winters for the use of my two grand daughters, children of his deceased wife Jane equally the amount which the said JohnWinters is due me which amount is about sixty dollars.To my daughter Hannah one half breed mare and colt in the care of Casewell Hendricks.I give bequeath and devise all the rest residue and remainder of my personal estate to my beloved wife for the use of herself and my children Hannah and Mary Jane and after her death if there should be any remaining to be divided equally between the said Hannah and Mary Jane.In Witness Where of I have here unto subscribed my name and affixed my seal this twentieth day of August in the year of our Lord, One Thousand Eight Hundred Sixty.SIGNEDDavid D. In the County Court of the State of Oregon for Lane County.In the matter of the Estate of Caswell Hendricks, deceased.To the Hon. A. H. Fisk, County Judge for said County:-
Comes now H. A. Hendricks and respectfully shows to said Court and alleges that Caswell Hendricks died in said county on the 18th day of July, 1893, and at the time of his death was a resident and an inhabitant of said county, was of the age of about 74 years and had and owned in his own name in said county an estate consisting of real and personal property of the value of about $1200.That said deceased left no will but died intestate:that the heirs at law and next of kin of said deceased are as follows:H.A. Hendricks, your Petitioner, the late wife and widow of said deceased aged about 65 years; R.A. Hendricks, a son aged 39 years, residence and post office address, Weiser City, Idaho; Martha Finn, a daughter, aged 37 years, residence and post office, Walterville, Oregon; Bell Fortner, a daughter, aged 35 years, residence and post office, Prineville, Oregon; Lena Tucker, a daughter, aged 33 years, residence and post office Thurston, Oregon, G.L. Hendricks, a son, aged 29 years, residence and post office, Thurston, Oregon, Grant Hendricks, a son, aged 26 years, residence and post office, Walterville, OR, Frank Hendricks a son, aged 22 residence and post office Walterville, OR; Aaron Fountain, a grandson of deceased, aged 23 years, post office, Hale in said County; Mrs. Matsie Platt, a grand daughter, married, aged 19 years, Post office Brockport PA.that the said two grand children are the daughter and son of Melissa Fountain, deceased, who was a daughter of said Caswell Hendricks; that your said petitioner lives and resides in said county and is a proper and suitable person to administer upon said estate and that it isnecessary that said court appoint an administrator for said estate and that Frank Hendricks, verifies this petition for your petitioner herein at her request, he knowing all the facts herein stated.
Wherefore your petitioner prays an order of said court appointing her administratrix and that letters may issue to her as such.(signed) H.A. Hendricks, Petitioner
I, Frank Henricks, being first duly sworn, say that I am the son of the petitioner, that I know the contents of the foregoing petition and that all the facts thereis stated are within my personal knownledge and that the same is true as I verily believe I make this verification for the petitioner at her request.(signed) Frank Hendricks.4th day of September, 1895

We find on the estate 1 dwelling house and outbuildings belonging to Grant Hendricks.the house is apparised at $80 and outbuildings appraised at $2.50that there was an agreement between Grant Hendricks and Caswell Hendricks that when Grant should move away that the said Caswell Hendricks should take the said buildings at their now present value or appraised value.
Bond certified and approved and filed to H.A. Hendricks for $2400. Oct. 7, 1895
