'Virginia Soldiers of 1776'
That the said Nelly Mossum married William Cunningham of this county and that she died before said Captain David Mossum, leaving the following children;James,David,William Roe, John and Mary, all of whom except John Cunningham died interstate and without children.
A letter, or memorandum. The claim of bounty land was presented to the Executive about the year 1831, by John Cunningham, who was at that time the sole claimant for the bounty. The certificate of the court shows that he died in 1833. See letter of J. W. Murdaugh, to Executive, 12 April 1833. The claim was presented by Samual Servant. The letter referred to, states that the claimant was a very poor man with an amiable family. I presume the claim was allowed in 1833, and John Cunningham died before the warrant was issued.That said John Cunningham married sometime in the year 1799 to Ann Bennett by whom he had the following children; Mary, Ann, John, Thomas, William R, James, Samuel, Elizabeth, William and Eleanor.

The Court in substitution of a former order heretofore make by this Court on the 29th day of May 1841, concerning the heir-ship of Captain David Mossom officer of the Virginia State Line doth not upon satisfactory evidence produced before said Court certify and make known that the said Captain David Mossom died intestate and unmarried in the County of Elizabeth City leaving the descendants of his sister Nelly his only heirs at law, that she the said Nelly Mossom married one William Roe Cunningham of this County and died before the said Captain David Mossom, leaving the following children: James, David, William Roe, John and Mary. All of whom (except John Cunningham) died intestate and without issue.That – the said John Cunningham married some time in the year 1799 one Ann Bennett by whom he had the following children: Mary (Purkinton), Ann (Cain), John, Thomas, William Roe, James, Samuel, Elizabeth, William and Eleanor.That the said Elizabeth, William and Eleanor died infants and without issue and Samuel died in 1829 above the age of twenty-one years, unmarried, intestate and without issue.That the said John Cunningham also married (after the death of his wife Ann Bennett) one Elizabeth Holsten by whom he had one child named Catherine who was then living and under the age of twenty-one years.That May Purkingten, Ann Cain, John, Thomas, James, William Roe and Catherine are the heirs at law of the said John Cunningham.The Court doth therefore certify that the said Mary Purkington, Thomas Cunningham, James Cunningham three of the heirs aforesaid are now living.That Catherine Cunningham one of the heirs aforesaid has married Marshal Whitehurst and is now living.That William roe Cunningham one of the heirs aforesaid died intestate in September 1859 leaving the following children his heirs at law; William Colbert, Samuel S, James, Wesley and Virginia, all of whom are infants and are now living.Ann Cain one of the heirs aforesaid died intestate in December 1859 leaving two children, George Cain and Virginia Almon her heirs at law both above twenty-one years of ago.That Virginia died in 1862 intestate and unmarried.
That John Cunningham on e of the heirs aforesaid died intestate in December 1860 leaving the following children his heirs at law, Thomas Cunningham above the age of twenty-one years, Mary Elizabeth, Emma Jane, William and John the last four being infants all of whom are now living.
