Notes for HENRY MCGEE, JR.: (This is reprinted from The Hardin County Historical Quarterly from 1986) Silver Mine Henry (McGee) Herbert Perry 2420 Vine St. Savannah, TN. 38372 Thanks to the writers of the United States Constitution and the provision of the Federal Census we have a ladder which extends back in time, each rung ten years apart to the year 1790. The Census has been compared in importance to the human skeleton to which can be added the flesh of American History. When family research is done beyond the year 1790, the lack of the Federal Census is keenly felt. One becomes much more appreciative of the early enumerator kicking his horse along from cabin to cabin, civilization at work in an organized way to get taxpayers names neatly arraigned and on paper. Born before the first census, Henry McGee was a forefather of the McGee’s about which several articles have been written in the Hardin County Historical Quarterlies. (1) In 1896 a group of Henry McGee’s ancestors tried to get themselves declared Indian based on facts about his life and there was sworn testimony even by an elderly few who knew him. The trial effort failed, but remaining generations are blessed (or cursed, as the case may be) with what was said about long dead Henry McGee. Here is the most pertinent page from the trial; Case 97 The United States Court for the Northern District of the Indian Territory - (Georgia) William M. McGee, et. al. VS. The Cherokee Nation Mary B. Hawkins, William M. McGee, Josiah W. McGee, Solon H. McGee, Nancy E. Ward, and Jesse J. McGee of lawful age being duly sworn, each for himself says, that they are respectively Grandsons and Granddaughters of Henry McGee and Mary McGee deceased, and sons and daughter of James G. McGee and Sallie McGee deceased, and further it is through their Grandfather Henry McGee that affiants claim their Indian blood, he being Cherokee Indian as affiants have always been advised by Grandparents, Parent and all who knew them, and traditions of the family corroborate such knowledge, that Henry McGee had but one sister to affiants knowledge named Judy Sellers. The maiden name of Mary McGee affiants Great Grandmother was Ottertail and related as we understand to the Vanns, all of whom, except our Great Grandmother, were members of the Cherokee band of Indians in the old Nation of Georgia. Grandfather Henry McGee was assassinated by one Bill Reed a quarter blood Cherokee, the trouble growing out of a silver mine which Grandfather owned and operated in connection with Dick Rowe and other Cherokee Indians, near the mouth of Coon Creek on Hitower River now in Bartow County, Georgia, between the years A.D. 1812 and A.D. 1820. Affiants Grandmother (a white woman) against the advise of her Cherokee neighbors and through fear left her farm and most of her livestock, with no compensation and went to her Father and brothers in east Tennessee, and soon thereafter married Samuel McKinney, he being a white man, which destroyed her interest and property rights as a Cherokee, she moved to middle Tennessee, Lawrence County, where our Father was bound out until he was supposed to be 21 years of age (there being no reliable record of his birth) after this he married Sallie Davis in 1850, a native of Indiana. Historically, the first silver mine in the U.S. was the “Silver Hill Mine” discovered in 1838, ten miles from Lexington, N.C...(2) Too bad Henry McGee missed the history books. From a Genealogical standpoint the most significant statements to come out of the trial are “Henry McGee had a sister Judith Sellers and his Mother was Ottertail related to the Vanns.” Henry McGee has lots of descendants and differing stories about him have been handed down. Perhaps some unknown descendant or interested party has facts not yet brought to light. The family lore available to this writer states that the Cherokee name for Henry McGee was ‘Tarle Skawee.’ The Eastern dialect, formerly often called the Lower Cherokee dialect, was originally spoken in all towns upon the waters of the Keowee and Tugaloo, head-streams of the Savannah River, in South Carolina and the adjacent portion of Georgia. Its chief peculiarity is a rolling “R”. (3) Other Cherokee dialects do not make use of the rolling “R”. Tarle has the rolling “R” which indicates Henry McGee was of the Lower Town or what is generally called the South Carolinian Cherokee. “Owing to their exposed frontier position, adjoining the white settlements of Carolina, the Cherokee of the Lower Town division were the first to feel the shock of war in the campaigns of 1760 and 1776, with the result that before the close of the Revolution they had been completely extirpated from their original territory and scattered as refugees among the more western towns of the tribe.” (3) Fur trade with the Indian was extremely important business during Colonial times. There is a record of one white trading company loading down 360 pack horses before venturing into the far distant home of the Indian.(4) It was very important that the trader establish allies and alliances among the tribes and was common practice to have one or more wives among the various tribes. Women were equal to men in most ways and it became important to the trader to have a dependable wife to return to each year. (5) In almost any history of the Cherokee it becomes apparent that the leaders of later years were sons of the traders. Just look at the names --- John Ross, David Vann, John and David Ridge, George Lowery, to names only a few. Joseph McGee, born ca. 1738, died shortly after Feb. 9, 1795, when he made and recorded his will in Moore Co., N.C. has the right credentials to be the Father of Henry McGee. (6) Joseph may have married more than once but he first married Mary Childs in 1756. Did you notice that Joseph had a daughter named Judith? The trial document stated that Henry had a sister – Judith Sellers. Judith McGee who married Isaac Sellers was in Moore County, N.C. in 1794, in Gainsville, Georgia in 1842 and in Chatham County, N.C. with son Abram in 1850. (7) If Henry McGee was carried north by Joseph, to escape the rigors to the south or any other reason, Judith may have been a favorite playmate as they were both about the same age. There is name similarity between the children of Henry and the children of Joseph. It is not known where Henry McGee met his white wife, Mary (Polly) Kilburn but North Carolina stands out as a strong possibility. It is believed the Henry above is the Henry McGee of this article, especially since he appears next door to his Father-in-law, Amos Kilburn. In the westward movement of this country, it is often found that family groups migrated together. Of interest in the above list are two William Reeds. The trial sheet says that Henry McGee was killed by “Bill Reed.” Land records have been found that place Henry McGee and Amos Kilburn in Pendleton, South Carolina around 1800. (8) Pendleton was a hold area for those yearning to move westward. Note the known birthplaces of the children of Henry and Mary (Polly) McGee. The time of death, ca 1817 predated the “finding of gold at Dahlonega and the madness of the first gold rush in 1828.”(9) Formerly trusted Cherokee leaders became the worst enemies of the Indian in the Andrew Jackson inspired land negotiations after January 1817. The uncertainty generated by the wholesale giving away of homes and lands created lawlessness among the Cherokee. There was no relief as “American hunger for land remained insatiable” and each new cession whetted more appetite than it satisfied. Before Congress could ratify one treaty, moves were underway for another cession. The general lines for the future of the Cherokee were clear; the Indian was to lose his land and to suffer. (10) The terror of the times enveloped Mary (Polly) McGee and her young brood. Desperately, they hid the mine entrance and made the wilderness trek to Lawrence County, Tennessee where her kin resided and David Crockett held court. Here are some of the Crockett court records as pertaining to Mary (Polly) and her children: Nov. 2, 1818 Ordered that the Sheriff bring at the next term, to-wit; on the first Monday in February next the following orphan children: those of Polly McGee, etc... October Term 1820 Ordered by the court that James McGee, an orphan child of Polly McGee be bound to John McDonald until he arrives at the age of 21 years and said McDonald enters into bond to the chairman of the court with security to the amount of $500.00, with conditions to have him taught to read, write and cypher as far as the rules of three inclusive and learn him how to tan, curry and dress leather and furnish him the said James McGee with holsum (sic) diet and decent apparel during his apprenticeship said McDonald shall give the said McGee two descent suits of clothing. October Term 1820 Sally McGee orphan of Polly McGee bound to James McConnel until 18. October Term (David Crockett docket) John McGee orphan of Polly McGee bound to Archer Nail until 21 to learn Blacksmith trade. April 2, 1821 Ordered by the court that John McDonald to whom a orphan boy by the name of James McGee was bound by an order of this court at some term passed, the said McDonald having removed out of this county, be released from his bond heretofore given for the education and care of said boy and that the said orphan be rebound. (Not in the records) James McGee was bound to Thomas Howard to learn the shoe and boot making business. October Court 1821 Ordered by the court that the securities of Thomas Howard to whom James McGee, an orphan boy was bound to learn the shoe and boot making business, be exempted from their former obligations. April 4, 1822 Ordered by the court that Mary McGee be allowed to keep her two daughters, and the said Mary McGee binds herself to give her daughters a bed and furniture each and school them to read distinctly in the Bible and Testament, who gave bond and security according to the law. July Term 1822 Ordered by the court that Amos Kilburn have James McGee, an orphan boy be bound to him until he arrives at age 21 years and said Kilbourn binds himself to give said orphan 3 months schooling and a horse to be worth $40.00 and a bed to weigh 25 lbs., who gave bond and security accordingly. July Term 1823 Ordered by the court that James M. McConnell be exempted from his obligation that he was bonded in when Sally McGee an orphan girl was bound to him. July Term 1824 Ordered by the court that Joseph Spears be released from his obligation as security for Mrs. McGee appointing her guardian to her children. October Term 1824 Ordered by the court that Hatein Spears be released from his bond as security for the Widow McGee. It is thought that Mary (Polly) McGee married Samuel McKinney and returned to her former South Carolina home as his bride. She may have lived to be 108 years of age and ended up living in Oklahoma with kin. Documentation is needed on her marriage and later life. Truth or legend, the story of the silver mine has remained a hot topic among descendants of Henry McGee and serves as a common interest topic to still draw them together. Part of an old letter from one McGee to another exemplifies this: “Now here is something which may be news to you. Henry McGee had a silver mine which he worked at intervals, not going the same way twice to avoid leaving any trail to his mine. He also had a shop where he melted the ore and coined it into silver dollars. Henry McGee was killed by someone while working in his shop. After his death the family moved to Tennessee where some of the children were let out to other people to raise. My Grandfather, James Giles McGee being one of them. And of course, after he (Henry McGee) was killed, the silver mine was never worked anymore and is to this day a lost mine. However, Nancy McGee, his daughter, tried years after to get my Grandfather, James Giles, to go back and find it. Nancy McGee knew where it was as she had gone with her Father many times to help carry ore back. It was what they call pure block silver. But for some reason they never went back. My Father and three brothers and one sister moved from Missouri in 1890 into the Cherokee Nation (now Oklahoma) and there they tried to establish their Indian rights but were defeated by the lower courts and instead of appealing to the higher courts, they just let it drop. They had proved their Indian blood by a number of old Cherokee Indians who knew Henry McGee in the Indian Territory (now Georgia). And they also knew about the silver mine, but of course, did not know where it was. My Uncle Jess McGee made several (16) trips back to Georgia to try to find the mine but was not successful, but he did find the ruins of the old shop and the cinders from the ore which would pay to work their claim. So now, they are all dead and I suppose it will always remain a lost mine.” James Adair, the Scotch trader who lived among the Cherokee and other Indians during the life of Henry McGee said there was a band of men who mined silver in Georgia, made silver into coins which were traded for slaves in Augusta, Georgia. (11) If you travel to the site of the Henry McGee farm, as this writer has, you will see a lot of very level topography that it must have taken many slaves to clear and till. The remains of the shop can still be located in the winter when the weeds and grasses are low. Far away in the distance are the hills from which the silver may have come. You are overcome by the immensity of the farm, the futility of looking for a hole in the ground that has been covered and hidden since 1816, but very near-by is the Etowah Mound Group which is really worth seeing. There, one of the Nations largest pre-historic Indian Mounds rises to a height of sixty-five feet and covers three acres. The Indian Museum is really excellent. He enrolled on 2 Oct 1863 and was mustered in at Nashville, TN. The 30 April 1864 muster roll has the following remarks: "mustered as a deserter from the 6th Tennessee Cavalry, turned over to this command by order of Maj. Murphy on 15 Feb 1864." Roll for 6 May 1864 stated" returned from 6th Tennessee Cavalry having never been mustered into that regiment." Roll for 23 July 1864: "killed in action at or near Clifton, TN." Final statement: Born in Wayne Co., TN, age 32 years, 5 feet 9 inches tall, dark complexion, black eyes, dark hair, a farmer. It is speculated that he was injured during the "Battle of Shiloh" and died as a result of that injury. He is buried in the Clifton City Cemetery. He is noted as being 32 years, 5 feet 9 inches tall, dark complexion, black eyes and dark hair, and born in Wayne County Tennessee. He entered service at Nashville, Tn. By his service record he was killed at or near Clifton Tennessee by a gunshot wound from the enemy on 23 July 1864 On 3 February 1866 Mary Jane made her first application for a pension number 106,007. Acute indigestion is the diagnosis; she died in less than an hour, so would probably be correct in saying it was a heart attach. She is buried in the Clayton Cemetery with services by Jerry Crews. She was the daughter of Thomas Crews, wife of Dan McGee. Her husband was a soldier and killed during Civil War. Two sons - Joe and Thomas. The Clayton Cemetery she would most likely be buried in (grave is not marked in any of the cemeteries) is called the Clayton/Beeler Cemetery and is also referred to as the Crews/McGee Cemetery also since there members of all three families buried there. Mt.
