Notes for John Sims Hulsey:

Submitted by James Curtis HulseyJr.

John Sims Hulsey was killed in a gun fight on 12-25-1895 and below are the details as they were reported by James Curtis Hulsey of Oklahoma(John Sims Hulsey's great grandson)
As for details about the "gunfight:" at that time there was, and remains, some question as to who was at fault, because there were only two witnesses: John (Jack) Sims Hulsey, and the man who killed him, Fayette Brock. The sheriff's inquisition over the shooting was obviously one sided, and I've never seen nor found any information about the resulting investigation. However I'm not surprised, even today there are areas in far SE Oklahoma and NE Texas--known as "Little Dixie"--where some shootings are considered justified and few questions are asked, or answered -- if you know what I mean?

A number of years ago, when I was looking for information to support my grandfather's research into his father's death, I contacted the Cass Country Historical Society, and they connected me up with some old-time locals in the Bryan's Mill, Texas, area. A few remembered, from their childhood days, some details of that event and the burial of John Sims. One older farm couple were related to Fayette Brock. In the 1890s, there were four Brock brothers living in that area: two of which had "questionable?" reputations--Fayette was one.

There was some question as to what caused the gunfight too. Some say that Brock was making "inappropriate advances" toward John's wife, Ida, while John was away, and that when he returned and learned of the advances, John went to confront Fayette; while others said the problem was over the theft of some hogs by Brock. Whatever the reason, when it came down to the actual conflict, John had to borrow a "Winchester" from another neighbor and went to confront Brock at his home. Brock was carrying a concealed pistol when he was "called out" by John, and in the short ensuing dispute, the easy access and agility of the pistol won out over the bulkiness of the long-gun -- Brock was able to aim around the same large Cottonwood tree that they both shared for cover, while John's gun required him to expose himself in order to take aim. As the story went, John got one shot off, shot the hat off Brock, but Brock's pistol shot hit John in the neck, resulting in the fatal wound.

John's body was laid out at a neighbor's home during the brief investigation, and he was buried that same night. (A historical note: a few years later the State of Texas outlawed all burials at night) According to two oral histories, the night John was buried, it was very stormy. Also, the coffin in which they placed John had to be extended. I suppose that John must have been taller than the average people in the area, or that he was longer than any available coffin at that immediate time?

As for Ida and her children, some neighbor's took them in and then provided her some money so that she could return to her folk's who were living in the Oklahoma Territory. I have never heard if Ida ever told anyone about the events of that day, or what might have lead her husband to be killed. When she remarried, she and her new husband named their first child, a daughter, "Era," because they were "beginning a new era in their lives." (by the way, when Era began school she changed her name to Dorothy)
