William fled to Warfield following the attainder (dishonor and sentencing of death) and execution of his over-lord Bartholomew de Badlesmere. William then assumed the name: le Barker.
Weis' "Ancestral Roots" (54:33), (65:33), (65A:33), calls Bartholomew de Badlesmere
the 1st Lord Badlesmere. States he was hanged at Cantrbury 14 Apr 1322. Was Lord
of Badlesmere and Chilham Castle in Kent. Was Steward of the King's
household, ambassador to France, Savoy, and the Pope. Also mentioned
(79:31).

Bartholomew de Badlesmere in the life time of his father received
command to attend the king at Portsmouth, upon the 1st day of
September, with horse and arms to embark with him for Gascony, and in
the year that he succeeded to his paternal property. He was in the wars
of Scotland. He was afterwards in the retinue of Robert de Clifford (RIN
4304*) in the Welsh wars, and in the first year of KING EDWARD I was
appointed the Governor of the castle of Bristol. In two years afterwards
he was summoned to parliament as Badlesmere, and had a grant from the
king, through the special influence of GILBERT DE CLARE, EARL OF
GLOUCESTER AND HEREFORD (RIN 726) , and Henry de Lacy, Earl of Lincoln
(RIN 2856*), of the castle and manor of Chelham, in Kent, for his own
and his wife's life, which castle had been possessed by Alexander de
Baliol in the right of his wife Isabel, and ought to have been escheated to
the crown on the decease of the said Alexander, by reason of the felony
of John de Straboli, Earl of Athol (Isabel's son and heir), who was hanged.
In the 5th year of King Edward II, Lord Badlesmere was constituted
Governor of the castle of Ledes, and obtained at the same time grants of
divers extensive manors. In the next year but one, he was deputed , with
Otto de Grandison and others, ambassador to the court of Rome, and the
next year, upon the death of Robert de Clifford, he obtained a grant of the
custody of the castle of Skyton in Yorkshire, as of all other castles in
that county and Westmoreland, whereof the said Robert died possessed,
to hold during the minority of Roger de Clifford, his son and heir. He was
further indebted to the crown for numerous charters for fairs throughout
his extensive manors; and he held the high office of steward of the
household for a great number of years; but notwithstanding his thus
basking in the sunshine of royal favor, his allegiance was not
trustworthy, for joining the banner of Thomas, Earl of Lancaster (RIN
2859*), and other discontented nobles of that period, he went into Kent
without the king's permission; where, being well received, he put
himself at the head of some soldiers from his castle at Ledes, and
thence proceeded to Canterbury, with 19 knights, having linen jackets
under their surcoats, all his esquires being in plate armor, and thus
repaired to the shrine of St. Thomas, to the amazement of the good
citizens. While Lord Badlesmere remained at Canterbury, John de
Crumwell and his wife sought his lordship's aid, and , pledging himself
to afford it, he hastened to Oxford, where the barons of his party had
been then assembled. In the meantime the King being apprised of the
baron's proceedings, dispatched the Queen to Ledes, and upon admission
being denied her, the castle was regularly invested by Adomere de
Valence, Earl of Pembroke, and John de Britannia, Earl of Richmond, to
whom it eventually surrendered, when Lord Badlesmere's wife, young
son, and daughters, all falling into the hands of the besiegers, were sent
prisoners to the Tower of London. The baron and his accomplices
afterwards were pursued by Edmund, Earl of Kent (RIN 4229*) , and John
de Warren, Earl of Surrey, and being defeated and taken prisoners at the
battle of Boroughbridge, his lordship was hanged, drawn, and quartered
at Canterbury, and his head set upon a pole at Burgate. At the time of
the baron's execution upwards of ninety lords, knights, and others
concerned in the same insurrection, suffered a similar fate in various
parts of the kingdom.

This land was upon the head of the main branch of the Lower Chippokees Creek. He conveyed this land to his son, John

They are located contiguously on the south side of the James River and north of the Blackwater. (pp 146-149) 4
FLOWERDIEU HUNDRED (Flowerdew Hundred & Flower de Hundred)
Sir George Yeardley, Governor of Virginia, was given a tract of land by the king of the Weyanoke Indians in 1617. Their chief town was at the head of the creek later known as Powell's Creek. In 1618 Yeardley patented 1000 acres on the west side of a creek, which he named Flowerdieu, which was his wife's maiden name.
On 5 Oct 1624 Yeardley sold Flowerdiew to Capt. Abraham Piersey, a leading merchant of virginia and a member of the Council. Piersey died in 1627, leaving two daughters: Elizabeth, who married Capt. Richard STEPHENS and Sir John HARVEY; Mary, who married Capt. Thomas HILL and Thomas BUSHROD.
On 15 Oct 1636 Elizabeth STEPHENS re-patented 1000 acres in Charles City County, called by the name of Flowerdiew Hundred. Soon afterward Elizabeth STEPHENS sold part of this grant to William BARKER.
On 11 May 1639 BARKER acquired 1300 adjacent acres. This became the home of William BARKER and his family.
MARTIN'S BRANDON, POWELBROOKE & MERCHANTS HOPEIn 1617 Capt. John Martin settled on the tract called Martin's Brandon. His grandson, Capt. BARGRAVE, sold it to SADLER, QUINEY, and STURGES in 1634-36.
William BARKER appears to be a part of the acquisition transactions; but I don't know if he owned any of Martin's Brandon. Several thousand acres were added. In 1656 & 1658 SADLER & QUINEY died and left both Martin's Brandon and Merchants Hope to their heirs, who sold the property to Nathaniel HARRISON in 1720.
POWELBROOKE was the land of Capt Nathaniel POWELL, who was killed (along with his wife Joyce, daughter of William TRACY) in the 1622 Indian massacre. When William BARKER and his associates acquired the property, they changed the name to Merchants Hope for Barker's ship.

Notes for JOHN BARKER:
It appears that John Barker and Thomas Busby were among the rebels who took possession of Bacon Castle (Arthur Allen home) during the Bacon Rebellion. John Barker was ordered to pay Arthur Allen damages in connection with the destruction done to Arthur Allen's brick house during the rebellion. Ben Harrison was the arbitrator in the settlement and his decision perhaps resulted in the foreclosure of Martin Brandon plantation owned by John Barker (senior).
Bacon Castle derives its name from Nathaniel Bacon, who was in 1676 led a rebellion agains the rule of Col. Governor William Berkley. Bacon's forces burned Jamestown in Sept. 1676 and set up a strong hold in Surry County. They took over Arthur Allen's house and occupied it for four months. Allen, a supporter, of the colonial governor, later sued the men who had occupied the house for the damages incurred.
(Surry p. 83, bk 2, by Boddie): Barker and Busby were fined along with 27 others for not attending church services of the established Church of England.
On October 5, 1657, John Barker of Surry patented (deeded) 600 A on Upper Chippokes Creek.
John's will was written 9 Oct. 1713 Surry Co., VA, probated 19 May 1714 (Surry Co. Wills, book 6, page 191): Willed to: Children: Elizabeth Andrews, Sarah Lanier, Hannah Lashley, Robert Foster (child of wife and first husband) John Barker, Joshua Barker, Grace Barker. Grandchildren: John Barker, Grace Foster, Christopher and Robert Foster (Foster children are not of age.) Others mentioned: Abraham Evans, Thomas Hunt, Robert Hunt, Richard Barker, Capt. Clemens, John Barker, Thomas Cotton.
Wife Grace was executrix of will. Will witnessed by Thomas Cotton, John Johnson and Elizabeth Figures.

In 1662, he added 1800 acres to the family property at the head of Chippokee Creek, VA.

On 6/16/1721 John and his wife Mary of Southwark Parish sold Thomas Peters 223 acres on cabin branch, adjacent to William Hunt. Witnesses: Benjamin Chap Donaldson, John Mitchel and Gerald Green (bk 8, p. 367)
John's will was dated 21 May 1725 in Surry Co., VA, and prbated 21 April 1742. He willed his son John, land between Reedy Branch and Cattail Swamp; to son Christopher - land that parts my father's and me to one cattail branch; daughter Mary was mentioned; other estate was divided between wife Mary and five other children not mentioned by name. Notes for SHADRACK BARKER:
Wake Co. was formed in 1771 from Orange, Cumberland and Johnston Counties, NC. From land deeds and court records, Dianne Spitzer, determined that Shadrack's land was mostly on the White Oak Creek that is near the southwest border of Wake Co., and was located in Orange Co., NC, in 1770. She found a few Orange Co. records at the library there and was able to determine that our Barker family was indeed there.
Jack Cole's guess is that Shadrack's father was William, who had the joining land. Brian has said his research shows that William was the father of Shadrack.
Shadrick Barker was in Rowan Co., NC, in 1768.
Court file papers show that Shadrack was a property owner Oct. 21, 1778. This would indicate he was at least 21 years of age by that date.
Wake Co. Minute Book for the Court of Pleas and Quarter Sessions (WCMB), 539-372, June-Sept. 1798, lists Shadrack Barker for road world. The WCMB for Aug. 1802, 226-212 estate papers returned to court. Conclusion, he died around 1798. His estate was not settled until 1826 because minor children had to mature, and then there was a delay by his widow, Naomi, and the administrator Andrew Peddy.
Brian Aldridge had his death date as 1792. Shadrack's estate records, per Dianne Spitzer, began on April 13,1799, Shadrack's estate was published. His children were listed as Edmund, Rebecca, Thomas, Edith, Sally, Polly, Milly and Warren. Neomi (Naomi) is sometimes called Omy and Omie. On 5/6/1800, there was an estate sale. In Aug. 1803, there was an estate accounting. In 1805, there was a division of land. There were 824 acres divided among: Thomas Barker, Solomon Segraves in right of his wife Sally; Edmund Barker, Warner (Warren) Barker; Polly Barker; Mylah Barker; Edith Barker; and Anthony Pilkington in right of his wife Rebecca. On Aug. 1806, there was an audit. Anthony Pilkington, dec'd (deceased) received an advancement from the estate. Neomi as administrator paid for schooling and subsistence for Sally, Polly, Milly and Warren. These records don't show an Elizabeth (who married William Crye) and listed her father as Shadrack Barker at the time of her marriage.
Someone placed a file with LDS Library that there was a Shadrack Barker born in 1766 in Wake Co., NC had a daughter Edith Barker who was born in 1792 in Wake Co., NC. This Edith died 2/20/1860. She married Augustine Jones b. 2/1/1781 in Wake Co., NC and died 3/20/1861. Their children were Alvin Jones, Elizabeth Ann Jones, Ethel Mildred Benton Jones, Jefferson John Quincy Jones, and Rebecca Jones. If this Edith is the daughter of Shadrack, she had to have had two marriages: 1) Jones and then to 2) Ezkiel Greenberry Herren. Note that when Shadrack's land was divided among his heirs on Sept. 25, 1805, Edith was listed as Edith Barker and was obviously a single woman. When the estate was fully settled in 1825, Edith was married to Berry Herrin. There is no mention of Jones in any of the settlement papers.
Maxine Kuhn interprets the following document to be one where some of minor children had matured, married and moved to a distant location and were anxious for the estate to be settled and receive their shares. It is not a settlement among heirs, nor does it list the complete line of heirs as some have claimed. "To the Worshipful Court of Wake. The petition of Solomon Segraves and Sally his wife. Anthony Pilkinton and Rebeckah his wife, Thomas Barker, Polly Barker and behalf by her nxt friend Solomon Segraves, and Miley Barker an behalf by her next friend Anthony Pilkinton, humbly herewith that Shadrack died intestate about the year 1798 leaving petitioners Sally, Rebeckah, Thomas, Polly, Miley and Edith (whom your petitions are informed, has removed to a distant and there married) his only children leaving at the same time a widow Neomi who is still alive and with Andrew Peddy hath obtained administration upon the estate of intestate more than two years ago, that the personal estate sold by the admins. and the proceeds now ready to be delivered over to those entitled, that your petitioner Anthony and wife have received an advancement whereby they were willing to account for. Your petitioners pray that the same may be divided amongst the said representatives and that your worships will grant a fit remedy for that purpose. S. S. On December Five 1806, this distribution of property as was recorded in Book II (note the document has II II with lines through each set of II) and page 107 on the 8th of April AD 1806 gave a widow dower of 400 acres. (end)
On September 25, 1805 this document was submitted: The platt doth represent the land of Shadrack Barker dec'd out of which we in obedience to an order of the court of Wake August session after being duly qualified have proceed to take the widow's dower, to wit, the division where the letter A stands. Beginning at a sweet gum on White Oak Creek Mark Barker's corner thence south 238 pole to a pine thence east 213 pole to a hickory, then north 42 pole to a post. Oak ? east 76 pole to a pine then north 194 pole to a pine then to the beginning containing 400 acres all which with the buildings and improvements thereon we do apportion and lay off to Omy (Naomi) Barker widow and Relect of Shadrach Barker dec'd as her thirds in real estatate of her dec'd husband."
Based on the widow's dower (400 acres) being 1/3 of the estate, Shadrack owned 1200 acres that was divided among his children or sold.
On September 25, 1805, these children of Shadrack: Warren Barker (100 acres), Polly Barker (131 acres), Mylah Barker ($36), Edith Barker ($17.50), Anthony Pilkinton in right of his wife Rebeckah (125 acres and $7.75), Thomas Barker (75 acres and $7.75), Solomon Segraves in right of his wife Salley (50 acres and $23.50) and to Edmund Barker (75 acres and $48). Therefore, the heirs are: Warren, Polly, Mylah (Milly), Edith, Rebecca, Thomas, Sally and Edmund. Note that no heir by the name of Elizabeth is mentioned!
Another document dated for the quarter of September-November in 1825 in the State of North Caroline and Wake Co. read: "The the worshipful, the petitoners of the said Court. The petition of Warren Barker, William Crisp (looks like Crop), and Milly his wife, and Anthony Pilkington, Rebeckah his wife. (continued next pargraph)
Respectfully showeth that Shadrack Barker late of Wake County died some time in the year ____ (not given - space left for year) intestate without will having Naomi Barker his widow the following children: Edmund Barker, Rebeckah married to said Anthony Pilkington, Thomas Barker, Edy married to Berry Herring, Sally married to Solomon Segraves, Polly married to John Segraves, Milly married to petitioner William Crisp (Crop), Warren Barker, your petition, that at the session in the year ___ (again left blank with a space for the year) of this worshipful court administration of the estate of said intestate may granted to Andrew Peddy and said Naomi the widow who hereby undertook the management of said estate. Your petitioners show that the said intestate due possessed of a very considerable personal estate, having debts to a large amount due him, the whole of which came to the hands of the said administrators, who sold the said personal property, and have long since made payment thereof. Your petitioners have been informed and are willing to admit the fact so to be that the said Admin. have paid over to each one of the other children? of said intestate, except themselves the part of the estate of said intestate to which they were respectfully entitled, and have taken part thereof. And they alledge (allege) that although frequent application has been made by them to the said admin. for a settlement of said estate that they should payover to your petitions through their respective shares, said applications under pretence or another have been refused and your petitioners, are consequently forced to appeal to the court for relief. Edmund appears in the 1820 Haywood Co., NC, federal census with these entries for household #214: 3/1/0/0/1/0 for males; 1/2/1/1/0/ for females. The head of the household was engaged in agriculture (a farmer). Edmund was 80 years old and living with Brantley Barker and family in 1850 in Macon Co., NC, federal census. Brantley's birthplace was Wake Co., his death is listed in mortality schedule for Macon Co., 1850.
Edman (Edmund) Barker occupied Section 22, District 1, of the Cherokee Survey Books in 1820. He claimed land where the Cherokee Indians had been forced to leave and give up. The following is from the web site http://www.teresita.com/lovebg.htlm. "On 2/27/1819, chiefs of the Cherokee Nation signed a treaty ceding a portion of their remaining eastern lands. The new North Carolina territory stretched from the former treaty line (the old Meigs-Freeman line) the the ridge of the Nantahala Mountains, and from the Georgia and South Carolina borders on the south to the Tennessee line on the north. The State of NC appointed James Meabin and Jesse Franklin as Commissioners in charge of organizing the large territory. Commissioners Creek in southern Macon county was named for them. They hired Captain Robert Love of Waynesville to head the survey party. The work began with the division of the huge area into 18 districts. Each was assigned to one of five or six survey crews for mapping. The districts were further divided into tracts or sections, which were offered to the public through land grants. Each section offered for sale contained 50 to 300 acres. Each included some good farm land and timber land. The survey party produced a huge map, one copy of which was posted in the Haywood County courthouse prior to the first land sale. The sale began on September 20, 1820 and continued for several weeks. Other sales were held in Franklin in 1822 and 1823. The survey party chose the site of Franklin, which was destined to become a county seat. The town site occupied 400 acres in sections 24 and 32 of district 16. It was named for Commission Jesse Franklin, a prominent statesman who became governor of NC in 1820. Because demand was high, prices were set to bring in a good profit. No land could be sold for less than 50 cents per acre. Grade 1 land, the best, sold for $4 per acre; grade 2 for $2, and grade 3 for $1. Buyers could pay 1/8 down and the rest in four annual payments, with a discount offered for early payment. Grants were to be issued after the state received the full purchase price. When the surveyors conducted their field work in May and June of 1820, they found some settlers already in residence and some Cherokee Indians still living on the land. The 1817/1819 treaty allowed Cherokees who wished to remain in the territory to become citizens of NC and claim 640-acre reservation around their home sites. However, the survey party ignored the reservations and divided them into tracts for sale as land grants!!!! The Citizen Cherokees were effectively dispossessed. They eventually won compensation for their losses from the State of NC. One of them who fought vigorously for their claims was Gideon Morris, who appears on the survey as resident of Section 32, District 11, "on the Nucasser Plains." This tract was part of the reservations to which Morris was entitled in right of his wife Naka or Rebecca, the daughter of Yonaguska. The Morrises lost their reservation to Gen. Thomas Love, father of Capt. Robert Love. According to a later account by Thomas Siler (son of pioneer Jacob Siler), the early settlers had an agreement not to bid against each other in the land sale. Owning an improvement entitled the purchaser to an option on the place at 25 cents per acre, which gave an incentive to these early settlers. some bought existing improvements from the resident Cherokees, others cleared a field or erected a building on their claim. The Survey notes hold clues to the early settlers of old Macon Co. Some were white men who had married Cherokee women and lived in the territory for an unknown period. A few white families may also have lived in the Cherokee Nation long before the cession. Others, like William Brittain and Jacob Siler, came in 1817, under the impression that the treaty was already settled. Though some Macon Co. pioneers moved on to new lands opening in the west, others put down deep roots here. Their descendants played important roles in the development of the region."
An Edmund Barker was listed as being in the Georgia Cherokee Land Lottery in 1838; Fifth District, Third Section, Cherokee, Residence 656th, Troup County. The land was granted previous to the first day of January, 1838 as number 205.
According to Superior Court of Law, October Term, AD 1832, "The jurors for the State upon their oaths present that Edmund Barker, Calvin Barker, and Warren Barker, all late of said County, on the 8th day of October 1832 with force and arms in the County aforesaid an assault did make upon the body of Solomon Millsaps, did make an assault, and him the said Solomon Millsaps did then and there would, beat and ill treat against the Peace and Dignity of the State. /s/ J. Roberts, So. pro tem (likely Solicitor pro tem). There were some additional papers and all referred to Edmund, Calvin and Warren as "planter," which indicted they owned land. In Millsaps statement posting money for his appearance read, "The condition of the above is such that if Millsaps does appear then and there to give evidence in behalf of the state against Edmon Barker and sons and not depart...." This proves that Edmund Barker was the father of Warren and Calvin.
Edmond transferred 990 acres of land on the waters of Great White Oak Creek in Wake Co., NC, on 3/10/1806 in Wake Co., NC to Lewis Barker. The land that Edmond transferred was the former property of Shadrick Barker, deceased, who was the father of Edmond. Edmond again transferred land in the Nov. Term, 1819 (1/11/1820) to Freeman Broadwell in Wake Co., NC. This may be when he moved to Haywood Co., NC. He is listed in the Haywood census in the next census of 1830 and in Macon County census in 1840. The 1850 census has his children being born in Haywood.
Polly Jones married our Edmond Barker. There was a Solomon Jones who witnessed the will of the other Edmund Barker on 2/2/1815. That Edmund could not sign his name. Our Edmund signed his name on previous land deeds. Solomon Jones likely was related to our Polly. In that will of the other Edmund had these children: Laban Barker, Hosea Barker, Lydia Barker Shaw, Priscilla and her children Briggs, Sterling and Hosea; Edmunds Barker (got 200 acres), Asa Barker, Prenissee Barker, and son Abner Barker (deceased) children: John, Willis, Salley, Allen and Polley. It is obvious that all of the Barkers in Wake County were related but how, we are unsure.
Barkers have long been noted for being constables. Edmund signed the bond in Wake Co., NC, Court of Pleas and Quarter Sessions for Labourn Barker to be appointed constable.

Diane Jenkins Spitzer found a reference in the Heritage Book (Swain or Macon) that Eli Barker of Barker's Creek was her father. She was mentioned in Warren Shadrack's will as his daughter.
Someone posted with the LDS Library that Edith Barker daughter of Shadrack married Augustine Jones in 1813, and he was b. 2/1/17861 in Wake Co., NC, and died 3/20/1861, buried in Middle Creek Township in Wake Co., NC. They listed this Edith as being born in 1792 in Wake Co., died 2/20/1860. They had these children Alvin b. 4/14/1814 d. 8/29/1860; Elizabeth Ann b. 5/23/1815, d. 4/9/1906; Etheldred Benton Jones b. Abt. 1818; Jefferson John Quincy Jones b. Abt. 1820, Rebecca b. 3/18/1822 and died 8/6/1890. Alvin was buried in the Family Cemetery in Wake Co. All were born in Wake Co., NC.
Shadrach's will states she was his daughter and married to Berry Herren. "The Old Buncombe County Heritage Books" and other references state that Eli Barker of Barker's Creek was the father of Edith (Edy, Edie) Barker Herren, wife of Berry Herren. Maxine Barker Kuhn is more inclined to believe the estate records of Shadrach stating Edith was his daughter and married to Berry Herren.

Check out a Shaderick Barker in Hillsborough district of Wake Co., NC, in NC Fed. Census. In the household was 1 male 16 yrs+, 2 males under 16, and 5 females. Edmond was in the same census as 2/3/4/0/6.
Bryan Aldridge (baldri3728@aol.com) said Shadrack died in Wake Co. in the 1790s - could that Shadrack be the father of Shadrack? Got to check to be sure our Shadrack was Warren Shadrack. Henry, Jr. thinks his name was Warren Shadrack and he went by Shadrack and his son by Warren.
Maxine Barker Kuhn is unsure if this is where our Warren fits into the tree. It may be that Edmond (Edmond), or Thomas could be our ancestor instead. It is known that Warren and Jason were brothers.
There was a Warren Barker in the census records in 1830 in Burke Co., NC. This could be the son of Shadrack, or some relation.
Information on dates for this Warren Barker came from Roy Barker. Sarah Gunter had this Warren dying at the age of 102. Roy's information is likely correct and explains our Barkers being in Texas.
Warren of Buncombe Co., NC, sold land which was his part of the dower of the widow Shadrack Barker, to Alsey Hunter of Wake Co. Warren Barker signed the deed 1/20/1819. The deed was recorded 4/12/1820. Wake Co. Deed Book 3, page 338. Warren also sold land to Alsey Hunter of Wake Co., signed deed 1/20/1819. Deed was recorded 4/27/1827. Wake Co. Deed Book 7, page 413.
Warren sold land to Berry Herrin, both of Buncombe Co., NC. "This indenture made and concluded this first of Sept. of the year of our Lord one thousand eight hundred and twenty (1820). It was registered 4/30/1840, Buncombe Co. Deed Book 22, page 89.
Note the compiler has photocopies of these deeds. If the registration of this last deed had not been delayed, it too would have been burned in the courthouse fire. We are fortunate. Berry Herrin was the husband of Edith Barker, who was the sister of Warren.
The 1830 US Census for Burke Co., NC, listed Warren Barker's family as 1 male 30-40, 1 female 30-40, 3 females under 5, 1 female 5-10.
Warren and Margaret Barker wrote a letter 9/7/1837 in Kentucky. He states they left North Carolina October 5, 1830.
In the 1860 US Census, Yell Co., ARK, Reel 1263, Pt. 7 reads: Barker, Warren husband 52, Margaret Wife 55, William Henderson Son 17.

9/26/1999. Tim Barker wrote "Here is a little history on Warren as far as I know. He obtained many land grants from the State of NC and did quite a lot of work on the Webster Courthouse. He was a rock mason and a carpenter.
Marriage records in Jackson and Haywood Counties listed that a marriage was held at the home of W. S. Barker (Warren Shadrack). Henry Barker, born 1904, said that Warren's name was Warren Shadrack and that his Warren's father had been Shadrack.
Warren was rumored to have been a sheriff in Jackson Co., but Maxine Barker Kuhn found evidence in 1998 that Warren was actually a court constable from mid-1856 through 1860 at Webster, NC.
Tim and Henry Barker, Jr., found evidence in Nov., 1999, that Warren was a constable in Jackson Co. ----
Warren was appointed constable of Jackson Co. on 3/16/1858, evidence Book 3, Page 162, Year 1860, State of NC to Warren Barker a "Bond" reads as follows:
State of North Carolina, Jackson County,
Know all men by these presents that all W. Barker, F. (?) Allison, W. H. Higdon, J. F. Parks, J. B. Allison, and J. Keener are held and firmly bound unto the State of North Carolina in the sum of four thousand dollars for which payment well and truly to be made and done we bind ourselves,our heirs, administrators. Given under our hands and seals this 16th day of March AD 1858. The conditions of the above obligations is such that whereas the above bounder W. Barker is the day of the date appointed to act as constable for the county aforesaid. Now if the said W. Barker shall well and truly execute his office agreeably to the law and will diligently endeavor to collect all claims put into his hands for collection and faithfully pay over all sums thereon receive either with or without suit unto the person or persons entitled to receive the same, the the obligation to be void otherwise to remain in full force and virtue.

There were bonds about 2" thick. Warren was scattered through many of them. They are located in the basement of the old jail behind the old courthouse in Jackson Co., NC.
There is a court document where Warren Barker, Hittie (Hettie) Martin, Bud (Warren Barker's son, Warren), and Ira Barker were to defend themselves again larceny and receiving. Must check out this suit and find the results.
In an article "Knowing Jackson... Whipping Posts, Stocks" by J. D. McRorie noted that Jackson County had a whipping post and stocks for about 12 years (1856-1868). NC repealed corporal punishment in all forms and limited the death penalty to four crimes - arson, murder, rape and burglary and further limited other types of punishment to imprisonment with or without hard labor, fines, removal of office." According to Jackson County's first sheriff Edd Douglas Davis, an old man by the name of Warren Barker did the lashing. Note the "old man" portion of that statement. Our Warren was born about 1814. He would have been 42 when lashing began and 54 when it ended. He would have hardly been an "old man." We thought that perhaps it was Shadrack's son Warren born abt. 1792 but Warren was not in NC at that time. It could be that 42-54 years of age was considered "old" when life expectancy was lower than it is in the late 1900s. According to the article, while Warren did the lashing, the sheriff made sure that Warren was not hitting the prisoners "too hard." Yet, Sheriff Davis pointed out that, yet, in spite of that, the licks often brought the blood. Keep in mind that Warren was a constable and this could have been his duty as constable.
Notes for EDITH (EDA) LUCINDA ELLEDGE:
In the 1860 census, Mr. Humphrey P. Brooks was no longer in the home. Edith said he died. It was rumored that Humphrey went off to the Civil War and never returned. However, the Civil War did not start until April 12, 1861 and Edith listed Brooks as deceased in 1860. Edith also bore a child by Warren Barker in 1861. There can be no records found of Humphrey Brooks serving in either the Confederate or Union forces. Humphrey Posey Brooks shows up late in a census report in AR married to a Sarah Settles and having a family with her.
In the 1870 census, Edith and her four children: Emily (Emiline), 13, Zeb. V., 12, Mary M. 8; and W. Grant, 4, were living with Esther E. Martin as head of the household and three of her children Sarah J. 9; A. Sherman, 5, and M.A.M. 5/12 (Marthan Ann Hasseltine). John Martin wasn't listed but Hettie hasn't yet had her last child Warren A. L. (Lush).
Floyd Parrish wrote that In 1860 census, Edith lived on the Hannah Cabe and husband's (Warren Barker) land.
Her death certificate listed her name as Eda Lucinda Brooks (not Barker). The Riverside Methodist Church in Macon Co., NC, listed her as the spouse of Warren Barker in recording her death. In the 1860 census, Edith was listed as head of her household. Swain Co. Heritage had Edith's birth date differently than the Riverside Methodist Church Cemetery. Cemetery had she was born 6/22/1838 and died 9/3/1919 vs. 6/25/1838 bd and 7/23/1919 dd. Cemetery records record her name as Edith Brooks (1st husband's surname) Barker. Her death certificate listed her name as Eda Lucinda Brooks.
Edith's children by Brooks were often referred to as Barker.
Edith married Humprhey P. Brooks using the name as Edith L. Ellige...not Ellege or Elledge.
Henry and James Barker (grandchildren of Edith) said that Edith was a Herrin and 1/4 Cherokee Indian.
In checking the census reports, Millie Elledge (Edith's mom) would have been 49 when Edith was born. There was a daughter of William and Millie Henson Elledge that could have possibly given birth to Edith. There was a Berry Herrin family that were neighbors of the Elledges. Maxine Kuhn heard her father Henry Barker (grandson of Edith) refer to an Ole Berry Herrin. Berry Herrin's wife was Edith Barker Herrin. It is interesting that Edith Elledge was named Edith also (possibly in honor of her natural grandmother??). Edith had a brother James who married a full Cherokee Indian by the name of Jane. In looking at Elledge family pictures, there appears to be no Indian features in that line. If Edith Elledge was truly a Herrin, then it is very likely she was part Cherokee Indian. There are many Herrins and Herrons on the Cherokee Dawes Roster. NOTE ALSO that Edith was born in 1838 which is the year the Cherokee Indians were forced from their western NC land. Could her parents have been forced to leave and she was taken in by the Elledges????

Cabe was shortened from McCabe.
Sarah Gunter's notes from Floyd Parris indicated Hannah died in 1855. However, Hannah appeared on the census reports until she was at least 65 years of age. Tim Barker found Hannah's estate was to be administered by E. H. Cagle on 5/14/1887. Joseph Green was granted a deed for 50 acres for $150 on February 20, 1888 (Book 12, page 296, 1890 (year)), Jackson Co. Courthouse, NC.
H. K. Jones transferred 100 acres of land to Hannah Barker in 1869 when Jackson Co. was still part of Macon Co., NC.

Warren Avery Barker told his grandson Roy Barker that the family kept looking down the road to see if Shade was coming but he never returned from the Civil War.

Mary and Eliza were sisters living together in 1870. Mary was 37, Eliza 39, and John Manley Barker was 18 and a farm laborer. Mary was "keeping house" and Eliza had no occupation.

Tim and Henry Barker, Jr., found a bond where Warren granted 50 acres of land for $50 to Mary; Book 21, Page 418, Year 1896. In Book 29, Page 213, Year 1902, this became Mary's land. land was also granted to her brother Zebulon Vance Brooks.
Mag died early in March of 1932. Her funeral was "preached" by Ed Brooks (Mathew's father). It was a cold and rainy day. Ed got pneumonia and died two weeks later.

Notes for WILLIAM GRANT (BROOKS) BARKER:
Born and married as Brooks instead of Barker. Some members felt he was born in 1864, but his tombstone gave date as 1865. His marriage license reflected he was 21 in 1886 so he would have been born in 1865. The Franklin Press referred to William as William Grant Barker in several articles over the years which were published. Henry (son of William) said that William was named for an ancestor of Warren's and that Waren gave William his last name of Barker. Warren openly acknowledged William as his son and appeared to love him dearly. When William Grant Barker remarried in 1907, he used the name of William Grant Barker - not Brooks, reflecting he had officially assumed the Barker name by 1907.
Witnesses to William's and Mary Frances' marriage were I. B. (Ira B.) Barker (his half-brother) and Ira Frady. They were married in the home of Sarah Frady in Jackson Co., NC.
Warren Barker deeded property to Mary M. Brooks and William G. Brooks for $50 in his hand before his death. Dianne Spitzer found records that Warren's children by Hannah, his son by Edith, and Edith's children were given equal shares of Warren's property before his death for $10 per deed transfer.
William's death certificate indicated his surviving wife was Rosa Barker. Her name was Elzie Barker. The death certificate listed him as a farmer. Farming was only a small part of William's many interests, trades, and professions. He was a Justice of Peace in Macon Co., NC, and expert carpenter, an undertaker, casket maker, dentist and lastly a farmer. The death certificate also listed his mother as Edith Etiz - she was Edith Ellege. Riverside Methodist Cemetery recorded his death date as 7/25/1938, while his death certificate listed 7/27/1938. His tombstone reads, "Gone but not forgotten."
William's younger son, Henry, lived in Bayboro, NC, in 1938, about 450 miles from William. At noon one day in 1938, Henry came in for lunch, told his wife Bessie that he dreamed his dad had died and had wanted to see him, he instructed Bessie to have the children (4 of their own and two they were rearing) ready to go to the mountains by 3 p.m. that day. Bessie said she was a little peeved for there were no such things as washing machines and clothes dryers, but being a dutifully wife, she was ready at 3 p.m. They drove all night, arriving about 10 a.m. the next day at William's home. William came out of the house, shook hands with my father, who was still in the car, knelt down and thanked God for sending his baby to see him before he died. That very evening, he asked Bessie (wife of Henry) to have milk and cornbread with him as his last meal. Bessie said that by now she felt Henry and William were nuts for William appeared healthy and my father was listening to Will's desires - like making sure Elzie, his soon-to-be widow, would have a place to stay after he died, etc. The following morning, Will went out to the wood pile, picked up the axe and cut a few pieces of wood, he put down the axe, stumbled to the back door steps, and where he collapsed from a stroke. The death report said a doctor was not present at this death, but Henry Barker and his wife Bessie were present and always said that a doctor was summoned, the doctor turned Will over during the examination and Will died after being turned onto his back. God obviously did answer Will's prayers by sending his baby son to him one last time. Henry followed his father's wishes, for Henry was to inherit the home place. He signed the estate over to this step-mother Elzie.
William went by Grant Barker.

She had been married to a Garrett and had two sons: Daniel and Vincent. Daniel was killed during the war. Vincent was jailer in Franklin, NC, for a number of years. Sarah Gunter Davis had Elsie's birth date as 2/19/1901. Henry Barker (distant cousin of Elsie and step-son of Elsie) said Elsie's name was Elzie. Family members called her Elzie, but records list her name as Elsie and Elzie. Henry and Bessie Davis Barker had named their daughter Elsie Bedell Barker as Elzie Bedell Barker but the doctor recorded her name as Elsie and the parents never changed the birth certificate.
Elzie's name was listed as Elzie Clark with the Social Security Administration.

John Manley Barker was the son of Mary E. Barker and William Parton. Eliza Barker helped her sister Mary E. Barker raised John Manley Barker. When he was about 21 years of age, he married Modene Barker on 12/5/1871. John and his wife Modene were first cousins. Together, they raised a family of six children. There was a time lapse of almost nine years before Harve was born and then 2 years later Amanda arrived. According to her daughter Amanda, Modene was a strong-willed wife who had no patience for infidelity. Her husband was well aware of her values. Once a young lady set her eyes on John, and Modene let John know she'd not tolerate no indiscretions, using legal resources as necessary. John and Modene had a long and successful marriage.
John was talented in cutting out suits and clothes to be sewn. He was a property owner on Alarka, NC. He raised hogs, marked them, and the hogs themselves mostly because they had free range in the mountains. Hogs helped feed the family.

Notes for IRA BAXTON BARKER:
Called gingerbread man because he sold gingerbread on the streets in Franklin, NC. According to Tim Barker, Ira sold gingerbread and apples to the people who would gather for court sessions at the Webster Courthouse. The courthouse burned in 1913. Ira was also a "yarb doctor" - meaning a person who had home remedies made from natural herbs and plants of the area. Some of them must have worked because most of the older Barker family members lived well into their 80s. All of them were farmers, rock masons, lumbermen, and generally the kind you would expect in the rural areas of their times.
9/26/1999 Tim Barker, descendant of Ira's, listed Ira's children as Garland, Otiela, Lear, Mitchell, Hannah, Wilburn and Asbury. Tim was 38 in 1999. His wife is Rose. Tim is a sign maker for the NCDOT. They have two daughters - Timara Amanda 15, and Angela Rose 11, who are very studious young ladies. They live on just a little of the old land Ira had years ago. Excerpt below is from Roaming the Mountains - Gone are the days of the gingerbread man, everybody's friend - by John Parris. Items in brackets are for clarification and for those who may be unfamiliar with the colloquialisms of Western NC.
We knew him (Ira Barker) as the gingerbread man. He might have been a character straight out of Dickens.
He was a little man with a gargoyle face, and has spoke with an Elizabethan flavor and dressed like Cockney.
He was a peddler of sorts, a hawker of apples and gingerbread.
He was also a collector of herbs and an herb doctor.
He was the Sage of Little Savannah.
Folks quoted him as faithfully as the Bible and the almanac.
His name was Ira Barker, and for 75 years he never missed a session of Superior Court in Jackson County (NC).
He was a friend of judges and lawyers.
He knew everybody and everybody knew him.
"I've never made the acquaintance of a stranger," he once said. "Everybody is my friend. Which makes me richer than the feller with a countin' house full of gold."
He had a way with children, and with birds. Children and birds were put on the earth by the Good Lord to make people happy," he said. "show me a feller who don't like children and I'll show you a man with a mean streak."
His mind was as sharp as a meat-ax, and he could expound on any subject under the sun.
"If a man knows his Bible," he said, "he can hold his own in any company. I've read the Good Book out night (almost/about) a thousand times, I reckon. That's from cover to cover.
He had the uncanny knack of sizing up a trial jury and a witness in the wink of an eye. "Set twelve men in the jury box and give me a good look at their eyes and the tilt of their chins," he said, "and I'll tell you what they'll do when they come to vote."
Ira attended the first term of court at the age of five. "My pa took me and had to hold me on his knee," he once recalled. "And I've been goin' ever since. Court-time is a time to see your friends and make new ones. And a feller can get an education listening to the lawyers and the judges.
He became a rambling vendor when he was eleven years old. "Found out folks have a hankerin' (desire) to buy things at a court session they wouldn't buy no time else. So I started bringin' a sack of apples to court and sellin' 'em. Then my ma let me take some gingerbread. By the time I got married I had a good trade. Then my wife got to makin' gingerbread. My ma learned her."
If Ira had a man with a Midas complex, he could have become the gingerbread king.
"I've never been greedy in all my life," he said shortly before his 80th birthday. If I had, I'd be rich instead of bein' as poor as Job's turkey. I've never knowingly beat a man. That's why my bed is soft and why I've always slept good.
There were some who bruited (reported) it about that Ira had weakness for the jug. "I've been takin' my toddy off and on for nigh 60 years now," he once admitted. "And I can't see it ever hurt me. "Course, a body can kill their selves (themselves) if they drink enough." "You know, I tell 'em, just take it easy-like and don't try to guzzle it like you're in a hurry to lay down in a pine box (casket). Folks have been makin' toxicants since time began and they'll go right on makin' 'em long's there's a feller that can lift a jug and open his mouth. "A feller's a plumb (complete) fool to go to the well and stay. Like the Good Book says, a body can make a sin of anything. Any time a body gets hisself (himself) full up to his neck, be it eatin' or drinkin', he's sinnin', and that's a true fact."
I remember the last time I saw Ira. It was an autumn Saturday 58 years ago (must check the date of this publication to find out when 58 years ago would be. It had to be early in the 1930s depression), and Ira was standing on a street corner, a sack of apples across his shoulder, a basket of gingerbread at his feet. "Apples! Apples!" he hawked. "The finest fruit on the green footstool of creation. Two for five cents."
Somebody stopped to talk with Ira. He let his sack slide from his shoulder, set it down beside his basket. "Like I tell 'em, he said to the man," "if they'd stop fussin' about Roosevelt and get out and work , this would be a better country. No jobs? Listen, if a feller wants to work, he can work. Look at all this country. Land every place. Stuff ain't goin' to plant itself and sprout up without some help. A feller worth his salt will always make out. He may not eat as high off the hog (best part of the hog) as he once did, but he can eat if he wants to bad enough. He paused, sold a couple apples, then a piece of gingerbread. "The apples are two for five cents," he said. "The gingerbread's a penny a slice."
A crowd had gathered, blocking the sidewalk, and folks wanting to be about their business had to step out into the street and skirt Ira and his listeners. Pretty soon the last of his apples and gingerbread were gone, and Ira reckoned (decided) he could do a bit of talking without being interrupted. "Made myself about three dollars," he said, looking at the empty sack and the empty basket. "It's not much but it's a honest living. (The three dollars will) Buy me and the old woman (wife) some meat and salt and sugar and a little coffee that'll last us a spell (awhile)."
Then he was back to talking about the country and hard times. "No use to kick and grumble, he told his audience. "Could be a lot worse, a lot worse. When you get healthy fellers (men) grumblin', well that a might pore (sure) sign they ain't all there in the head. Som Folks just got to feel sorry for their selves (themselves) and expect it (food) to come a runnin' to 'em on a silver platter.
"But let me tell you, them fellers should pull up their reins and give a lot of thought to how well the Good Lord's been to 'em. Think of the crippled, the sick and the afflicted. I tell you, them of us that can be up and about has got a lot to be thankful for."
Finally, it was getting on toward daydown (sunset), the pink of the evening, and Ira picked up his empty sack and his basket and set out down (walked down) the street and out of town. I remember watching him shuffle along, back slightly bent, head bobbing as if he were talking to himself. It was the last time I ever saw him.
But I still remember him as the gingerbread man who took my pennies when I was a boy and patted me on the head and smiled and always spoke to me, calling me by name.
I wonder if anybody makes gingerbread any more, the kind that Ira sold in our town.

In 1999, Tim Barker wrote, "All of Ira's children that I can remember were some of the best people a person could meet. They had stories and old timey ways that are quickly disappearing here in Western NC. They were all good people that believed in God, Country, and family.

Roy O. Barker wrote 11/2/1999: The first time I saw Mitchell Barker, son of Ira Baxton Barker and Candis Oma Conner, Mitchell looked like my father (Thomas Edward Barker b. 1895). Mitchell had the same facial expressions, same height, same hairlines and similar weight. He even sounded like my father, acted like my father, and seemed like identical twins. Ira was a brother of my grandfather, Warren Avery Barker, and Candis was a sister of my grandmother, Sarah Adeline Conner. So, my father, Thomas Barker, and Mitchell Barker were double first cousins. My father commented that it was like looking at himself in the mirror.
