The Last Will and Testament of Peter Smith ser.

In the name of the Benovolent Father I Peter Smith senr. of Clinton
County and State of Indiana, do make and publish this my last will and
testament. Since Peter died in 1851, suggest you order the
"complete" probate packet, and find out exactly where Abraham was to
sign for his bequest. There might be a teeny bit of paper, the receipt
receiving the bequest in the packet. It should state his address,
and where he is signing. I hope you connect, need help in NC looking
for Pete's ancestors.
1st I give and devise to my beloved children as follows:. that my son
Abram Smith have six hundred dollars and that my daughter Ann wife of
William (Said) have the sum of six hundred dollars and that my son
Christian Smith have the sum of five hundred dollars and that my son
Peter Smith have the sum of six hundred dollars and that my son Jacob
Smith have the sum of six hundred dollars, and that my son Daniel Smith
have the sum of six hundred dollars, and that the heirs of my son Moses
Smith towit Silas Smith and Nancy Smith each have three hundred dollars,
but not to be paid to them till they become of age and that my daughter
Rebecca wife of Wiley Erby have the sum of six hundred dollars and that
my son Joseph Smith have the sum of seven hundred and fifty dollars and
that Benjamin Lilly have one dollar.

2d That the hereafter appointed executors are to pay my funeral
expenses and also all just debts that I may owe at my death out of the
money that may be on hand at my death and the remainder of money to be
paid to the above named heirs in proportion to the amount willed to each
of them, as soon as said executors may become in possession of it after
my death and the remainder to be paid to said heirs out of the money
collected from out standing debts or from the sale of the real estate as
soon as collected.

3d In case the amount of my estate should be more than will pay the
above amounts to the to the heirs and comfortably support my beloved
companion during her lifetime the executors is to divide the same
equally among all the said heirs (except the said Lilly he is to have
only one dollar).

4th I do hereby nomionate and appoint Daniel Smith and Peter Smith
executors of this my last will and testament hereby authorize them the
said executors at my death to take charge and possession of all my
propertyboth real and personal. I hereby authorizing and empowering
them to compromise adjust release and discharge in such manner as they
may deem proper the
debts and claims due me. I do also authorize and empower them to sell
by private sale or in such manner upon such terms of credit or otherwise
as they may think proper all of my real and personal property and deed
to purchasers to execute acknowledge and deliver in fee simple said
executors are to sell my real estate within seven years at any time they
think proper within that time and in case my companion is living at the
time of sale the real estate is to be sold with her right of dower on
the same.

5th the said executors are to see that my beloved companion Susanna
Smith have sufficient amount of my estate to render comfortable during
her lifetime. In testamony whereof I have hereunto set my hand and seal
the fifteenth day of October in the year of our Lord 1851.

in our presence and signed by us inhis presence.

Codicil to the foregoing will.

Whereas I Peter Smith Sen. of Clinton County, Ind. did on the fifteenth
day of October A.D. 1851, make thwe above my last will and testament of
that day do hereby declare the following to be a codicil to the same.

Whereas in my last will and testament aforesaid I did bequeath to the
heirs of Moses Smith to with Silas Smith and Nancy Jane Smith the sum of
three hundred dollars each I do hereby revoke that portion of said will
and give and bequeath said six hundred dollars (that was willed to said
heirs) as follows towit that my companion Susanna Smith have five
hundred dollars to be disposed of as she may see proper and that my
esteemed friends Henry Smith and James M. Smith each have the sum of
forth dollars and also that George W. Webb and Emily Smith each have the
sum of ten dollars all of which is to be paid to them bymy appointed
esecutors in the manner that they are to pay the heirs in my will
directed and also that said hers of Moses Smith towit Silas Smith and
Nancy Jane Smith each have one dollar to be paid by the executors when
they become of age.
