40. SIMEON S.4 LAKE (HARRISON B.3, WILLIAM LAKE2 JR., WILLIAM1 LAKE) was born March 19, 1839, and died April 01, 1913. He married LOUISA MARIA BURDETTE September 03, 1858 in Taylor County, WV, daughter of MARY WILMOTH CLEGGETT. She was born August 09, 1840, and died July 22, 1907.

In the name of God Amen.

Knowing the frailty of life and the certainty of death, I Simeon S. Lake, being of sound mind, make this my last will and testament February 4, 1913.

1. That out of my personal estate and property my funeral expenses be paid and all my debts if any.

2. That I bequeath unto my two daughters Mary and Lucy the home farm on which I now reside containing 13 3/8 acres more or less, with the right and privilege to sell to each other if so desired, and to have all the household and kitchen furniture in the home.

3. That all my personal property go to my two daughters Mary and Lucy and my son Homer except that Homer shall have the horse Tom, buggy wagon, harness and farm implements as his own.

4. That Homer Lake and Guy Lake my two sons, have the farm known as the Josiah Bartlett farm of about 42 1/2 acres and they make their own division.

5. W. T. Lake shall be paid by Lucy, Mary and Homer the sum of one hundred ($100) dollars and a sum not to exceed eighty ($80) dollars funeral expenses - the $100 to be paid in yearly payments of $_____each on the first day of each year until paid - when needed.

6. To Mrs. Byrd Lake the tract of about two (2) acres between B. & O. Railroad and County road during her lifetime or until she again marry and in that event to go to her sons Walter and Dewey Lake.

7. That the tract known as the Newlon place is hereby bequeathed to my two daughters Mary and Lucy and my son Homer during their lifetime and at their death to be sold and the money divided equal with the brothers then living but with the understanding that Bruce shall have the first right of purchase when sold and if no brothers be living then to be divided equal with the grandchildren.

But if the three, Mary, Lucy and Homer agree at any time the land may be sold and the money divided equal with themselves.

That I hereby appoint Clyde Lake as the executor of this will and that he give a bond in the sum of two hundred ($200) dollars.

Signed by myself and in the presence of E. N. Lock and T. J. Hickel, witnesses and they signing in my presence.

This the 4th day of February 1913.

WILL OF HOMER LAKE

I, Homer Lake, do make and publish my last will and testament as follows, hereby revoking all former wills made by me.

First: I give, devise and bequeath to my brother, Guy Lake, my undivided interest in a certain tract of land lying in Court House District, Taylor County, and known as the Josiah Bartlett farm and which is now owned by myself and said Guy Lake, but my brother Guy shall pay to my estate the sum of six hundred dollars unless he should pay to me some money before my death in which event I will give him a receipt and if such receipt is given then it shall be accepted as a credit upon said six hundred dollars and said six hundred dollars or such part thereof as is paid to my estate shall be used for the payment of my funeral expenses, to cost of a grave marker which I now direct to be placed at my grave, the cost of administration and if any balance then remains such balance is to be paid to my sister, Mary Lake.

Second: I give, bequeath and devise to my sister, Mary my undivided interest in the parcel of land lying in Court House District, Taylor County, known as the Charlie Newlon place and now owned by myself and my two sisters, the said interest being so given in fee.

Third: All other property remaining, including my livestock, I give to my sister, Mary Lake.

Fourth: I nominate and designate Mrs. Minerva Lake executrix of this will but provide that she shall be allowed to qualify and act as such without executing and filing a bond.

In witness whereof I have hereunto subscribed my name on this the 4th day of May, 1935.
