Will of Edward C. and Rosa Lake

We, Edward C. Lake and Rosa Lake, husband and wife, of Marion County, West Virginia, being of lawful ages, sound minds and disposing memories, do hereby make, publish and declare this to be our last will and testament, jointly as well as severally, hereby revoking any and all other wills by either or both of us heretofore made.

First: We direct that our just debts and funeral expenses be paid as provided by law.

Second: We hereby give, devise and bequeath unto the one of us surviving the other all property, real, personal or mixed, of whatever nature and wheresoever situate, of the other, in fee simple, absolutely and forever, to be used, enjoyed and disposed of in any manner whatsoever as the survivor may see fit, but should both die, or if when both shall be dead and no individual will shall have been made, then the property of both shall be treated as one and the same, and shall be disposed of as hereinafter provided.

Third: When the survivor of us shall die, or when the both of us shall be dead, all the property belonging to the deceased of us, real, personal or mixed, of whatever nature and wheresoever situate, which the deceased of us may own or have the right to dispose of at the time of his, her or our death, we hereby give, devise and bequeath to our hereinafter named children and grandchildren in the proportions as follows:

(1) To our son, Harold Lake, one third (1/3rd) part thereof;
(2) To our daughter, Betty Ann Myers, one third (1/3rd) part thereof;
(3) To our grandson, Robert Finnerin, one sixth (1/6th) part thereof;
(4) To our grandson, Daniel Finnerin, one sixth (1/6th) part thereof; our said two grandsons being the children of our deceased daughter, Dorothy Lake Finnerin.

Fourth: We hereby make, constitute and appoint the survivor of us to be the executor or executrix of this our last will and testament, and direct that said executor or executrix, as the case may be, shall not give security on his or her official bond as such fiduciary.

In testimony whereof, we hereunto set our hands and affix our seals to this our last will and testament, at the city of Fairmont, Marion County, West Virginia, this the 12th day of May, 1949.
