TRAGEDY ON PINE CREEK OVER FAMILY AFFAIR

M. H. Sims of Hugo, Ok., a former resident of Lamar county, was killed about 2 o'clock yesterday afternoon [Sep. 11, 1917] at the home of his son-in-law, J.S. Landers, between eight and nine miles northeast of Paris on the D.S. Hammond farm on Pine Creek. The tragedy was the result of family trouble which resulted in the separation of Mr. Landers and his wife a year or two ago and the institution of a divorce suit by Mr. Landers, which is still pending. Two of the children, boys six and eight years old, are staying with their father and the mother has possession of three of them. The two little boys were the only eye witnesses to the killing.

According to the statement of Mr. Landers the deceased arrived at his home from Hugo in a jitney with two men who put him out at John Irwin's, half a mile from where Landers lived, and drove away about 1:30 o'clock. He and his two little boys were were in the field picking cotton and the deceased went to where they were and drew a pistol and made him shed his cotton sack and march in front of him at the point of the pistol to Marvin Bailey's, a neighbor living about a quarter of a mile from his home. When he reached Mr. Bailey's the deceased stopped to talk to the latter's wife and while he was talking to her Landers gave him the slip and went around the house and across the field to his home.

When the deceased got through talking to Mrs. Bailey and discovered that he was gone he went to Irwin's in search of him, but failing to find him, then went to his home, Landers stated that when he saw the deceased coming he got his shotgun and sat out in the hall to protect himself, and that the deceased approached the house from the back way and came around the smokehouse with his pistol in his hand. As soon as he turned the corner of the smokehouse in view of the gallery Landers fired at him with a shotgun loaded with No. 6 shot.

Only one barrel was discharged while he was about ten steps away and the contents took effect in the lower part of his face and neck and all over the breast. The deceased turned and walked five or six steps and fell and expired. The two little boys of Mr. Landers were standing in the road near the house when the shot was fired. As soon as the shooting occured Landers got his neighbors, Bailey and Irwin, to notify Sheriff Clarkson, who went out to the place accompanied by Deputy Sheriff McDonald and County Attorney Grady Sturgeon, and they found him at home waiting to surrender, he claiming self-defense. Sheriff Clarkson brought the body of Mr. Sims to Paris in his automobile and turned it over to Emberson & Brown, undertakers, who notified his wife.

THE DEFENDANT WAIVED AN EXAMINING TRIAL

J. S. Landers, charged with killing his father-in-law, M. H. Sims, on the Hammond farm eight miles northeast of town Tuesday afternoon, and who had been released on a temporary bond, was arraigned before Justice of the Peace, Jay Hall yesterday morning and waived preliminary examination. His bond was placed at $500, the same amount as the temporary bond, which he made with the same sureitys. A number of persons called at Emberson & Brown's undertaking shop yesterday morning to view the body of the dead man, he having had a large acquaintance.

The wife of the deceased and daughter, Mrs. Landers, arrived in Paris on the 11 o'clock train Tuesday night in response to the message that had been sent to them announcing his death. The funeral service was held at 3 o'clock yesterday afternoon at the Palestine graveyard of Powderly. SOURCE: The Paris Morning News, Thursday Sept, 13, 1917.

Landers Funeral

The funeral of Joseph S. Landers, Rt. 6, Paris wil be held Thursday at 3 P.M. in Brown-Roden Funeral Home here. Dr. H. Glenn Smith of Immanuel Baptist Church will Officiate and interment will be made in Red Hill Cemetery in the northeast part of the County.

Mr. Landers, 67, a retired grocer of Slate Shoals community, died Monday night in Lamar General Hospital here.
