On the petition of Mary A. CLINE intermarried with Ira D. CLINE, late Mary A. BRITTON one of the daughters and heirs at law of John BRITTON late of Huntington Township in the County of Luzerne aforesaid deceased setting forth: That the said petitioner's father lately died intestate leaving a widow to wit: Aluisa BRITTON and issue six children to wit: the said petitioner named Mary A., Adelaide intermarried with Henry P. WHITEMAN, Benton BRITTON, and Asael [sic - underlined] BRITTON the last two of whom are juniors and have Epephras WADSWORTH for their guardian, Henrietta BRITTON a junior who has for her guardian Ezra S. CHAPIN, and Nancy intermarried with Andrew LAUBACH, Esq., who is since deceased leaving issue five children all of whom are juniors under the age of fourteen years and have for their guardian their father Andrew LAUBACH and are named John B. LAUBACH, Mary Allen [sic - underlined] LAUBACH, Aluisa LAUBACH, Clarence LAUBACH and Nancy LAUBACH. And that the intestate died seized in his desmame [sp?] as of fee of and in the following described real estate to wit a certain messuage and tract of land situate in the township of Huntington and County of aforesaid adjoining lands of George LARRISH [sic - underlined] on the West/East [over-written - underlined], Charles BATTON on the North, Aluisa BRITTON on the South and bounded on the West [sic] by the line of the Counties of Luzerne and Columbia containing one hundred and twenty-eight acres and one hundred perches more or less with the appurtenances And therefore praying the Court to award an inquest and to appoint Stephen MELICK [sic], Edward HUGHES and Joseph BOSTON commissioners who are nominated and agreed upon by the several parties interested as appears by the annexed agreement, to make partition of the premises aforesaid to and among the children and representatives of the said intestate in such manner and is such proportion as by the laws of the Commonwealth is directed if such partition can be made without prejudice to or spoiling the whole; but if such partition cannot be made thereof as foresaid thence to value and appraise the same and make report of their proceedings herein according to law. AGREEMENT It is agreed between the undersigned widow and heirs at law of John BRITTON, deceased, that the Judges of the Orphans Court of Luzerne County shall appoint the within named Stephen METICK [sic], Edward HUGHES and Joseph BOSTON Commissioners as prayed for in foregoing petition ad for the purposes therein set forth and they therefore pray their appointment. ~~ Aluisa BRITTAIN [sic], Mary A. Nov. 15: June: 1857. Stephen MELICK one of the Commissioners to make partition & appointed by the Court on the agreement & nominations of the parties having died since such appointment the Court on the agreement & nomination of the parties appoint Jacob GOOD of Huntington Township a commissioner in place of said Stephen MELICK, dec'd. 17 August 1857 Estate of John BRITTAIN, dec'd. RETURN OF INQUISITION To the Honorable the Judges of the Orphans Court of Luzerne County. We the subscribers Commissioners appointed by the annexed order of Court to make partition of the Real Estate in the said order described whereof John BRITTAIN late of Huntington Township in said County of Luzerne died seized if each partition could be made without prejudice to or spoiling the whole otherwise to value and appraise the same do report that in pursuance of the said order the said parties in the said order named having been severally named and as [unreadable] as choose being present we on the twenty fifth day of July A.D. eighteen hundred and fifty seven went to and upon the premises within described and after having viewed the same finding that they could not be parted and divided so as to accommodate all the heirs of the said deceased and that only one of the heirs could be accommodated thereby we have valued and appraised and do value and appraise the same without division for the sum of Forty three hundred dollars.
