B, pp. 274 - 276 CHARLES BRITTON ) I Charles BRITTON of the township of Abington in the County of WILL ) Luzerne and State of Pennsylvania being of and [sic] my usual health and of sound mind, memory and understanding, do make constitute and appoint this my last will and testament. First of all I give my body to the Earth to be decently interred, and my Soul to God who gave it. To my Wife if she shall survive me as my Widow I give the use if one third part of my Estate and property during her natural life. To my son John I give of my Estate as follows, to wit: Beginning at the North West corner thence along the line of my land South West to the Brook, thence along the brook so as to divide the water to the road, thence along the road in a South Westerly direction so far as to make the North East part of the lot at the point thirty two rods wide thence South East to a line run parallel to the South West line of the lot quite through my Land to the outside line of the same, thence by the outside line of the same North East to the corner, thence North West to another corner, thence South West to another corner of my old Lot and thence North West along the same to the place of Beginning, including all North East of the Brook on the West side of the Road and all North East of the said parallel line on the East side of the Road, also all my Carpenters and Mason Tools and Tool Chest, charged with payment as follows, to wit: He shall pay to his Sister [sic] Nancy Ann & Mary Each fifteen dollars & to his Sisters Esther & Hannah Each five dollars, all in four years from my decease, also all necessary and proper charges of my funeral. To my son Jeremiah I give the residue of my Real Estate not included in that part described and given to John with the appurtenances for his use during his life, and after him to his Son Jerome in fact. And I charge the said Jeremiah or my Estate so given to him as follows: To pay to my Son Charles out of the same Sixty dollars, to pay my son Caleb ten dollars within four years after my decease, and to pay all necessary and proper Expenses of the funeral of his Mother. I give to my Daughters who shall survive me all my household furniture, to be divided equally among them. And to Nancy Ann and Mary Each fifteen dollars, and to Esther and Hannah Each five dollars, to be paid to them by my son John as before mentioned in four years after my decease. I give to my Son Charles Sixty dollars to be paid as above by my Son Jeremiah. I give to my Son Caleb ten dollars to be paid as above by my Son Jeremiah. And I hereby nominate and appoint my Son John BRITTON and my neighbor Benj. LEACH to be Executors of this my last Will and Testament. I witness whereof I have here-unto set my hand and seal this thirteenth day of March Eighteen hundred and forty-Seven. SMITH Luzerne County, S.S.: Be it remembered that on the 16th day of April 1847 before me Harris JENKINS Register of Wills and granting Letters of Administration in and for said County came Thomas SMITH who after being duly sworn according to law doth depose and say that he signed his name as a Witness to the foregoing Will, and on the 23th [sic] day of April A.D. 1847 also appeared Benjamin SMITH who after being duly sworn according to law doth depose and say that he signed the foregoing Will as a Witness, and they saw Charles BRITTON the Testator sign his name thereto and that he declared it as his last Will and testament, and that he was at the time of so doing of perfect sound mind, memory and understanding, to the best of their knowledge and belief. Harris JENKINS, Register. In Conformity to the foregoing Will & probate thereof Letters Testamentary were this day granted to John BRITTON (Int.) X Benjamin LEACH Executors therein named, they having first been sworn according to law, to well and truly Administer the goods and chattels, rights and credits which were of the said Testator, and make a true and perfect Inventory and just and conscionable appraisement thereof, and render a true and perfect account, reckoning or calculation of their said Administration according to law. ~ Given under my hand and the Seal of the Registers Office at Wilkes Barre this 16th day of April 1847.
