To all people to whom these presents shall come John COLE and Matilda his wife, Josiah COLE, Alexander COLE, William COLE, George HESS and Rebecca his wife late Rebecca COLE, Solomon H. DAVIS and Elizabeth his wife late Elizabeth COLE, and Sarah COLE children and heirs of Benjamin COLE late of Sugarloaf township in the county of Columbia and State of Pennsylvania deceased, Send greeting, Whereas William EAGER late of the township of Sugarloaf deceased who died intestate in possession of a tract of land in the township of Sugarloaf aforesaid granted to him by the Commonwealth of Pennsylvania by Patent dated the eighteenth day of January A.D. Eighteen hundred and twenty-three enrolled in patent book H volume 20 folio 506 adjoining lands of the honorable the proprietors Philip CRAMER, Matthias RHONE & Daniel HEISTER containing three hundred and eight acres, ninety-five perches and allowances of six percent for roads which said tract of land after the death of the said William EAGER was by due cause of law divided into three parts of equal value, one of which one-third parts became the property of the said Benjamin COLE and Elcy his wife late Elcy EAGER, a daughter of the said William EAGER, deceased, adjoining lands of Matthias RHONE, heirs of John EAGER, Michael HARTMAN and Alexander COLLEY, containing one hundred and fourteen acres, sixty-four perches and allowances of six acres per cent for roads. And the said Benjamin COLE, being so thereof seised did on the twelfth day of January A.D. eighteen hundred and forty-one enter into a contract for the sale of the same to Ezekiel COLE (his son) for the sum of five hundred dollars. And whereas the said Benjamin COLE did not by proper deed or deed of conveyance grant the said piece of land according to contract to the said Ezekiel COLE in his life time nor make any sufficient provisions for the performance thereof, know ye that the said John COLE and Matilda his wife, Josiah COLE, Alexander COLE, William COLE, George HESS and Rebecca his wife, Solomon H. DAVIS and Elizabeth his wife, and Sarah COLE for and in consideration of the sum of five hundred dollars to them in hand paid by Ezekiel COLE of Sugarloaf township aforesaid at and before the ensealing and delivery hereof the receipt whereof they do hereby acknowledge and thereof acquit and forever discharge the said Ezekiel COLE, his heirs, executors, and administrators by these presents have granted, bargained, sold, released, and confirmed, and by these presents do grant, bargain, sell, release, and confirm unto the said Ezekiel COLE, his heirs and assigns All that messuage or tenement and piece or parcel of lands situate in Sugarloaf township aforesaid adjoining lands of Reuben HARTMAN, Daniel HARTMAN, A. COLLEY, Solomon DAVIS, Matthias RHONE & Stott E. COLLEY bounded as follows to wit: Beginning at a post on line of D. HARTMAN South seventy-eight and one-fourth degrees East one hundred and fifty-one & a half perches to a post thence South eight degrees West one hundred and twenty-one perches to a post thence South eighty-eight & one half degrees East forty perches to a post thence North eight degrees East one hundred and ninety-four & seven tenth perches to a post thence North seventy-four degrees West one hundred and fifty-eight perches to a post thence South twenty-nine and one fourth degrees West ninety-two and a half perches to the place of beginning containing one hundred and fourteen acres, sixty-four perches of land with allowances of six acres per cent for roads. Together with all and singular the Buildings, Improvements, Ways, Woods, Waters, Water-Courses, Rights, Liberties, Privileges, Hereditaments and Appurtenances whatsoever thereunto belonging or in any wise appertaining and the Reversions and Remainders, rents, issues, and profits thereof and also all the Estate - Right - Title - Interest - Property - Claim and demand whatsoever of them the said John COLE and Matilda his wife, Josiah COLE, Alexander COLE, William COLE, George HESS and Rebecca his wife, Solomon H. DAVIS and Elizabeth his wife, and Sarah COLE in law or equity or otherwise howsoever of, in, to, or not of the same to have and to hold the said messuage or tenement and piece or parcel of ground, hereditaments and premises hereby granted or mentioned as intended so to be with the said appurtenances unto the said Ezekiel COLE, his heirs and assigns the only proper use and behoof of the said Ezekiel COLE, his heirs and assigns forever.



In Witness whereof the said parties to these presents have hereunto set their hands and seals Dated the tenth day of September in the year of our Lord one thousand eight hundred and fifty-three.

On the tenth day of September A.D. eighteen hundred and forty-nine Before me the subscriber a Justice of the Peace in and for the County of Columbia came the above-named John COLE and Matilda his wife, Josiah COLE, William COLE, George HESS and Rebecca his wife, Solomon H. DAVIS and Elizabeth his wife, and Sarah COLE, and severally acknowledged the above-written Deed Poll as and for their act and deed and desired that the same might be recorded as such according to law they the said Matilda, Rebecca & Elizabeth being of full age, separate and apart from their said husbands by me examined and the full contents thereof made known to them voluntarily consenting thereto.
