Family Tree Maker, World Family Tree, Disk 705, Vol. 5, Tree #3:Contributed by Ruth Goodman:
James was born Abt. 1740 in NJ and lived there until Abt. 1760 when he moved to VA and there married Josephina Rose Unknown. His first wife died in VA in 1780. He lived in MD until Bet. 1740-1759 when he moved to VA where he and three of his son's served in the Revolutionary War. He married his second wife, Mary Brain, in 1782 in VA. In 1785 he moved to Bourbon Co., KY. He settled on land purchased in what is now Nicholas Co., KY. His large family was located on present State Route 32 and 36 near the settlement of Headquarters, KY. Early court records show that when the new County of Nicholas was formed from parts of Bourbon and Mason Counties in 1799 and laid out its first County road, it bisected the Burden farm. He sued for an injunction and lost, but when the road was completed he sued for damages and won a judgement. Births in Bourbon Co., KY are now listed in Nicholas Co., KY.

James Burden, who is infirm and incapable of supporting himself and family by reason of his three sons going into the service of the United States. Captain Peyton Stern's Company.
Note: I believe this is our James Burden. I can only assume he was injured earlier in the war is why he was listed as infirm. According to the journal left by his son, Judge Eldridge Burden, James served in the Militia in the Revolutionary War. He would have only been in his early 40's when the war ended but I do not know the extent of his injuries.
