He married SARAH ELIZABETH UPSHAW August 18, 1843 in Noxubee Co., Mississippi, daughter of JOHN UPSHAW and TABITHA LAWLESS. She was born June 19, 1825 in Elbert Co., Georgia, and died July 11, 1902 in Holland, Bell Co., Texas.

I have copies of several handwritten documents;

Marriage license 18 Aug 1843 signed by Jno. B. Roberts, clerk. Rites witnessed 3 Sept 1843 by Allen L. Baird, Justice of the Peace. Recorded 12 Sept 1843.

Bienville Parish, LA - Succession of John B. Markham

Estate settlements 1857 and later showing disposition of properties 18 Nov 1857.

Sarah Markham settles the estate of John Markham, her late husband. She names her brother, James Upshaw as administrator.

Wherefore, petitioner prays that a family meeting be held composed of John Upshaw, T. Allen Upshaw, the only male relatives of said minors to deliberate touching the interest of said minors and to advise and hold a family meeting composed of the following persons, to wit: John Upshaw, T.A. Upshaw, E.N. Warren, Lewis Eldridge and John C. Young. Minor children of John B. Markham, dec'd and issue of his marriage with Sarah Upshaw, Permelia Ann, Emily Jane, Tabitha, James M. and John B. Markham.

James Upshaw, admin. - in account with the succession of John B. Markham, dec'd. Clerk of the District Court in and for the Parish and State aforesaid, do hereby certify that Sarah Upshaw, widow of John B. Markham, Leasor. 18 November 1857. Bienville Parish, Louisiana.

Tutorship of the minor children of J.B. Markham. To the Hon. Judge of the 17th Judicial District, State of Louisiana, Parish of Bienville.

The petition of Sarah Upshaw, a resident of the said State and Parish with respect, shows that John B. Markham, late of said Parish dec'd, left the following named minor children to wit: Ann, Tabitha, James M., John Markham and Emily J. Markham, issue of his marriage with petitioner who further shows that she has not yet been confirmed as their natural tuition to which she is entitled by law and that the interest of said miners requires that she shall now be confirmed as natural trust of said minors and that some discreet person be appointed as under tutor.

Wherefore she prays that she be now confirmed in her capacity of natural tutor of the above named minors, issue of petitioner's marriage with said dec'd, and that James Upshaw be appointed under tutor of said miners and for all necessary orders and general relief.

That Sarah Upshaw be confirmed as natural tutrix of the minors Ann, Tabitha, James M., John and Emily J. Markham, children of John B. Markham, Issue of his marriage with Sarah Upshaw. It is further ordered that James Upshaw be appointed under tutor of said minors, etc.

Sighed - John F. Stephens, Clerk of the Court.

James Upshaw to post bond of $2800 and take an oath to administer estate. Property was sold at auction to Alfred Price for $1600 (at 8% interest?) on 2 Jan 1860.
