Thanks for responding. I was concerned that I lost your email.
I did receive your last message that indicated that a zip file was attached but none came through. I can usually translate zip files without any problem. I would like to see the file if it not too much troble to transmit it again.
The name "Ollie" caught my eye. My mother's name was Ollie (Ollie Shipley"). Her mother's aunt was Ollie Zimmerly, daughter of Jacob Zimmerly and Mary Lower. My mother did not know for whom she was named. She was not aware of the Zimmerly /Lower connection. There may a more direct link if can decipher how the various families are connected.

I did not find the will or estate settlement for Peter Lower. What I found was the sale of property from the heirs of Peter. In establishing title to the land it was noted in each of the three land sales that the land was from the estate of Peter Lower. The three sales were from Mary (Lower) Zimmerly, daughter of Peter,; Henry Lower, son of Peter Lower; and from Catherine Lower as her life estate share from her husband, Peter Lower. No other family members are listed in the deed transfers.

The affidvit of sale I found that alerted me to the Claiborne County record was filed in Hamilton Co., TN but referred to the land in Claiborne. This was under Jacob Zimmerly (in TN the husband had to agree to the sale of land and the wife, who had inherited the land, had to give a separate statement of agreement of sale). The affidavit was returnwed to Claiborne Co. for recording. Until I found the affidavit I did not know that I had any ancestors living in Claiborne County.

Origins of the Zimmerly Family In his Will dated 1819 Jacob Zimmerly names his wife Eve and eight children. Catherine Lower(y), George, who predeceased his father leaving four children. Eve Mumbower(sic), Elizabeth Zimmerly, Jacob, Susannah Shelby, Mary Sanders, and Margaret Booher. Catherine Lowery, the eldest Zimmerly daughter lists her place of birth as South Carolina in the 1850 Indiana census, where she was 80 years of age and living with her sister Margaret Booher. Daughter's Eve and Elizabeth list their birth place as North Carolina. This would seem to suggest that Jacob's family arrived in this country by way of South Carolina, not Pennsylvania as previously assumed. There were two brothers, Adam and John Simerly who migrated from South Carolina to North Carolina in the mid-1770's. Adam Simerly/Zimerly appears in the Washington County Tax list in 1782 in the same tax district as Jacob Simerly/Zimerly, increasing the probability of a sibling link between these three gentlemen. They migrated from SC inland to the Northeastern corner of Tennessee, then known as North Carolina. The brothers Adam and John remained in Tennessee but Jacob about 1780 moved his family up the Holston River and settled in Washington County, Virginia.

These are my old notes about Lower/Lowery, Peter. I still think they are one in the same.. but I may be wrong... wrong.. Little Barren Creek area? 1802?? same time and area as our Whiteheads there anyway. -- Just sending and perhaps more deed info I might find will help prove something added to this info. -- Mary Lou

Catherine Zimmerly married Peter Lower (not Lowery). I spent many hours tracing the Lowerys because a court clerk listed the marriage name as Lowery. Peter & Catherine are in Claiborne Co., TN by 1801. (Susanna & Samuel Shelby lived near by.) Peter & Catherine had as children:
Henry m. Sally Fields,Hamilton Co.TN 1836
Mary Margaret m. George Zimmerly, (son of George & Catrine Deck) moved to Hamilton Co. TN before 1840.

We just returned from a quick trip to TN. Your line seems to be Lowery. Here is the information I have in my file on Peter Lower:

Peter Lower b. d. <1838 Claiborne Co. TN m. 1794 (Wash. Co. VA) ZIMMERLY, Catherine b.c. 1776 d. >1853 (The Washington Co., VA court clerk listed the groom incorrectly as Peter Lowry. I spent a lot of time off on that wild goose chase.)

In March 1802 Peter Lower serves as a juror in Claiborne Co. TN.

(George & Henry with families are living on land grant in West TN in 1870-80). Margaret marries Tilman C. Keener 1865 in Sale Creek, Hamilton Co. TN. On 25 May 1837, Jacob & Mary are living in Hamilton Co. TN and sell land on N. side of Clinch River at the mouth of Little Barren Creek in Claiborne Co. TN to James Braden. The land was part of Catherine's inheritance from Peter Lower, dec'd. Witness for the sale was Henry Lower, Catherine's brother. In other transactions, Henry sells his share, 33 acres, to James Braden also. In 1839 Catherine sells her "life estate" share of land, 150 acres, to Stephen Owsley. (Recorded in the Claiborne Co. TN records.)

Hi, Mary Lou,
I have not found any proof that our family lines have an Indian connection. One family, the Branhams, have an Indian connection from VA but that link seems to have been made after our Branham side moved to TN. Most of my research in Claiborne Co., TN has been on the Lower and Shelby families (sisters and brothers in law). Both of those families were on Little Barren Creek. That area is now underwater near where the highway 33 bridge crosses. Most of research has been concentrated in the Hamilton Co., TN area where I was born and grew up.

I talked to RUTH Monroe tonight. She is so excited about the deed where Thomas sold 100 acres to daughters, Eliz. & Polly Ann. She said she knows she remembers the house and the mill now that must have been Thomas Whitehead's. It was down on Little Barren creek when she was a girl they used to pass it. The Needhams had or ran the mill later, she said. But that would be right she said... since Elizabeth had the land and her son Maryville Whited married Pulaski Needham. And Maryville had the land later.

Ruth has this land record.. or deed that deals with Catherine Zimmerly Lower/Lowery. Wife of Peter Lower/ Lowery. Ruth is now convinced that the Peter Lower & Catherine Zimmerly are parents for Ollie & Lucinda. In this land dealing Catherine Zimmerly Lower is selling or dispensing her land and mentioned in this are CP Whited and Wiley Whited. They are selling their part of the heirship or whatever to the dower of Catherine Lower. So.. this has to prove that Peter & Catherine Zimmerly Lower/Lowery are parents to our Lowery women, doesn't it?

Ruth is sending me a copy of this deed and some other things soon. I will scan or copy for you.

We will soon piece this all together. We will. I am going to email Quinton Marsden and also will send him a copy of this land record that mentions our WHITED men as heirs to Catherine Lowery. I can perhaps get some Peter Lower info from him. He was convinced that Peter Lower & Peter Lowery were two different men.

Ruth Monroe sent this infomation from Peter & Catherine LOWER deeds to me today. It is exciting information as it lists our Whiteds as being in heirship to the dower of Catherine Lower. Please enlighten me asto the legal terms it contains. Such as Life Estate, Dower, Heirship. I am not very good at understanding just what it means for sure. I assume Ollie & Lucy are perhaps daughters of Peter & Catherine Zimmerly Lower? Also can I assume that Anna Snodgrass & Susannah Bundy & Eve Braden are daughters of Peter & Catherine also? Hi Mary Lou, again,

Life Estate means the person can use the property for the remainder of their
lives, but upon thier death it devolves to the heirs.

Dower is the right of a woman to inherit 1/3 of any property the husband and
wife own at the time of his death.

Hiership is those heirs who stand to inherit from an estate.

I'm not a lawyer, but 35+ years of research has taught me a lot about property,
wills, estates, etc.
