Personally came and appeared Margaret Kaisar who being duly sworn maketh Oath and saith that Peter Erlin Kaisar, late of the Township of York, Yeoman, deceased, departed this life on or about the fourteenth day of September last past possessed of some personal and real Estate within the Home District of the Province of Upper Canada, and that the Will of the late Peter Erlin Kaisar now exhibited in the Surrogate Court of said District is the only Testamentary paper found among the Effects of the said Peter Erlin Kaisar

Before me, William Warren Baldwin, Esquire, Surrogate for the Home District of the Province of Upper Canada

Personally came and appeared Leonard Klinck of the Township of Vaughan, Taylor, One of the subscribing Witnesses to the last Will and Testament of Peter Erlin Kaisar Yeoman, hereunto annexed, who being duly sworn, maketh Oath, and saith, that he was present and did see Peter Erlin Kaisar, Sign and Seal the said last Will and Testament as and for the last Will and Testament of him the said Peter Erlin Kaisar [inserted ^ that the said Peter Erlin Kaisar made his mark thereto and did acknowledge] that the name of Peter X [mark] Erlin Kaisar subscribed to the said Will as of the proper hand writing, signature & Mark of the said Testator, and this deponent further saith that the names of Johannes Schmidt, Daniel [X] Stong and Leon Klinck, subscribed to the Will as Witnesses thereto, are of the respective hand writing and Marks of this Deponent, Daniel Stong and Johannes Schmidt who respectively signed their names as Witnesses to the said last Will and Testament in the presence of each other, and in the presence of the said Testator, and at his request, and this deponent cfurther saith, that he verily believes that the said Peter Erlin Kaisar at the time of his signing, and sealing his said last Will, and Testament, was of sound mind, memory and understanding, and that the said PeterErlin Kaisar did sign, seal, publish, and declare the said Will, and Testament hereunto annexed in manner aforesaid, and for the last Will and Testament. We Valentine Fisher Executor and Margaret Kaisar Executrix, do swear That we verily believe that the annexed Will and Testament of Peter Erlin Kaisar deceased, to be the true last Will and Testament of him the said Peter Erlin Kaisar and that We will pay the Debts and Legacies of the deceased, so far as the goods shall extend, and the Law shall bind Us and that We will exhibit a true, full, and perfect Inventory of all and every the goods and Chattels, Rights and Credits of the said deceased, together with a just and true account of Out Administration into the Registry of the Surrogate Court of the Home District of the Province of Upper Canada when we shall be thereunto lawfully required.

3. The Will

In the name of God amen. I Peter Erlin Kaisar of the Township of York, County of York, Home District and Province of Upper Canada Yeoman, being weak in body but of sound mind and memory, blest be God therefore, I do this tenth day of July in the year of our Lord one thousand eight hundred and twenty make and publish this my last Will and Testament in manner and form following (that is to say)
Witness I Commend my soul into the hand of Almighty God who gave it me and my body to the Earth from whence it came, in hopes of a joyful resurrection through the mercy of my saviour Jesus Christ. And as for that wherewith it has pleased God to bless me I dispose thereof & now Will and Direct As soon after my Death as my Executor and Executrix (or either of them, their heirs or successors) will think proper they shall out of my real and personal estate pay my just debts and funeral expenses.

First I give unto my loving wife Margaret all the rents issues and profits of my farm during her natural life, which [farm] is described as being seventy five acres of land westernmost part of Lot number twenty three, Fourth Concession, said Township of York, Home District and Province aforesaid, and as soon or shortly after the death of my said wife I Will and Direct that said farm shall be valued or appraised and my sons Daniel, Adam and Benjamin shall be the sole proprietors of said land.

I also will and direct that immediately or shortly after the death of my wife my personal property shall be equally divided among my sons Daniel, Adam & Benjamin and my daughters Magdalene, Eve and Mary.

I will and direct that in case my son Daniel shall remain on my said farm and prove a faithful and obedient child to his mother, sisters and brothers, when he attains the age of twenty five years I then authorize and empower my executors or the survivor of them to execute a good and sufficient Deed unto him of twenty five acres western most part of Lot Number Twenty Three, fourth concession, Township District and Province aforesaid.

I also give and bequeath to my son Peter Erlin Kaisar the sum of Five Pounds Provincial Currency to be paid to him one year after the death of my said wife.

I now therefore make Constitute and ordain my friend Valentine Fisher Executor and my beloved wife Executrix of this my last will and Testament. In witness whereof I the said Peter Erlin Kaisar have to this my last will and testament set my hand and seal the day and year above written.
