1. CAPTAIN JAMES2 MARSHALL (UNK1) was born Abt. 1745 in PA(?), and died Abt. 1812 in Kershaw Co SC. He married (1) UNK. She was born Abt. 1750, and died Bef. 1797 in Kershaw Co SC. He married (2) CHARITY PARRISH November 01, 1797 in Kershaw Co SC, daughter of JEREMIAH PARRISH and MARY TILLER. She died Abt. 1826 in Kershaw Co SC.

What follows is general information copied from the Kershaw Dist, SC court records:

7 Nov 1797 Indenture WILLIAM RANSOM DAVIS, Sheriff, to BENJAMIN HAILE, whereas JOHN MARSHALL, late of this district; 4 tracts of land on Little Linches Creek 200 A ori. granted to JAMES MARSHALL 4 mar. 1760; 250 A ori. granted SAMUEL BRADFORD 8 July 1774; 100 A ori. granted JOHN MARSHALL dated 5 June 1786; 352 A ori. granted JOHN MARSHALL dated 5 Sept. 1795; Total - 902 A more or less whereas the said JOHN MARSHALL in his lifetime was indebted to JOHN JAMES MARSHALL JR for 10 lbs. 10 shillings brought suit against WILLIAM MASSEY JR and JOHN MARSHALL JR administrators of JOHN MARSHALL

JOHN EVERINGHAM did recover in Nov. Term 1795 for 13 lbs. 13 shillings on 6 Nov
recorded: 8 Feb 1799

Indenture - 10 Dec 1793 between CLEMENT STEWART, planter of Kershaw Co, and LYDIA STEWART, JOHN STEWART, ELIZABETH STEWART, and JEAN STEWART which he bearth his beloved children for 30 shillings - horses, cows, to be applied to school - until Lydia attains 20 years of age, if father dies not to dispose without consent of uncles, JOHN BASKIN, JAMES BASKINS or WILLIAM BASKIN

According to information received from Ed Gray, Captain James Marshall was born in Camden District, Kershaw County, SC around 1750. He died in Kershaw Co around 1812. He had eight children by his first wife, March. He had four children by his second wife Charity Parish. He distinguished himself in gallant service during the War Between the States raising to the rank of Colonel. ( There was a John Marshall at the rank of Colonel, however, I as not sure that the Colonel is our James Marshall--Captain appears to be the correct rank)

According to information complied by Agnes B. Corbett, Jane P. Justice, and William T. Johnson, Jr., in Marshall Faith and Family, James Marshall came to the inland area of South Carolina in 1754. He states in a land petition "he is lately come from Pennsylvania with a wife and two children". He asked for two hundred acres of land on or near the Pee Dee or waters thereof. James was a Captain in the American Revolution, 1776-1781, in which the colonies won their independence from Great Britain. He served in the militia and supplied beef and flour for state use. His record of Revolutionary service has been used for Daughters of the American Revolution memberships.

James apparently died in the winter of 1811-1812. In his will dated 2 August 1811 and recorded 7 March 1812 at the Kershaw County Courthouse, there are references to his wife, Charity, and the following twelve children: Mary, Susanah, John, James, Elizabeth, Thomas, Margaret, William, Zachariah, Jane, Sarah and Nancy. A child, Benjamin, was not mentioned in the will. Benjamin was probably born after the death of James.

In the Name of God Amen know all Men by these presents that I, James Marshall of Kershaw District and State of South Carolina, Planter being well Stricken in age but of sound & Disposing sence & memory do make constitute publish and ordain this my last will & testament in manner & form as following Just & principally. I recommend my soul into the Hands of Almighty God my Maker - my body to the Earth to be decently buried at the Discretion of My Executors hereafter Named - and as to my worldly affairs I will and positively Order that my Just Debts and Funeral charges be all fully satisfied and paid.

1st Item, I give and bequeath To my Daughter Mary Marshall one negroe woman named Suke and her four children, Vizt, Nanny, Darg and Adam, and my riding Horse and one feather Bed and furniture to her, her Heirs and assigns forever.

2nd Item, I give and bequeath to my daughter Susannah Baskins wife of John Baskins one negroe woman Named Hannah and her youngest child Named Anakin to her, her Heirs and assigns forever.

3rd Item, I Give and Bequeath To my Son John Marshall one Negroe wench Names Celia and her Child Named Chloe, one Negroe Man Named Daniel and on Negroe woman Named Dina to him and his Heirs and assigns for Ever.

4th Item, I Give and Bequeath To my Son James Marshall one Negroe woman Named Sabina, and Fifty Dollars to be raised out of my Estate To him and his Heirs and Assigns for Ever.

5th Item, I Give and Bequeath To my Daughter Elizabeth Peoples wife of Jesse Peoples one Negroe woman and the Child Named Phereba the above Negroe woman Name is Teenor to her, her Heirs and Assigns for Ever.

6th Item, I Give and Bequeath To my Son Thomas Marshall one Negroe Man Names Ted and one Negroe Girl Named Franky to him, his Heirs and assigns for Ever.

7th Item, I give & bequeath to my Daughter Margaret McCoy one negro woman named Milley & her child named Orange to her, her Heirs and assigns for Ever.

8th Item, I give and bequeath to my son William Marshall one negro woman named Rose and her son named Ezekiel to him and his heirs and assigns forever.

9th Item, I give & bequeath unto my beloved wife Charity Marshall one bed & furniture and one hundred dollars to be raised out of my estate to her, her assigns for Ever.



10th, I give & bequeath unto my four last children Viz Zacharish Marshall, Jane Marshall, Sarah Marshall, and Nancy Marshall the four following Negroes viz Sylvia, Henry, Fanny, and Penny to be equally Divided amongst the said Zachariah Marshall, Jane Marshall, Sarah Marshall, and Nancey Marshall to them and their Heirs for Ever.

11th Item; I Give and Bequeath my three plantations To my Two Sons William and Zachariah Marshall, with all the working Tools and all my Stock of Every Description for the use of the said plantations to Raise the four following Children Zacharish, Jane, Sarah and Nancey Marshall, Likewise one negroe man named January.

I do hereby Nominate and appoint John Marshall, John Baskins & Benjamin McCoy whole and Sole Executors of this my Last will and Testament whom I also Charge with the Guardianship under Direction as also with Collection of my Debits and payment of my Debts, evoking and making Void all other wills and Testaments heretofore made or dine In Testimony whereof the said James Marshall hath set his hand and affixd his Seal this 2nd day of August in the year of our Lord One Thousand Eight Hundred and Eleven and in the 35th year of American Independence

"Originally a marshall was a shoeing blacksmith, but as the importance of
horses grew in both the economic and social life of the age, the importance of
men expert in their care and selection grew too. In the 11th, 12th, and 13th
centuries a Marshall was a man in charge of the horses. The root of the word
is probably the old French word mareschal meaning ‘one who tends the horses’.
The earliest record of the name is Goisfridus Marescal in 1204".

Charity and James entered into the following agreement prior to their marriage:

Articles of Agreement made and entered into the day of in the year of our Lord one thousand seven hundred and ninety seven and in the twenty second year of the sovereignty and independence of the United States of America, Between James Marshall the elder of Lynchs’ Creek in Kershaw County and State aforesaid, Esquire of the one part, and Charity Parish, of the County and State aforesaid, Single woman of the other part, Witnesseth as follows; viz;

Whereas a marriage is shortly intended to be had and solemnized between the said James Marshall and the said Charity Parish; It is therefore covenanted and agreed by and between the said parties to these presents in manner and form following that is to say~
First the said James Marshall for himself, his heirs, Executors and Administrators doth covenant and agrees to and with the said Charity Parish, her heirs, Executors and administrators, that he the said James Marshall in case the said intended marriage shall be had and solemnized, and in case he should die before her will secure to her separate use and benefit and the property which she shall bring with her in marriage, or the value there of, and also Ten head of cattle, to be left to her at his death to her absolute disposal: And the said Charity Parish for herself, her heirs, Executors and administrators doth covenant and agree with the said James Marshall, his heirs, executors and administrators, that in case the said intended Marriage shall take effect, and in case the said James Marshall should happen to die before the said Charity Parish, that she will and shall not claim or take any other or greater part of his personal Estate, nor any part of his real Estate by way of Dower or thirds; but shall only claim the aforesaid Provision to be made and left for her benefit, or the values thereof, that is to say, the value of whatever she shall bring with her on her marriage and Ten head of Cattle.
Memorandum of the property intended to be brought as a portion in Marriage by the said Charity Parish in case the said intended marriage takes effect to wit-----

Come to Charity Parish by her father, one feather Bed and Furniture and one cow and calf.

I give her ten head of cattle or the value thereof in willingness whereof we have hear unto set our hands and Seals to this first day of November 1797.
