Wilkes Co., NC Will Book #4 Page 316 William Horton's Will In the name of God Amen! I WIlliam Horton of the County of Wilkes and State of North Carolina Being of sound mind and memory do make and ordain this my last Will and testament as follows "to wit." I return my soul to God who gave it and my body to the tomb ???????? As respects the property of this World I own and possess I give and bequeath in this my last will and testament after my just debts are paid all the residue to my beloved wife Mildred Horton, all my property both real and personal to hold during he natural life or Widowhood with the exception herein afer made "to wit." My said wife Mildred shall not have power to sell or convey title to any of my real Estate or Negro property or their increase not withstanding she may loan for a time any property belonging to my Estate to any or all of my Children she having a strict regard in so doing to do equal justice as near as she can to all my said Children. And my wife further is, that at the death of or Termination of the widowhood of my said wife Mildred, that all my property both real and personal belonging to or that may then belong to my said Estate shall be equally divided among all my lawful heirs. And for the purpose of carrying in effect this my last will and testament I do hereby nominate and appoint my Son James C. Horton and George H. Hamilton my Executors with power to sell such of my property as in their judgement can best be spared from the Estate and coney title to the same so far as may be necessary after collecting debts due me to pay all my just debts and to pay the same and my said executors may sell such property for such porpose either on a Credit or for Cash as in their discretion they may think best, In testimony whereof I William Horton hereby declare and publish this my last wil and testament nad have hereto set my hand & Seal this twenty Second day of November in the Year of our Lord one Thousand Eight hundred & forty Five Signed sealed and published Wm Horton [seal] in presence of us James Calloway C.C.
