While the English origins of the MATTHEWS are uncertain, it is probable that he may be descended from one of the numerous MATTHEWS families in the counties of Devonshire and Cornwall.

Registered August 13, 1687.

 

An account of what RALPH MATTHEWS gave his three children before his departure to each: one bed and bedstead, to each six pewter dishes, to each one [an] Iron pot, to each one [a] frying pan, to each one a dozen of spoons, to each two por-ringers?, to one a skinner, to the next a flesh fork, and the other a ladle, and that had the lade to give her one salt tiller to equalize the skinner and flesh fork, and this he did desire. Should be at his wife's disposing till they come of age to ____ it themselves, furthermore he did desire that Col. Smith or his sonne Arthur Smith to take some care that this which he gave his children may not be imbezled and for the children be defrauded of it, and furthermore that his wife should have the remainder herself paying his debts out of it. This RALPH MATTHEWS desired as we have set our hands and hereunto to take notice of as to be his Will. Col Smith being present at that time, it being some two days before his death. Attested by Boaz Gwin, Robert Brock. Proved in open court held for the Isle of Wight County, August ye 13th 1687 by the oaths of Boaz Gwin and Robert Brock.

In the  nuncupative will of Ralph Matthews on August 13, 1687, proved by Boaz Qwin and Robert Brock, and requesting Colonel Arthur Smith to serve as overseer of said children 3. On October 21, 1687, the widor Alice Matthews qualified as executrix. From

September 12, 1751 in South Hampton, Virginia15,16,17,18.  He married (1) MARTHA JOHNSON19,20,21,22,23,24,25,26,27,28 1715 in Isle of Wight County Virginia, daughter of JOHN JOHNSON and MARY.  She was born Abt. 1688 in Southhampton Cty Va, and died Abt. 1738 in Southhampton Cty Va.  He married (2) ANN29,30,31,32,33,34 Aft. 1738 in Virginia.  She was born Abt. 1680 in Isle of Wright, Va., and died Aft. 1751 in South Hampton County Va.35,36,37,38,39,40.

Hugh Matthews, founder of our family in America, was likely the son of Ralph Matthews,

who died in August, 1687, leaving a wife Alice and three small children, unnamed in court

procedings following his death. Hugh may have been sent back to England and then brought

to Virginia in 1698 by Richard Covington, who was granted land on April 26th of that year

for importing 23 persons, including Hugh.(1) Hugh was granted 100 acres of land himself

on 23 March 1715, for importing other persons,(2) and purchased 200 acres from William

West on 23 July 1720 (2a), and was granted another 20 acres on 24 March 1725.(3) His land

was in Isle of Wight County, on the south side of the Nottoway River, on both sides of

Angelica Swamp, beginning at the line of the Nottaway Indians' land. As counties formed,

this land fell into Southampton County, Virginia. He could not have been the Hugh

Matthews who bought 850 acres of land in Isle of Wight County, Virginia, 17 June 1667

from William Cook (3a) as he would have had to have been over 100 years old at his death.

What relationship, if any, to the earlier Hugh remains to be discovered.

 

Hugh Matthews married Martha Johnson, daughter of John Johnson (c1663-1707) in 1715.

Various deeds listed Hugh's wife as Martha, including one in 1738. His will listed a wife

Ann. The will of Hugh Matthewes of County Southampton, Nottoway Parish, was dated 7

November 1747, and proved 12 September 1751.(4) Hugh's children, in no particular order:

Benjamin Matthews was granted land in Craven County, North Carolina, in 1739,(5) He

purchased additional land in 1746 (6) and 1760 (7) on the North Swift Creek where it

joined the mouth of Rocky River. This land was in the area that was Craven County until

it fell into Edgecomb County in 1741 and became Nash County in 1777. His neighbors

included William Matthews, Joseph Matthews and Abraham Sauls.(8) His children:

44. Benjamin Matthews (1748-1818) m. Mary Sauls; of whom later

 

Benjamin Matthews, son of Hugh, died shortly before 4 September 1762, at which time, the

administration of the estate was granted to his daughter Pheba Matthews, his widow being

unable to serve. (11) The inventory was made in September, sale in October,(12) and

report in January, 1763.(13) On 25 October 1763, William Matthews (uncle?) was appointed

guardian to the orphan Benjamin Matthews, (14) indicating that the widow had now died and

that young Benjamin was under the age of 21, and the youngest child. Benjamin witnessed a

deed 16 October 1774,(15) showing that he was at least 21 years old by that date. So he

was born between 1742 and 1753, consistant with a reported date of 1748.(16)

 

The exact nature of Benjamin's Revolutionary War service has not been established, but

the State of North Carolina paid him at least £207/5 in 1783 out of the Revolutionary

Army Accounts.(17) This may have been for military service or for furnishing a

considerable amount of supplies for the use of the army.

 

Abraham Sauls lived next to Benjamin Matthews, Sr. His granddaughter Mary married

Benjamin's son Benjamin about 1775. When Abraham died before May, 1771, his

granddaughter

Mary administered his estate.(10) It is not clear whether it was this Abraham who m.1 Dec

1762 Anna Screws or his son, but when he wrote his will in 1764, he gave his wife's name

as Ann. Known children of Abraham Sauls, Sr:

 

1. Abraham Sauls served as a Corporal in the South Carolina

__ Continental Regiment of Artillery from 1778 to 1782.(9) lived

__ in Darlington Co, SC until 1794. An Abraham Sauls bought land

__ in Warren Co, GA, 5 Mar 1803.

 

2. Absolam Sauls was a justice in Darlington Co, SC 1787

 

3. Lydia Sauls m.1766 Henry Screws

 

The Census of 1790, Nash County, North Carolina, lists Benjamin Matthews' family as

consisting of one male over age 16, 3 males under age 16, 4 females including his wife,

and one slave.(18) Benjamin's brother Joel Matthews lived nearby, and witnessed the deed

of the sale of a negro boy from James Blackwell to Benjamin Matthews on 30 March 1797, in

Nash County.(19) Benjamin and his wife Mary sold their land in Nash County 13 Nov

1797,(20) and his brother Joel sold his land in May, 1798.(21) A Benjamin Matthews

certified Harry G. Caldwell as a good citizen of Burke County, Georgia, April 16, 1795.

Many of the descendants of Hugh Matthews, including Tharp, Johnson, McKinney, and Newsom

families, joined the migration to Georgia, settling in Wilkinson, Wilkes, and Warren

counties. An Arthur Matthews held land in Warren County in 1794, adjoining lands owned by

Tharp and Newsom.(22) Benjamin Matthews witnessed the deed when Joel bought land in

Warren County on 3 Dec 1800.(23) Benjamin Matthews drew land in Warren County in the Land

Lottery of 1805 and again in 1814.(24) This land appears to have fallen into Twiggs

County, as Benjamin is listed as owning 153 acres on Pine Creek in the Tax Digest of

1818.(25) Mary Sauls Matthews died in Warren County, Georgia in 1806. Benjamin then

married Rebecca Pierson Brown (b. 12 Dec 1772) on 6 Dec 1806.(26) She was the daughter of

Jeremiah Pierson, born about 1735 in New Jersey, died after October, 1829, in Monroe

County, Georgia.(27) Benjamin and Rebecca joined Stone Creek Baptist Church in Twiggs

County on 24 Narch 1810. (27a) The pastor was Rev. Vincent A. Tharp (Vincent T.

Allentharp 1760VA-1825, who moved to Georgia in 1784) Rebecca removed her membership 25

Oct 1823, and joined Emmaus Primitive Baptist Church in Upson County in 1838.

 

Benjamin died between March and October, 1818.(28) and reportedly on October 17,

1818.(16) "Rebecca Matthews, widow" drew land in the 1821 Land Lottery.(29) This land was

in the portion of Monroe County which fell into Upson County when it was formed in 1824.

The land was located east of Thomaston. Rebecca died 13 Dec 1846.(30)

__Goza (Gosey) and moved to SC. In 1818, moved to Mississippi,

__Missouri, and back to Chester Co, SC by 1820. He died just

__before 1840, and Elizabeeth moved to Hot Springs Co, Arkansas,

__where her son Mark Goza lived.

Hugh Matthews arrived in the colonies in 1698. In the record of Cavaliers and Pioneers, he was transported by Richard Covington. He was granted 100 acres of land on March 23, 1715 and 20 acres on March 24, 1725 in the Isle of Wight County, Virgina. His land deeds were on the south side of Nottoway River and on both sides of Angelica Swamp. Later this land fell into what became Southampton, Virginia. In 1738, he sold the land.

 

HUGH MATTHEWS first appears in the records of Isle of Wight County, Virginia on March 16, 1715, when he and his wife MARTHA conveyed 50 acres on branches of Blackwater River to JOHN JOHNSON for 500 pounds tobacco, it being land left to MARTHA MATTHEWS by her father JOHN JOHNSON's will.

 

HUGH MATTHEWS patented 100 acres on the South side of the Nottoway River adjoining the Nottoway Indians on March 23, 1715 for the importation of Timothy Times and his wife Elizabeth Times

 

On March 24, 1725, he obtained another patent of 20 acres on both sides of Angelica Swamp in Isle of Wight County for the sum of 5 shillings.

 

HUGH MATTHEWS was appointed an appraiser of the estate of Henry Townsend in an order dated Jan. 25, 1728/29. The appraisal was returned to court by MATTHEWS, Thomas Pursell,and William Blake for registry on Jan. 27, 1728.

 

HUGH MATTHEWS did not have any further land transactions until July 17, 1738, when he sold a water mill and land of unspecified acreage on Angelica Swamp for 5 shillings to James Ridley. Witnessed by son-in-law Gilbert Mac Kenny and John Brewer, the deed was also signed by MARTHA MATTHEWS

 

HUGH MATTHEWS wrote his will in Southampton County, Virginia [officially formed in 1749] on November 7, 1747, witnessed by Daniel Sebree, Thomas Pursell, and George Stephens(on). It would appear that his wife MARTHA had predeceased him, for his will left legacies to his then wife ANN MATTHEWS.

 

The lengthy will of HUGH MATTHEWS, which makes reference to four sons, five daughters, five grandsons, and at least three deceased children, was submitted for probate on September 12, 1751.

 

Newitt Drew, Timothy Thorp, and James Jones appraised HUGH MATTHEW's estate at 72 pounds, 11 shillings, and 5 pence in an inventory dated Oct. 13, 1751.12 On Feb. 3, 1753, James Ridley, Timothy Thorp, and James Jones examined the estate and returned an account showing expenses of 39 pounds, 9 shillings, and 4 pence. Their account was returned to court for registry on March 8, 1753.13 Issue:

 

1. RALPH MATTHEWS. He apparently died intestate before Nov. 7, 1747 in Isle of Wight County, VA. His son RALPH MATTHEWS received a legacy of land on Angelica Swamp in the will of HUGH MATTHEWS.

 

2. JOHN MATTHEWS. He died prior to Aug. 27, 1739, when his widow MARTHA MATTHEWS returned an appraisal of his estate into Isle of Wight County Court [Isle of Wight Co., VA Will Book 4, p. 237].

 

3. JOSEPH MATTHEWS. He was born about 1710-15, and married ELIZABETH, perhaps the daughter of JOHN STEVENSON and CATHERINE WIGGS. On Oct. 15, 1753, he sold 150 acres on the South side of Three Creeks to John Brewer [Southampton County, VA Deed Book 2, p. 7]. He and his family were residing in Edgecombe Co., NC prior to July 13, 1764, when he conveyed two tracts of 275 acres and 691 acres on the North side of Swift Creek to Isaac Hilliard [Edgecombe Co., NC Deed Book C, pp. 296, 297]. He removed to old Cumberland County (now Harnett County) after 1771. His will was probated in Cumberland County in January, 1791.

 

4. WILLIAM MATTHEWS. He is probably the WILLIAM MATTHEWS, who with wife ELIZABETH sold 200 acres in Edgecombe Co., NC to James Benton on Feb. 11, 1760 [Edgecombe Co., NC Deed Book OO, p. 138]. He bought 497 acres on both sides of Swift Creek in Edgecombe County from Ebenezer Folsom on Sept. 8, 1762 [Edgecombe Co., NC Deed Book I, p. 388]. He conveyed 70 acres on Swift Creek to Benjamin Smith on March 1, 1771 [Deed Book D, p. 447]. He is referred to as WILLIAM MATTHEWS of "Cumberland Co., NC" when he sold 200 acres on Myrey Branch on the North side of Swift Creek to John Jones on March 1, 1771 [Deed Book D, p. 429].

 

5. EDWARD MATTHEWS. He died in Southampton County, VA prior to Aug. 12, 1762, when an account of estate was returned to Southampton County Court [Southampton County Will Book 1, p. 513].

 

6. BENJAMIN MATTHEWS. He apparently migrated to Edgecombe County, NC with his brothers JOSEPH and WILLIAM. He bought 200 acres on the North side of Swift Creek in Edgecombe County, NC on Aug. 19, 1746 [Edgecombe Co., NC Deed Book 3, p. 7]. He died intestate prior to September Court, 1762, when his daughter PHEBE MATTHEWS was granted administration of his

estate. His estate was sold Oct. 9, 1762, and account of sale was returned to court in January Court, 1763 [Watson, "Estate Records of Edgecombe Co., NC," Durham, NC: Seeman Printery, Inc., 1970, p. 176].

 

7. [Daughter] MATTHEWS. She married SOLOMON STEVENSON, Sr., and apparently had died prior to Nov. 7, 1747. Her son "SOLOMON STEPHENSON, Jr." was bequeathed land on James Branch in the will of HUGH MATTHEWS.

 

8. MARY MATTHEWS. She married _____ THORP. No Data.

 

9. SARAH MATTHEWS. She married first GILBERT MAC KENNY, whose estate was appraised by Timothy Thorpe, Henry Rose, and James Jones, and returned by SARAH MAC KENNY on July 10, 1746 [Isle of Wight Co., VA Will Book 5,p.26]. It is highly probable that she married secondly, SOLOMON STEVENSON, Sr. (her deceased sister's husband) prior to August 31, 1750 [Southampton

Co., VA Will Book 1, p. 109].

 

10. MARTHA MATTHEWS. She married SOLOMON NEWSOM, son of Thomas Newsom

and Elizabeth (Crafford) Newsom. SOLOMON NEWSOM and his wife had a real estate conveyance in Isle of Wight County, VA on April 22, 1746. They removed to Brunswick Co., VA as early as 1752, and to Wilkes Co., Georgia by 1777. An inventory of his estate was taken in Wilkes County, Georgia on Dec. 4, 1795 ["The Newsom Family" by B. C. Holtzclaw, in "Genealogies of Virginia Families," Volume 4, p. 518].

 

11. HESTER MATTHEWS. She married WILLIAM JOHNSTON, son of Benjamin and Mary Johnston of Isle of Wight County, VA. On May 10, 1752, he sold JOSEPH MATTHEWS 150 acres on Fork Branch in Southampton County [Deed Book 1, p. 328]. On May 11, 1787, WILLIAM and [H]ESTER JOHNSON of Wilkes Co., Georgia sold Jesse Cooper 75 acres south of Three Creeks in Southampton

County, VA. They sold James Porch 50 acres on Gum Branch and George's Branch in Southampton Co., VA on May 18, 1787 [Deed Book 7, p. 440; Deed Book 8, p. 10].

In the Name of God Amen, I HUGH MATTHEWS of the County of Southampton in Nottoway parish do make this writing my last will and testament in form and manner as followeth. Item. I give and bequeath to my grandson JONAS MATTHEWS son of JOHN MATTHEWS deceased 200 acres of land lying on the East side of Angelica Swamp being part of a tract of land formerly taken up by Captain William West and now possessed by Edward Drew I say I give the said tract of land to him and the heirs of his body lawfully begotten. Item. I give and bequeath to my grandson RALPH MATTHEWS son of RALPH MATTHEWS a certain tract or parcel of Land lying on the East side of Angelica Swamp a survey lately made by Major James Baker the Contents not known at present I say I give the said land to him and his heirs. Emigration: ( from the net per Bill Matthews) Hugh was transported to the colonies in 1698 by a Richard Covington, who was granted 1091 acres in Essex County, VA. on April 26, 1698 for inporting 23 persons

 

Hugh left a bequest of land to his grandson Solomon, Jr. in his will of 1747 (probated 1751) .  the daughter, Solomon, Jr.'s mother, was evidently deceased by the time of her father's 17 47 will.  Solomon, Jr. was probably only a small child at the time of this bequest.  Solomon , Sr. was evidently married secondly by 1750 to Sarah (Matthews) McKinney, another daughter o f Hugh Matthews.  She was the widow of Gilbert McKinney, who was deceased in 1746.  Sarah i s called Sarah McKinney in her father's 1747 will.  She is mentined in the will of her mother -in-law Katherine (Wiggs) Stephenson in 1750, so she married Solomon, Sr. between 1747 and 17 50.  By Sarah, Solomon, Sr. had David Stephenson, John Stephenson, Olive Whittington, Sarah J ohnson White, Patty Langdon, and James Stephenson

Mat(t)hews, Mat(t)hews, Mat(t)his of Gates County, NC all likely descended from Hugh Mathews of Southampton County, Va. and possibly from his wife Martha Johnson (believed to have been a great grandaughter of Ancient Planter and John Johnson of Jamestown.) Hugh Mathews believed to have been son of the Ralph Mathews who was transported to Westmoreland County, Va. by Wm Drummond who received land grant in Westmoreland County, Va. in 1658. Hugh Mathews purchased 850 acres in Isle of Wight County, Va. on credit from William Cooke in 1667. In 1671, William Cook, being owed money (or tobacco) was granted and "extent" against the lands of Hugh Mathews in Isle of Wight County, Va. no other estate of Hugh mathews being found there. In 1675 Hugh mathews was still in Westmoreland county as he was listed as a judgement debtor there of Rotterdam, Holland creditors represented in Virginia by agent Alexander Dolaphanie. In 1679, Col. Arthur Smith of Isle of Wight County, Va. who was possibly a relative or in-law of Ralph Mathews was granted land in Isle of Wight county for the transport of numerous persons there, including Ra.& Hugh Mathews. Ralph Mathews died in Isle of Wight Co, Va. 1687 leaving a widow Alice. His nuncupative will, made in the presece of Col. Arthur Smith, who may have been a relative of he or his wife, asked Col. Smith or his son Arthur to oversee Ralph's three unnamed, underage children, two of whom were surely named Edmund and Ezekiel. Hugh Mathews (presumably an older son of Ralph Mathews) died in Southampton County, Va. which was formed from Isle of Wight in 1747, sometime between the date of his 1747 will and his 1750 inventory date. He was still married to wife Martha Johnson as late as 1730, but she apparently died before him and he remarried Ann---? who was his co-executor. Hugh Mathews had sons named John, Ralph, Joseph, Edward, Benjamin and William, some of whom died before him. See his will in Southampton County, Va. His sons Ralph and John were in North carolina, in the area that I believe later became Gates County, N.C. in 1718

Hi, I have this information on Martha Johnson. Martha Johnson, most likely the daughter of John Johnson, the elder, and first wife Mary, was born in Isle of Wight County, Virginia about 1688. Her father, in his will made in Isle of Wight County on January 7, 1703/04, and probated on August 9, 1707, bequeathed "to my daughter Martha, 50 acres of land, half the household goods at Blackwater, and one shilling in lieu of any part in her stepmother's estate." By 1715, she had married Hugh Matthews (or Mathews) who may have been a widower. Presumably he was a son of Ralph and Alice (?) Mathews. Hugh Mathews was probably one of three unnamed children mentioned in the will of Ralph Mathews on August 13, 1687, proved by Boaz Gwin and Robert Brock, and requesting Colonel Arthur Smith to serve as Overseer of said children. On October 21, 1687, the widow, Alice Mathews, qualified as executrix.

 

On March 18, 1715/16, Hugh Mathis and Martha Mathis of the Upper Parish deeded to John Johnson of the Lower Parish for 500 pounds of tobacco, 50 acres on the branch of Blackwater adjoining said John Johnson that had been left to said Martha in her father John Johnson's will dated January 7, 1703/04; witnessed by Henry Sanders, Arthur Smith, and John Watts. Martha predeceased her husband, Hugh, after which he married Ann (?).

He removed to old Cumberland County (now Harnett County) after 1771. His will was probated in Cumberland County in January, 1791.

Re: John Mathews. Again, obviously one of the older sons of Hugh Mathews. John Mathews had a son named William who I believe came to be referred to as William Mathias in Gates County, N.C. Volume 3, No.1, p.126 of Hathaways Register mentions William Mathews and John Mathews in Gates County, N.C. as witnesses to a conveyence of real estate from

Aaron (Mathews?) to Amos Blanchard on Nov. 10, 1736. Hugh Mathews son John Mathews also had another son besides his son William. The other one was named Jonas. Hugh Mathews 1747 will, recorded in Southampton County, Va. mentioned him as Jonas, son of John Mathews (deceased). John "Mathias" will was recorded in Perquimans County, N.C. in April 1748 mentioning his son William and a wife Elizabeth. William "Mathias" died testate in Gates County in 1798. (I believe his executor was Kedar Ballard, who was an officer in the 3d N.C. Regiment during the Revolutionary War.) This William "Mathias" who died in 1798 also had a son named William.

Thats about all I know about Ralph and John, sons of Hugh Mathews and their descendants. I was very interested to read that your husband is descended from Hugh Mathews son and co-executor Joseph, who I know settled on Swift creek in what was at that time Edgecombe County but may be Nash County today. I'm descended from Hughs son William Mathews who got embroiled in a legal wrangle in the Southampton Courts with Hughs last wife and co-executor Ann Matthews. He apparently illegally held on to some assets that he was supposed to have surrendered after his fathers death. She sued him and he immediately absconded to North Carolina, purchasing 200 acres on the S. side of Fishing Creek in Edgecombe County in 1753. Hughs son Benjamin had preceeded him in moving to Edgecombe County, having moved to the Swift Creek location in about 1747-1749. Hughs son Joseph also moved to the Swift Creek location, so I don't know why my ancestor William moved to the Fishing Creek area unless he was persona non grata to the rest of the family after the squabble in Southampton County; anyway, only he moved to the Fishing Creek location in Edgecombe while Joseph and Benjamin both moved to the Swift Creek area. (Hughs son Edward died in Southampton County, Va. in about 1760.)

My interest is Hugh's son, Benjamin, and Benjamin's son, also Benjamin. Benjamin, Sr. was only given one shilling by his father’s will. However, in 1739 he was granted land in Edgecombe County, North Carolina. He also purchased additional land in 1746 and 1760 on the North Swift Creek where it joined the mouth of the Rocky River. This land became part of Nash County in 1777. He apparently migrated to Edgecombe County, NC with his brothers Joseph and William. He bought 200 acres on the North side of Swift Creek in Edgecombe County, NC on Aug. 19, 1746 [Edgecombe Co., NC Deed Book 3, p. 7]. Also owning land in this area were William and Joseph, as well as the family of Abraham Sauls, whose daughter Mary would marry Benjamin's son. Benjamin, Sr. died intestate shortly before September 4, 1762. The administration of his estate was granted to his daughter Phebe Matthews since his widow was unable to serve. An inventory was made in September, sold on October 9, 1762, and and accountof the sale was reported in January 1763. [Watson, "Estate Records of Edgecombe Co., NC," Durham, NC: Seeman Printery, Inc., 1970, p. 176]

On October 25, 1763 William Matthews, Benjamin's brother, was appointed guardian to the orphan Benjamin Matthews indicating that Benjamin, Sr's wife had most likely died and that son Benjamin was still under the age of 21; he was also likely the youngest child, since he is the only child for whom a guardian was appointed.

       The following  information came from James Matthews Liptrap, also a member of the mailing list. .. but errors in transcription are mine.

 

   When Benjamin (I) died in 1762, his wife was not able to administrator the estate and Pheba was given that job.  From indications, Benjamin (II) may have been about 13, since an uncle was appointed as his guardian in 1763 when he was described as an orphan.  In 1790, Benjamin (II) is now in Nash Co, NC.  His brother Joel lives nearby - he was a witness on the deed for the sale of a negro boy from James Blackwell to Benjamin.  On 13 Nov 1797 Benjamin and Mary sell their land.  In May, 1798 Joel also sell

 

     On 3 Dec 1800, Joel buys land in Warren Co and his brother Benjamin is a witness.  Benjamin draws land in the Land Lottery of 1805 and 1814 - which appears to have fallen into Twiggs Co.

It is absolutely clear that the William Mathews who entered the 250 acres in Duplin in 1779 was the same man as the NC Continental soldier of that name who was either killed in action or died in the line of duty at some time during the war.....

I Simon Matthews of the county of Cumberland and State of North Carolina being of sound mind and memory but considering the uncertainty of my earthly existence do make and declare this my last Will and testament in manner and form following that is to say:

 

                First that my executor hereafter mentioned shall provide for my boddy a decent burial suitable to the wishes of my relations and friends and pay funeral expences together with my just debts howsoever and to whomsoever owing out of the moneys that may first come into his hands as a parte or parcle of my estate.

 

                Second I have given to my son Jacob Matthews (by my first wife) one negro boy named Paschael Sandy which I intend for his share.

 

                Third I have given to my son John Matthews (by my first wife) two negrs Mary and Ansey which I intend for his share.

 

                Fourth I have given to my son James Matthews (by my first wife) one negro boy named Paschael  which I intend for his share.

 

                Fifth I have given to my daughter Barbar McLeod one negro girl named Ansey which I intend for her share.

 

                Sixth I have given to my son Archibald Matthews one negro girl named Mariah which I intend for his share.

 

                Seventh I have given to my son Simon Matthews (by my first wife) one negro girl named Jane which I intend for his share.

 

                Eighth I have given to my daughter Nancy Johnson one negro woman named Tellar which I intend for her share.

 

                Ninth I have given to my daughter Elizabeth Dennis one negro girl named Francis.  Also one hundred dollars in money to be paid by my executor in two years after my death which I intend for her share.

 

                Tenth I have given to my daughter Mary Matthews one negro girl named Patience which I intend for her share.

 

                Eleventh I give to my beloved wife Nancy Matthews for and during her natural life or widerhood all lands and plantation that is hereafter given to my son David Henry until he comes to the age of twenty one years and after he arrives to the age of twenty one it is my will she shall not cultivate any of the land hereafter given to my son David Henry on the west side of Neill's Creek and the land on the east side beginning at Murdock McLeod's fence then up Neills Creek to the fence that runns out from the creek and crosses the branch that passes thru my field known as my fish trap field thence(?) with that fence to said branch thence up said branch to its head thence to Thomas Matthews line near the Stephen old field.  It is my will that she shall not cultivate the lands below the above boundry and that my son David Henry take possession of the same when he comes to the age of twenty one and the balance of the lands given him on the west side of Neills Creek.  It is my will that my beloved wife Nancy Matthews shall use the balance of my son David Henry's hereafter given him including my dwelling house so long as she shall live except the lands above excepted when my son David Henry comes to the age of twenty one.  If she should marry it is my will that David Henry take pocession of all the lands given him together with dwelling house.  I further lown to my beloved wife Nancy Matthews for and during her natural life or widerhood the following negros viz Ned(old) Isaac Wesley Henderson & Preny.  I further give or lown to my wife Nancy Matthews one yoke of oxen and carte, three head of choice horses, six head of choice cows and calves, twenty head of sheep, forty head of hogs, black smith tools, family carry all, household and kitchen furniture.  I further desire the property given or lowned to my wife Nancy Matthews (except the negros) at her death or marriage to be sold and the proceeds equally divided among my last wife's children except the black smith tools which I want to remain on the premices for y son David Henry.

 

                Twelfth I give to my son Joseph H. by my last wife the following negros,  young Ned & Jennett also I give him all the lands I own on the west side of Neill's Creek lying below C. H. Cofield and west of the Spence tract of land on the lot branch.

 

                Thirteenth I give to my daughter Citty Ann(?) Hollan one negro girl named Caroline and her two child Guston & Julius during her life and at her death it is my will the negros and there increase shall go to the lawful begotton heirs of her boddy (her children).

 

                Fourteenth I give to my son young Anderson three negros Viz old Ned Wesley and Anderson & seventy five dollars in money to by a horse bridle and sadle or a horse bridle and sadle.  Also my lands lying north and east of certain lines beginning North of Kern's Creek running up said creek to the mouth of Stephens Spring branch thence up said branch to the ford where my line crosses said branch thence south to a stake near Thomas Matthews? corner thence east to the waters of Buey's Creek.

 

                Fifteenth I give to my son David Henry two negros (boys) Henderson and Bright and and old fellow named Isaac.  I also give him a certain tract or parcle of lands including my home tract and plantation where I now live lying on both sides of Neill's Creek also seventy five dollars in money or a horse bridle and sadle.

 

                Sixteenth I give to my daughter Aumanty Harlow and to the lawful begotton heir of her body one negro girl named Eeady.

 

                Seventeenth I give to my daughter Nancy Catharing one negro girl named Emeline.  It is my will at the death of my daughter should she have any children for Emeline and her increase to go to her children.

 

                Eighteenth I give to my daughter Mary McFarlin two negros Mary and Marshal and should my daughter die leaving children it is my will the negros I have given her shall go to them (children) at her death.

 

                Nineteenth it is my will that Gincy(?) who I have given to my wife during her natural life or widowhood shall go to my last wife's children and her increase if any at the death or marriage of my wife.

 

                Twentyeth it is my will that my minor children and negros shall stay on the plantation with my wife provided she shall clothe and support my minor children until they are twenty one for the use of their negros.

 

                Twentyfirst my will and desire is that all the residue of my estate (if any) after taken out the desires and legacies above mentioned shall be sold and the debts owing to me collected.  If there should be any surplus over and above the payment of debts expences and legacies that such surplus shall be equally divided and paid over to my last wife's children in equal proportions, share and share alike to them and each and ever of them their executors administrators and assigns absolutely and for ever.

 

                And lastly I do hereby constitute and appoint my son Joseph Hawkins my lawful executor (secondly David Holland should Joseph not act) to all intents and purposes to execute this my last will and testament according to the true intent and meaning of the same every parte and clause thereof.  I hereby revoking and declaring utterly void all other wills and testaments by me heretofore made.

 

                In witness whereof I the said Simon Matthews hereunto set my hand and seal this the twelfth day of May A.D. one thousand eight hundred and fifty three.

 

 Signed sealed published and declared by the said Simon Matthews to be his last will and testament in the presence of us who at his request and in his presence do subscribe our names as witnesses thereto.

Whereas I Simon Matthews have made my last will and testament in writing bearing date on the 12th day of May 1853 and have thereby made sundry devices and bequests according to what I then believed to be just right and equitable have since materially changed my minde.  I do by this my writing which I hereby declare to be a codicil to my said will to be taken and construed as a parte thereof will and direct that the boundry line dividing the lands between my wife (Nancy Matthews) and my son David Henry be changed (or so altered as to give to my wife the lands laying both sides of the roade near William Johnson's) viz up the branch that runs threw my fish trap field as set forth in my Will until it gets opposit
