John Marshall was born Abt. 1711 in Brunswick Co. Virginia, and died Bet. July 1782 - November 1785 in Mecklenburg Co. Virginia. He married Mary Malone on Abt. 1739 in Virginia.

It has been published in more than one genealogy of the Marshall family that John Marshall of Mecklenburg Co., Virginia was the son of William Marshall and grandson of Alexander Marshall, a line inclusive of several prominent members. There is no proof of a close connection between our John Marshall and that line. The extensive research of Lou Poole establishes and separates some of the misconceptions about the several John Marshall lines in early Virginia. Our John Marshall of Mecklenburg Co. Virginia had a brother named Samuel and left a will written in 1782. His parents are unknown. Many early Virginia records were destroyed during the Civil War which would likely have answered many questions and clarified family relationships.

John Marshall of Mecklenburg Co. Virginia received a patent dated October 28, 1732 containing at least 220 acres, in what was then the new county of Brunswick. No record of this patent survives however it is mentioned in several later deeds.

September 26, 1753 John Duke vs. John Marshall: A case of slander for which John Marshall was found guilty of L9 worth of damage. Sackville Brewer and Edward Ellis and Elizabeth Ellis appeared as witnesses for Duke. Lucas Powell and William Harrison appeared as witnesses for John Marshall. John Parrish was paid for 9 days attendance and 18 miles.

(Note: the same deed was recorded in Lunenburg County, dated December 1, 1761.)

John Marshall's will, was dated July 17, 1782, in Mecklenburg Co. Virginia. The will was recorded on November 14, 1785, in Will Book 2 page 132. His wife (Mary?) was not mentioned as she had predeceased her husband. John Marshall mentions his children: Samuel Marshall, James Marshall, Benjamin Marshall, Lucy (Marshall) Malone (wife of George Malone, widow of George Carter), and Ann (Marshall) Nance (wife of Robert Nance). Also mentioned are grandchildren: Jesse Carter, Catherine Carter, Mary Ingram, Betsy Hooper (Lucy Marshall Carter Malone's children), and Judith Nance. Specific bequests were made to each of those named in the will. The executors were John's sons Samuel and James Marshall, and the witnesses were; John Arnold, William Pegram and his granddaughter's husband, Elisha Arnold (husband of Sally Marshall, the daughter of Samuel and Cassandra Marshall).
