16. ANDREW4 MCBRAYER (SAMUEL3, WILLIAM2, FATHER '1ST GEN'1) was born Abt. 1788 in Rutherford Co., NC, and died Abt. 1851 in St. Clair Co., AL. He married SARAH JOHNSON 1809 in Buncombe Co., NC, daughter of JAMES JOHNSON and ANN COLE. She was born February 16, 1796 in Greenville Dist., SC, and died Aft. 1870 in AL.

NDREW MCBRAYER:
Andrew lived in the area of his childhood in Buncombe County, NC, until about 1834 when he moved with most of his family to Alabama. They settled near Springville in St. Clair Co.

There are several records on file for Andrew. He bought land on Rocky Mountain at the head of Roaring Branch, "..it being a branch of Shaw's Creek", in Buncombe County, NC, from his brother, John, for $100 on 30 Nov 1816. The deed was witnessed by James Johnson, the father of his wife, and Malinda Johnson. He lived on the land until 20 Nov 1822 when he sold it to James Taylor and Joseph Gilbert for his original $100. The land had originally been granted to his brother, John, on a patent dated 21 Dec 1809.

Evidently he had either bought or had been granted additional land prior to 1822 as on the 30th of Sep, 1822, Sheriff Henry Grady of Buncombe County sold to Samuel King, Sr., 150 acres of land on King Mill Creek above the dam, property which had been seized from Andrew McBrayer, and sold to the highest bidder for $25 to satisfy a debt of 5 pounds, 1 shilling, 11 pence, and three farthings.

He was granted, in conjunction with Benjamin King, still more land - 100 acres in Buncombe Co., on 12 Dec 1832. This land was located "on the branches of King's Mill Creek, joining lands of the said King and the land where said McBrayer now lives".

The last grant to Andrew, which has thus far been located, was for 150 acres in Buncombe County "on waters of William's Creek, including Reiner's old improvements", which was issued on 5 Dec 1833. This must have been just prior to his move to Alabama.

He moved with his parents and family to AL in the mid 1830s. Below is a transcript of the will of James as taken from his probate records (from the files of Lynn Akin, Birmingham, AL. - 1992);

            [THE STATE OF ALABAMA, ST CLAIR COUNTY]
      All to whom these presents shall come Greeting That I James F. McBrayer of the state and county aforesaid, do make and ----- this my last will and testament. In the name of God amen.
      1st My first wish will and assign is that my body be decently interred and my soul return to He who gave it.
      2nd My second assign is that all of my effect both real and personal shall remain in the hands of my mother Sarah McBrayer during her natural life and then disposed of in the most effectual manner to the good of my several heirs.
      3rd My third wish will and assign is that Eli Jones of the county and state aforesaid be appointed my executor in this my last will and testament.

      According to the probate records, (St Clair County, AL, Bk "D" (1860-1866 pgs 1-12) (probation began of 22 Nov 1859 - concluded on 6 Mar 1860), James never married. He died between the date of his will (1856) and Nov 1859 in St Clair Co., AL, where he is presumed to have been buried.

Allen and Harriett McBrayer, sisters of dec'd of full age and reside in Henderson County, NC, and William McBrayer, brother of the dec'd and full age and resides in the State of California and Jonathon McBrayer, brother of the dec'd of full age resides in the state of Mississippi.       Both he and Martha are buried at the Fletcher Cem (old 'John Fletcher Place'), on Howard Gap Road, near Fletcher, Henderson Co., NC.
      The town of Fletcher, NC, is named for this family. It is located in Henderson Co.
      John and his first wife, Elizabeth Savage, had 13 children.
      It was believed that the name "Seyn" was a family surname.

      "He served in the Civil War - North Carolina Troops: 1861-1865, Vol VII, pg 430 - Ordnance Sargeant. He resided in Henderson Co. Where he enlisted at the age of 30 - Jul 15, 1861/ Mustered in as Private and was promoted to Ordnance Sgt. in May-June 1862. Present and accounted for until wounded in the left hip at or near Fort Stedman, VA, Mar 25, 1865. Hospitalized at Richmond, VA, where he was captured by the North on Apr 3, 1865. Transferred to hospital at Point Lookout, MD, on or about May 6. 1865; released on or about Jun 26, 1865, after taking the Oath of Allegiance."

ANE MCBRAYER:
There is some confusion as to when Jane died. It was thought she died about 1850 in AL, however, she appeared in the 1860 Federal Census, Milan Co., TX, but did not appear in the 1870 census. John may have remarried, moved to Bowie Co., TX, and then to Bell Co., TX, where he died.

OHN B. GLAZENER:
It is possible that John moved the family to AL after 1838. It was about 1840 when her brother, Andrew, moved there. Jane's half-brother, David, had already migrated to AL in 1818-1821. It seems reasonable they (John and Jane) would have settled near their kinfolk. (Not data on issue)
