20. WILLIAM4 MCBRAYER (SAMUEL3, WILLIAM2, FATHER '1ST GEN'1)28 was born Abt. 1764 in "Williamsburg", Cumberland Co., PA, and died Abt. 1819 in Rutherford Co., NC. He married ELIZABETH MARVIN Abt. 1788 in Rutherford Co., NC. She was born Bet. 1763 - 1765 in Rutherford County, NC, and died Aft. 1850 in Cleveland Co., NC.

Notes for W
ILLIAM MCBRAYER:
He was born in Cumberland Co., PA, ca 1764, on his grandfather's farm, "Williamsburg".

He moved with his parents, while still a babe-in-arms, to the Carolinas (about 1765). (His father was in Mecklinburg Co., NC, about 1765-66, according to land grants located in the files in both North and South Carolina.) William grew up on the family farm, which was at first located in 'old' Mecklinburg County, then in Tryon County, and finally in Rutherford County, NC. (The county lines changed every few years.)

Some researchers of the family genealogy have confused this William with the William of South Carolina, his uncle.

On 11 Jul 1791 (Bk J-L, P 144, #1137, Rutherford Co., N.C.) Samuel McBrayer "of Rutherford Co" sold his son "William McBrayer of said county and state" a 200 acre tract of land on the waters of the First Broad River. Evidently up to this time William had not owned land, but he was witness on many prior deeds for his father.

When Samuel moved his family to Buncombe County in 1797, William elected to remain in Rutherford Co., where his roots were by now becoming deeply entrenched. He became active in community affairs and was elected one of the Commissioners for Rutherford County (later Cleveland Co.) and "At the April term, 1802, court of Pleas and Quarter Sessions, the plat of the town of Burr was brought in by William McBrayer, one of the Commissioners, and was approved." ("History of Old Tryon and Rutherford Counties 1730-1936", by Clarence W. Griffin, p 150)

"In January, 1819, the court appointed LEMUEL MOORE, M.R. ALEXANDER, and THEO BIRCHETT, a committee to settle with the old commissioners, JOSEPH CAMP, WILLIAM MCBRAYER,....(and others), or the survivors of them..." (ibid, p 167)

William was apparently a quite prosperous individual and bolstered his land holdings. On 25 Sep 1795 he bought 200 acres on Hickory Creek on the north side of the Little Broad River from ABRAHAM KUYKENDALL of Buncombe Co. for 150 pounds currency. He bought an additional 200 acres from the same individual on 3 Sep 1802. This land, too, was located on the Little Broad. He purchased 3 lots or squares in the town of Burr, Rutherford Co., on 5 Dec 1805. He, as a commissioner, had sold his brother, Samuel, Jr., a lot in Burr on 29 Apr 1803.

It is said, and proven by the fact of many legal entanglements and deeds by his children, that William was quite prosperous at his death in 1819, and owned many acres in Rutherford (later Cleveland Co.) Co., NC.

William was married to ELIZABETH MAROON (MARVIN, MARVON). She could possibly have been the daughter of JOHN MAROON, who was listed on the Rutherford Co, NC, tax list in 1782 - CAPT. HUGH BEATY'S Company or PETER MERONE (MAROON), who was listed in Rutherford Co. tax list - 1785 - Folio III.) (Terry Perritt, West Monroe, LA, provides the information that she discovered in the 1800 census of Rutherford Co., NC, a JACOB MAROON and a JOHN MAROON, both listed on page 130. "They are listed on either side of William McBrayer. On the LDS ancestral file they are listed as sons of a PETER MAROON, b 1745, NC...")

It was thought that Elizabeth died ca 1845 in Cleveland Co., NC, but a census listing submitted in 1987 by Kirby Watkins of Arlington, TX., shows the following information.
Cleveland Co., NC, U.S. Census 1850, entry #581
      * JUDY RUSKE, age 50 (F), born NC, (pauper) (her family is listed.
Living with Judy was: ELIZABETH MCBRAYER, age 87, b NC.

Elizabeth was apparently still living in 1850 in Cleveland Co., NC. Based of census reports and other records and the records of JAMES F. STRICKLAND (1866-1962) (also provided by Kirby Watkins, William and Elizabeth had issue (4th gen):
      1. Rebecca McB., b 1788
      2. Samuel McB., b 1790 (#362)
      3. Jerimiah McB., b 1791 (#209-5)
      4. Martin McB., b 1794 (#297)
      5. James McB., b 1796 (#161-5)
      6. POLLY MARY MCBRAYER, b 1802, m MOSES DICKEY
      7. Jason McB., b 1806 (#205)
      From Strickland's records:
      8. JEMIMA MCBRAYER, b 1786
      9. JANE MCBRAYER, b 1798, m --?-- HOGUE
      10. JUDY MCBRAYER, b 1800, m --?-- RUSS (RUSKE), was living in Cleveland Co., NC, 1850.
      *11. ALMIRA/ELMIRA MCBRAYER, b ca 1805/1815

Rutherford County deeds: "2 Aug 1819 - Elizabeth McBrayer, Jemima McEntire, Francis Beaty, James McBrayer, Moses Dickey, Martin McBrayer, (Legatees of William McBrayer, decd.)...of the first part and Samuel McBrayer of the other part. (sold to Samuel for $50, a tract of land on First Broad River, Rutherford Co., estimating 130 acres.)

William and Elizabeth, according to the NC census records, had more children than those whose names are listed. They may have died young, which would result in their not being listed in other documentation.

In 1810 William operated a "moonshine still" capable of producing 350 gallons of "shine", and was assigned an evaluation of $145 by the authorities. He also owned one slave in 1810.

Notes for E
LIZABETH MARVIN:
Elizabeth was living with her daughter in Cleveland Co., NC, in 1950.

Very little is known about this son. He was reported to have married --?-- MCINTIRE, though no records have been located to verify this. No other records have been located concerning this son.
